vSolicitation Ref.
Questions
H-5 Clause
Question #1: Please provide copies of the referenced CBA including addendums so that offeror may provide appropriate pricing for the labor covered by the referenced CBAs.
Government Response: The Government addressed this question in Amendment 6 Question 2 and Amendment 8 Question 23 previously addressed, stating "CBAs are agreements to which the Government is not a party; therefore, the Government cannot provide CBAs to prospective offerors. It is the prospective offerors' responsibility to negotiate wage rates with cognizant unions."
Solicitation clause H.5 identifies appropriate Wage Determination which identify minimum rates applicable to the geographic location of the work. FAR 22.1002-3 Wage determinations based on collective bargaining agreements requires "contractors to pay wages and fringe benefits at least equal to those contained in any bona fide collective bargaining agreement entered into under the predecessor contract." As such, should an offeror propose a rate at least equal to the Wage Determinations identified in H.5. but less than that covered in a collective bargaining agreement, the Government will adjust the offeror's proposed price during its evaluation of price reasonableness to reflect the rate from the predecessor contract collective bargaining agreement.
J-20
Question #2: Please note that errors exist in the revised J-20 schedule. The escalation in the option years was removed from the non-exempt amounts in each Mess Hall; however, the Mess Hall Totals in the Mess Hall columns on the Total Labor Cost worksheet were not updated correspondingly (e.g. see cell B12 - should be sum of 2 above and total $1,077,924; but is a hard number at $1,109,236). The Grand Totals at the bottom and far right are formulas and have been updated automatically.
Government Response: Concur. Attachments J-20 to East and West Coast solicitations are revised.
