About this file
This document is a Labor and Material Payment Bond for the City of Beaverton, Oregon, related to a tenant improvement project for the Oregon Startup Center (OSC). The bond covers a construction contract for remodeling spaces on the third floor of the Beaverton E-Suites, which will include renovation of a non-profit incubator, OSC offices, and a shared kitchenette. The bond serves as a financial guarantee that the principal contractor will make prompt payments to all claimants (labor and material suppliers) involved in the project, with a total bond amount to be specified by the parties.
The payment bond includes specific legal provisions protecting claimants, with a 90-day window for payment and a 180-day notice requirement for claims. The bond allows for legal action in Washington County Circuit Court or the U.S. District Court for Oregon if payment disputes arise. The surety agrees to maintain the bond's obligations despite potential changes in the contract terms, and the bond will remain in effect until all labor and material claims are satisfactorily resolved. The bond is part of a public contract subject to Oregon Revised Statutes (ORS) Chapter 279C, ensuring compliance with state procurement regulations for public works projects.
