About this file
This is a Labor and Material Payment Bond form required by the City of Beaverton, Oregon for the Erickson Avenue Waterline Replacement project (2nd Street to 5th Street). The bond serves as a guarantee that the contractor will pay all laborers, material suppliers, and claimants involved in the project. The project involves replacing approximately 1,060 linear feet of 1940s-era 8-inch cast iron water main with new ductile iron pipe, including 1,020 feet of 12-inch pipe and 40 feet of 8-inch pipe, along with two system connections, one fire hydrant assembly, two water services, and associated appurtenances. Work will occur within the roadway in a residential area adjacent to Beaverton High School, which is undergoing concurrent renovations requiring coordination to maintain access throughout construction.
The Labor and Material Payment Bond requires the principal contractor and surety to guarantee payment in a sum equal to the total contract amount plus any extra orders issued by the City. Claimants—defined as laborers, material suppliers, subcontractors, and entities with claims for employee benefit plan contributions—have 90 days after final work or material delivery to receive full payment before they may file claims against the bond. All claims must be preceded by written notice to the principal and the City's Finance Director within 180 days of last labor or materials provided (or 200 days for benefit plan claims), and suit must be filed within two years and exclusively in Washington County Circuit Court or the U.S. District Court for the District of Oregon. The bond amount is reduced by any payments made in good faith, including mechanic's liens paid by the surety, and the surety waives notice of any contract modifications, extensions, or specification changes.
