About this file

This is a sample Labor and Materials Bond document required by the City of Orange Beach, Alabama for state and local contract opportunities. The bond serves as a financial guarantee that the principal contractor and all subcontractors will promptly pay all persons supplying labor, materials, or supplies for work performed under the contract, as well as reasonable attorney's fees incurred in successful claims against the contractor. The bond is executed jointly and severally by the principal contractor and surety, with the penal sum amount to be specified based on the contract value. The bond is subject to Alabama state law, specifically the Act of the Legislature of the State of Alabama approved February 8, 1935, regarding bonds and contractors on public works projects.

Key conditions and limitations of the bond include that claimants have direct rights of action against both the principal and surety and must assert claims within one year after final settlement of the contract in the county where work is performed or where the principal or surety conducts business. The surety's liability is capped at the bond's penal sum and is not subject to suits instituted more than one year after final contract settlement. The bond excludes liability for damages recoverable under Workers' Compensation or Employer's Liability Statutes. The document requires that all parties provide full legal names and residences, corporate entities include their state of incorporation and execute under corporate seal, and the bond date must not precede the contract date. For the Orange Beach Tennis Court Resurfacing and Cabana Installation project, winning bids exceeding $50,000 require a Labor and Materials Payment Bond equal to 50% of the contract amount.
