SECTION 01 0270
APPLICATION FOR PAYMENT
PART 1 GENERAL
1.01 SUMMARY
A. This Section specifies administrative and procedural requirements governing the Contractor's Applications for Payment.
B. Payments shall be made in accordance with Contract Clause FAR 52.232-5 entitled, “Payments Under Fixed-Price Construction Contracts”.
C. Contractor shall use the payment form as provided by the United States Property and Fiscal Office (USPFO), Contracting Office. Contractors request for progress payments shall include the following substantiation:
1. Itemization of the amounts requested, related to the various elements of work required by the contract covered by the payment requested.
2. A listing of the amount included for work performed by each subcontractor under the contract.
3. A listing of the total amount of each subcontract under the contract.
4. A listing of the amounts previously paid to each such subcontractor under the contract.
5. Additional supporting data in a form and detail required by the Contracting Officer.
1.02 SCHEDULE OF VALUES:
A. Coordinate preparation of the Schedule of Values with the Contractor's Construction Schedule.
Schedule of values will be categorized into the major divisions and further categorized into sub-divisions within the major divisions as determined by the Contracting Officer.
B. Correlate line items in the Schedule of Values with other schedules and forms, including:
1. Contractor's Construction Schedule.
2. Application for Payment form.
3. List of Subcontractors.
4. List of Products.
5. Schedule of Submittals.
6. Submit the Schedule of Values to the Contracting Officer's Technical Representative at the earliest date, but no later than thirty (30) days before the date scheduled for submittal of the initial Application for Payment.
1.03 IDENTIFICATION:
A. Include the following identification:
1. Project Name and Location.
2. Name of the Architect.
3. Project number.
4. Contractor's name and address.
5. Date of Submittal.
B. Arrange the Schedule in tabular form with columns to indicate the following for each item:
1. Generic Name.
2. Change Orders (numbers) that have affected value.
3. Dollar value.
4. Percentage of Contract Sum to the nearest one- hundredth percent.
C. Break Contract Sum down in enough detail to facilitate evaluation of Applications for Payment.
Break principal subcontract amounts down into several line items. Round amounts off to the nearest dollar; the total shall equal the Contract Sum.

D. For each item where an Application for Payment includes products purchased or fabricated and stored, but not installed, provide separate line items for initial cost, each subsequent stage of completion and installed value.
E. Update and resubmit the schedule when Change Orders change the Contract Sum.
1. Show Change Orders as separate line items in resubmitted Schedule of Values.
1.04 APPLICATIONS FOR PAYMENT:
A. Each Application for Payment shall be consistent with previous applications and payments as certified by the Contracting Officer and paid for by the Government. Application for Payment will be submitted in WAWF.
1.05 PAYMENT APPLICATIONS TIMES:
A. Progress payments shall be made monthly unless otherwise approved by the Contracting
Officer.
1.06 APPLICATION PREPARATION:
A. Complete every entry, including execution by person authorized to sign. Incomplete applications will be returned without action.
B. Entries shall match data on the Schedule of Values and Contractor's Construction Schedule.
Use updated schedules if revisions have been made.
C. Include amounts of Change Orders signed by the Contracting Officer prior to the last day of the period covered by the application.
1.07 TRANSMITTAL:
A. Submit application for payment by email to the Contracting Officer's Technical Representative
(COTR) and the Contracting Office prior to submission in WAWF. Approval of payment request must be obtained prior to submission to WAWF. The payment request must be complete including required certifications.
B. Transmit each copy with a transmittal listing attachments, and recording information related to the application.
1.08 INITIAL APPLICATION FOR PAYMENT:
A. Administrative actions and submittals that must precede or coincide with submittal of the first
Application for Payment include:
1. Emergency phone numbers.
2. List of subcontractors.
3. List of suppliers, fabricators, and products.
4. Schedule of values.
5. Contractor's Construction Schedule(s) (preliminary if not final).
6. Copies of building permits (if applicable).
7. Copies of licenses from governing authorities (if applicable).
8. Letter notifying Contracting Officer that required insurance policies are in force.
9. Performance and payment bonds.
1.09 APPLICATION FOR PAYMENT AT SUBSTANTIAL COMPLETION:
A. Administrative actions and submittals that precede or coincide with this application include:
1. Occupancy permits.
2. Warranties and maintenance agreements.
3. Test/adjust/balance records.
4. O&M Manuals/Maintenance instructions.
5. Meter readings (if applicable).
6. Final cleaning.

7. List of incomplete Work, recognized as exceptions to Contracting Officer's Certificate of Substantial Completion.

1.10 FINAL PAYMENT APPLICATION:
A. Administrative actions and submittals which must precede or coincide with submittal of the final payment application include:
1. Completion of closing documents.
2. Completion of Project closeout requirements.
3. Completion of all Work and acceptance of Work by Contracting Officer.
4. Transmittal of required Project construction records to Government.
5. Release of Claims.
6. Removal of temporary facilities and services.
7. Removal of surplus materials, rubbish, and similar elements.

SECTION 01 0350
MODIFICATION PROCEDURES
PART 1 GENERAL
1.01 GENERAL:
A. This Section specifies administrative and procedural requirements for handling and processing Contract modifications.
B. Change Orders may also be known as “Contract Modifications”. The two terms may be used interchangeably with the same meaning.
C. Changes in the work involving an adjustment in the contract price shall be authorized only by a written change order signed by the Contracting Officer.
D. Drawings and general provisions of the Contract, including General and Supplementary Requirements and other Division 1 Specification Sections apply to this Section.
1.02 CHANGE ORDER PROPOSAL REQUESTS:
A. Proposal requests that require adjustment to the Contract Sum or Time if, accepted, will be issued by the Contracting Officer, with a detailed description of the proposed change and supplemental or revised Drawings and Specifications. Proposal requests are for information only and shall not be considered as instruction to stop work in progress, or to execute the change.
1. Unless otherwise indicated, within ten days of receipt, submit an estimate of cost to execute the Change.
a. Include a list of quantities of products to be purchased and unit costs. Furnish data to substantiate quantities.
b. Indicate applicable taxes, delivery charges, equipment rental, and amounts of trade discounts.
c. Include a statement indicating the effect the proposed change in the Work will have on the Contract time.
1.03 CONTRACTOR INITIATED CHANGE ORDER PROPOSAL REQUESTS:
A. When unforeseen conditions require modifications to the Contract, the Contractor may propose changes by submitting a request to the Contracting Officer's Technical Representative.
1. Include a statement outlining reasons for the change. Provide a complete description of the change. Indicate effect of the proposed change on the Contract Sum and Time.
2. Include a list of quantities of products to be purchased and unit costs. If requested, furnish data to substantiate quantities.
3. Indicate applicable taxes, delivery charges, equipment rental, and amounts of trade discounts.
B. Prior to conditions being disturbed, differing site conditions shall be handled in accordance with contract requirements and shall be brought to the Contracting Officer's attention immediately.
Any damages to government property or construction in progress resulting from a differing site condition not brought to the attention of the Contracting Officer shall be the responsibility of the Contractor.
1.04 CHANGE ORDER PROCEDURES:
A. Upon the determination of the Contracting Officer that extra work beyond that indicated on the drawings and/or specifications, or that certain portions of the work will be added or deleted from the Contract, the Contractor shall submit a change order proposal to the Contracting Officer for review.
B. Proposed Change Orders shall be submitted on a Proposed Change Order (PCO) Form, numbered sequentially by the Contractor.

C. Upon acceptance of the change order proposal, the Contracting Officer will prepare copies of the change order and obtain the necessary signatures indicating acceptance of the modification to the contract.
D. Copies of the change order will be distributed by the Contracting Officer to the Contractor, Architect, and other agencies or individuals as required.
E. Change Order Proposals
1. The proposal shall be itemized to show the following:
a. Quantities and cost of materials F.O.B. jobsite
b. Costs of labor
c. Subcontractors work and cost thereof shall be itemized as stated in a. and
d. b. above.
e. Overhead*
f. Profit
2. Proposals may be either “Add” or “Deduct” types as necessary to cover the change.
3. Allowable mark ups for overhead and profit.
4. All proposals shall include allowances for overhead and profit as follows: When change order proposals include an add and deduct as part of the same change, one overhead and one profit figure shall be used for the difference. Overhead and profit figures shall be based on the following table.

5. * Overhead includes general office operating costs that are not direct costs related to the project. Overhead items would include, but are not limited to, general company insurance, office rental or operating costs, company vehicles and/or equipment, etc. Overhead shall also include Performance-Payment Bond costs associated with the contract modification.
The above rates also apply to subcontractors at all tiers.

PROJECT COORDINATION
PART 1 GENERAL
1.01 SCOPE:
A. This Section specifies requirements for project coordination including:
1. Coordination
2. Administrative and supervisory personnel
3. General installation provisions
4. Cleaning and protection
1.02 COORDINATION:
A. Coordinate activities included in various Sections to assure efficient and orderly installation of each component. Coordinate operations included under different Sections that are dependent on each other for proper installation and operation.
1. Where installation of one component depends on installation of other components before or after its own installation, schedule activities in the sequence required to obtain the best results.
2. Where space is limited, coordinate installation of different components to assure maximum accessibility for maintenance, service, and repair.
3. Make provisions to accommodate items scheduled for later installation.
B. Prepare memoranda for distribution to each party involved outlining required coordination procedures. Include required notices, reports, and attendance at meetings.
1. Prepare similar memoranda for the Government and separate Contractors where coordination of their Work is required.
1.03 ADMINISTRATIVE PROCEDURES:
A. Coordinate scheduling and timing of administrative procedures with other activities to avoid conflicts and ensure orderly progress. Such activities include:
1. Preparation of schedules.
2. Installation and removal of temporary facilities.
3. Delivery and processing of submittals.
4. Progress meetings.
5. Project closeout activities.
1.04 PRE-CONSTRUCTION REQUIREMENTS:
A. Requirements: Prior to starting construction, the following items shall be completed.
1. Contractor’s completion of a Technical Pre-Construction Meeting with Base Civil Engineer, Tenant, and Contracting personnel.
2. Receipt of “Task Order” contract from USPFO for North Dakota, Contracting Officer.
3. Receipt of “Notice to Proceed” from the USPFO for North Dakota, Contracting Officer.
4. Provide additional payment protection as required.
1.05 STAFF NAMES:
A. Within 15 days of receipt of the Notice to Proceed, submit a list of Contractor's staff assignments, including Superintendent and personnel at the site; identify individuals, their duties and responsibilities, addresses and telephone numbers, including a minimum of three individuals to contact in the event of an emergency.
B. Workmanship throughout the project shall be of the highest quality. Generally accepted standards and recommended practices of the various trade associations shall govern all work under this contract, unless otherwise specified. Neatness and good appearance as well as sound substantial construction are required of all work.

C. Inspection: The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to the contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer written authorization.
(See FAR Clause 52.246-12)
1.06 INSPECTION OF CONDITIONS:
A. The Installer of each component shall inspect the substrate and conditions under which Work is performed. Do not proceed until unsatisfactory conditions have been corrected.
1. The Contractor and Subcontractors shall be responsible to check and field verify all dimensions, elevations, and conditions prior to fabricating or installing equipment, products or materials.
1.07 MANUFACTURER'S INSTRUCTIONS:
A. Comply with manufacturer's installation instructions and recommendations, to the extent that they are more stringent than requirements in Contract Documents.
B. Inspect material immediately upon delivery and again prior to installation. Reject damaged and defective items.
C. Provide attachment and connection devices and methods necessary for securing each construction element. Secure each construction element true to line and level. Allow for expansion and building movement.
1.08 VISUAL EFFECTS:
A. Provide uniform joint widths in exposed Work. Arrange joints to obtain the best effect. Refer questionable choices to the Contracting Officer's Representative for decision.
B. Recheck measurements and dimensions, before starting installation.
C. Install each component during weather conditions and project status that will ensure the best results. Isolate each part from incompatible material as necessary to prevent deterioration.
D. Coordinate temporary enclosures with inspections and tests, to minimize uncovering completed construction for that purpose.
1.09 MOUNTING HEIGHTS:
A. Where mounting heights are not indicated, install components at standard heights for the application indicated. Refer questionable decisions to the Contracting Officer's Representative.
1.10 CLEANING AND PROTECTION:
A. Clean and protect construction in progress and adjoining materials in place. Apply protective covering where required to ensure protection from damage or deterioration.
B. Clean and maintain completed construction as often as necessary through the construction period. Adjust and lubricate operable components to ensure operability without damaging effects.
1.11 LIMITING EXPOSURES:
A. Supervise operations to ensure that no part of construction, completed or in progress, is subject to harmful or deleterious exposure. Such exposures include but are not limited to:
1. Excessive static or dynamic loading.
2. Excessive internal or external pressures.
3. Excessive weathering.

FIELD ENGINEERING
PART 1 GENERAL
1.01 SCOPE:
A. This Section specifies requirements for field engineering.
1.02 PROJECT RECORD DOCUMENTS:
A. Submit a record of Work performed and record survey data required under provisions of Sections "Submittals" and "Project Closeout."
1.03 LAYING OUT THE WORK:
A. The Contractor shall employ, or have in his employ, a competent Engineer, who shall establish permanent benchmarks to which easy access is available by all Subcontractors for use in determining all levels, lines, and grades and for verification periodically during the progress of the Work.
1.04 PROTECTION OF UTILITIES AND ROADS:
A. Before starting work, the Contractor shall notify the Contracting Officer Technical
Representative (COTR) and all utilities involved via North Dakota One-Call B. (1-800-DIG-SAFE), and shall request that the lines be located in advance of the work. The
Contractor shall take precautions effort to avoid damaging utility lines. The utility shall be notified immediately should any damage occur in a line during construction under this contract.
Any lines so damaged shall be repaired according to the utility company's standards at the expense of the Contractor.
C. The Contractor shall be held responsible for all damage to roads, streets, pavement, shoulders, ditches, bridges, culverts and other property, caused by him or his Subcontractors during construction operations, regardless of location of such damage, and shall pay for or replace such damaged property to the satisfaction of the Contracting Officer of such property.
D. The Contractor shall clean all dirt from paved surfaces and not allow dirt, mud, or other debris to pack on the roadway or create a traffic nuisance.
1.05 CONNECTIONS TO EXISTING FACILITIES:
A. Make all necessary connections to existing structures and utility lines according to the requirements of the respective owner. Thoroughly plan such connections in advance and perform as expeditiously as possible. Connection fees and permits shall be paid by the Contractor.
B. Verify layout information shown on the Drawings, in relation to existing construction before proceeding. Locate and protect existing benchmarks and control points. Preserve permanent reference points during construction.
1. Do not change or relocate benchmarks or control points without prior written approval.
Report lost or destroyed reference points, or requirements to relocate reference points because of necessary changes in grades or locations.
2. Promptly replace lost or destroyed project control points. Base replacements on the original survey control points.
C. Establish and maintain a minimum of two permanent benchmarks on the site, referenced to data established by control points.
1. Record benchmark locations, with horizontal and vertical data, on Project Record
Documents.
1.06 EXISTING UTILITIES AND EQUIPMENT:
A. Before beginning sitework, verify the existence and location of underground utilities and other construction.

1. Prior to construction, verify the location and invert elevation at points of connection of sanitary sewer, storm sewer and water service piping, gas piping, electrical service, telephone service, and other utilities.
1.07 PERFORMANCE:
A. Establish benchmarks and markers to set lines and levels and where needed to properly locate each element. Calculate and measure required dimensions within indicated or recognized tolerances. Do not scale Drawings to determine dimensions.
1. Advise entities engaged in construction activities, of marked lines and levels provided for their use.
2. As construction proceeds, check every major element for line, level and plumb.
3. Record deviations from required lines and levels. Advise the Contracting Officer's
Representative when deviations that exceed indicated or recognized tolerances are detected. On Record Drawings, record deviations that are accepted and not corrected.
1.08 SITE IMPROVEMENTS:
A. Locate and lay out site improvements, including pavements, stakes for grading, fill and topsoil placement, utility slopes and invert elevations by instrumentation and similar appropriate means.
1.09 EXISTING UTILITIES:
A. Furnish information necessary to adjust, move, or relocate existing utilities or services affected by construction activities. Coordinate with Contracting Officer's Representative.

DEFINITIONS & STANDARDS
PART 1 GENERAL
1.01 DEFINITIONS:
A. Basic Contract definitions are included in the Contract clauses.
B. Indicated refers to graphic representations, notes or schedules on Drawings, or Paragraphs or
Schedules in Specifications, and similar requirements in Contract Documents. Where terms such as “shown”, “noted”, “scheduled”, and “specified” are used, it is to help locate the reference.
C. Wherever in the specifications or upon the drawings the words “directed”, “required”, “ordered”, “designated”, “prescribed”, or words of like import are used, it shall be understood that the “direction”, “requirement”, “order”, “designation”, or “prescription”, of the Contracting Officer is intended and similarly the words “approved”, “acceptable”, “satisfactory”, or words of like import shall mean “approved by”, or “acceptable to”, or “satisfactory to” the Contracting Officer, unless otherwise expressly stated.
D. Where “as shown”, “as indicated”, “as detailed”, or words of similar import are used, it shall be understood that the reference is made to the drawings accompanying this contract unless stated otherwise. The word “provided” as used herein shall be understood to mean, “provide complete in place”, that is “furnished and installed”.
E. Directed: Terms such as “directed”, “requested”, “authorized”, “selected”, “approved”, “required”, and “permitted” mean “directed by the Contracting Officer”, “requested by the Contracting Officer”, and similar phrases. No implied meaning shall be interpreted to extend the Contracting Officer's responsibility into the Contractor's supervision of construction.
F. Regulation includes laws, ordinances, statutes and lawful orders issued by authorities having jurisdiction, and rules, conventions and agreements within the construction industry that control performance of the Work, whether lawfully imposed by authorities having jurisdiction or not.
G. Furnish means “supply and delivery, ready for unloading, unpacking, assembly, installation, and similar operations”.
H. Install describes operations at the site including “unloading, unpacking, assembly, erection, anchoring, applying, working to dimension, protecting, cleaning and similar operations”.
I. Provide means “furnish and install, complete and ready for use”.
J. Similar means in a general sense and does not mean identical. Construction details and installation of construction materials shall be coordinated relative to their location and connection to adjacent work.
K. Patch to Match means that the finish surface referred to is to be altered so the patched or extended surface shall have the same material, texture, finish and color as the surface being changed before alterations started. Contractor shall verify conditions at the site.
L. Owner: Where the word “Owner” is used throughout the Contract Documents, it shall be understood to mean the “Contracting Officer” or “Contracting Officer’s Technical Representative” (COTR) as applicable.
M. Installer: “Installer” is the Contractor or an entity engaged by the Contractor, as an employee, subcontractor or sub-subcontractor for performance of a particular construction activity, including installation, erection, application and similar operations. Installers are required to be experienced in the operations they are engaged to perform.
1. The term “experienced” when used with “Installer” means having a minimum of 5 previous projects similar in size to this project, and familiar with the precautions required, and with requirements of the authority having jurisdiction.

N. Project Site is the space available for construction activities, either exclusively or with others performing other construction on the Project. The extent of the Project Site is shown on the Drawings.
O. Testing Laboratories: A “testing laboratory” is an independent entity engaged to perform specific inspections or tests, at the Project Site or elsewhere, to report on and, if required, to interpret, results of those inspections or tests.
P. Specification Format: These Specifications are organized into Divisions and Sections based on the Construction Specifications Institute's MASTER FORMAT numbering system.
Q. Language used in the Specifications is the abbreviated type. Implied words and meanings will be appropriately interpreted. Singular words will be interpreted as plural and plural words interpreted as singular where applicable and where the context so indicates.
1. Imperative language is used generally. Requirements expressed in the imperative mood are to be performed by the Contractor. At certain locations in the text, subjective language is used to describe responsibilities which must be fulfilled indirectly by the Contractor, or by others when so noted.
2. The words “shall be” shall be included by inference wherever a colon (:) is used within a sentence or phrase.
R. Assignment of Specialists: Certain construction activities shall be performed by specialists, recognized experts in the operations to be performed. Specialists must be engaged for those activities, and assignments are requirements over which the Contractor has no option.
Nevertheless, the ultimate responsibility for fulfilling Contract requirements remains with the Contractor.
S. Mechanical/Electrical Drawings: Graphic symbols on mechanical and electrical drawings are aligned with symbols recommended by ASHRAE. Where appropriate, they are supplemented by symbols recommended by technical associations. Refer instances of uncertainty to the Contracting Officer's Representative for clarification before proceeding.
T. Applicability of Standards: Except where the Contract Documents include more stringent requirements, applicable industry standards have the same force and effect as if bound or copied into Contract Documents. Such standards are part of the Contract Documents by reference.
U. Publication Dates: Where the date of issue of a referenced standard is not specified, comply with the standard in effect as of date of Contract Documents.
V. Conflicting Requirements: Where compliance with two or more standards that establish different or conflicting requirements for minimum quantities or quality levels, the most stringent requirement will be reinforced. Refer uncertainties as to which quality level is more stringent to the Contracting Officer’s Representative for a decision before proceeding.
1. Minimum Quantities or Quality Levels: The quantity or quality shown or specified is the minimum to be provided or performed. Indicated values are minimum or maximum values, as appropriate for the requirements. Refer instances of uncertainty to the Contracting Officer's Representative for decision before proceeding.
W. Copies of Standards: Each entity engaged on the Project shall be familiar with standards applicable to that activity. Copies of applicable standards are not bound with the Contract Documents.
1. Where copies of standards are needed for performance of a required construction activity, the Contractor shall obtain copies directly from the publication source.
2. Although copies of standards needed for enforcement of requirements may be part of submittals, the Contracting Officer's Representative reserves the right to require submittal of additional copies for enforcement of requirements.
X. Abbreviations and Names: Where acronyms or abbreviations are used in the Specifications or other Contract Documents they mean the recognized name of the trade association, standards

generating organization, authority having jurisdiction or other entity applicable. Refer to the “Encyclopedia of Associations,” published by Gale Research Co., available in most libraries.
Y. Workmanship: Workmanship throughout project shall be of highest quality. Generally accepted standards and recommended practices of the various trade associations shall govern all work under this Contract, unless more stringent requirements are specified. Neatness and good appearance, as well as sound, substantial construction, are required of all Work.
Z. Permits, Licenses, and Certificates: For the Government's records, submit copies of permits, licenses, certifications, inspection reports, releases, jurisdictional settlements, notices, receipts for fee payments, judgments, and similar documents, correspondence and records established in conjunction with compliance with standards and regulations bearing upon performance of the Work.
AA. In cases where building codes and regulations are at variance, the highest level of compliance shall be in effect. The intent of these Contract Documents is to be in at least minimum compliance with applicable building codes, laws, and regulations in force at the location of the project.

SUMMARY OF WORK
PART 1 GENERAL
1.01 RELATED DOCUMENTS:
A. Drawings and general provisions of the Contract, including Supplementary Requirements and other Division 1 Specification Sections, apply to this Section.
1.02 CONTRACTS:
A. Basis of Contract: Firm Fixed-Price Construction Contract
1.03 EXISTING CONDITIONS:
A. Existing conditions may vary from those shown on the drawings. The Contractor shall examine the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of Contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after Contract award.
1.04 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK:
A. The Contractor shall be required to commence work within the time frame specified in the contract, prosecute the work diligently, and complete the entire work ready for use not later than the number of calendar days specified in the Task Order.
B. The time stated for completion shall include final cleanup of the premises.
C. The Contractor shall ensure that all Task Order work under this Contract is completed and that submittals are made in accordance with the time allowances and progress schedules set forth in individual Task Orders. The schedule is subject to adjustment by the Contracting Officer or a duly authorized representative—in writing—for material delays on the part of the Government and for conditions beyond the control of the parties hereto.
D. The order completion schedule shall be based on receipt of either written or verbal Notice to Proceed (NTP), whichever is sooner.
1.05 SCOPE OF WORK:
A. Extent of drawings and specifications defining all work to be performed under this Contract is listed on A/E’s cover sheet of project book. It is the bidding Contractor's sole responsibility to verify that he has received all sheets of plans and specifications as to claim for extra cost will not be allowed due to lack of complete information at time of bid.
B. The successful General Contractor shall provide all subcontractors and suppliers with appropriate construction documents necessary to coordinate and perform their work.
1. Lack of information due to incomplete reproduction and/or distribution of construction documents to subcontractors and suppliers, which adversely affects the work, will be the sole responsibility of the General Contractor, at no additional cost to the NDANG.
2. It is strongly suggested that all major subcontractors and suppliers be provided with complete sets of construction documents to facilitate necessary coordination of their work with that of other trades.
3. Disputes between subcontractors and suppliers regarding receipt of insufficient or incomplete construction documents potentially affecting the performance of their work will be resolved as per the Contracting Officer’s final determination at no additional cost to the
NDANG.
C. Equipment or work indicated on plans to be “N.I.C.” is not to be included in bid proposal or construction Contract.
D. The scope of work of this project does not include removal of asbestos containing materials.
The Contracting Officer will be responsible for the identification and removal of all asbestos-

containing materials. Contractor shall report to the Contracting Officer the suspected presence of any asbestos-containing materials encountered during the performance of their work. Once asbestos-containing materials are suspected of being present, work shall stop until such time as the Contracting Officer deems it safe to continue with the work.
E. No products or building materials used as a temporary or permanent element in the construction of a building that has any form of asbestos will be allowed. Contractor shall be responsible to monitor shop drawings and product literature to verify the makeup of materials to be used in the building, and to remind material suppliers that their products must be asbestos-free.
1.06 ASTM DESIGNATIONS:
A. Shall be latest edition for all sections of specifications. Materials specified to comply to a certain standard (ASTM or other) shall be delivered to job properly labeled and identified. If material is not labeled, the Contractor shall furnish a certificate of compliance from the manufacturer.
B. TERMINOLOGY:
1. Requirements of all specification sections, Conditions of the Contract, and Divisions 01 extend and apply to all work required of all contractors, subcontractors, material suppliers, etc., set forth in other Divisions of Specifications.
2. Where the term, “include”, is used under Scope paragraphs of subsequent specification sections, this shall be interpreted to mean items of work therein listed may be a part, but not necessarily the total limit, of the work required by such section. The Contractor shall examine drawings and specifications documents.
3. Where specifications are abbreviated type, they indicate complete sentences in the same manner as when a note occurs in the Drawings. Omissions of words such as “the Contractor shall” or “shall be” are to be supplied by inference. The term “provide” shall mean “furnish and install in place”.
4. Where a number is listed in the specifications (as for gauges, weights, temperatures, amount of time, etc.), the number shall be interpreted as that or better.
1.07 CONTRACT LINE ITEM DESCRIPTION:
A. Furnish all labor, material, equipment, services, and supplies required to complete the work which includes, but is not limited to, the following principal items:
1. Construction of the Renovate Building 210 project, consisting of demolition and remodeling within an existing hangar and cold storage building and associated work.
1.08 MEASUREMENTS:
A. Figured dimensions shall be followed in preference to measurements by scale. Large-scale drawings shall take precedent over those of a smaller scale. Figures on all drawings, as detail drawings themselves are, in every case, subject to measurements of adjacent or incorporated completed work. All such necessary measurements shall be taken before undertaking any work dependent upon such data. Report any discrepancies to the Contracting Officer for clarification before proceeding with work. The Contractor shall be held solely responsible for any error resulting from failure to exercise such precaution.
B. Where on any drawing a portion of work is drawn out and remainder is indicated in outline, parts drawn out or indicated by symbols or instructions by work description shall apply also to all other like portions of the work. (See Architectural symbols under Appendix B-1 for materials not specifically called out on drawings and details).
C. Where existing work is added to or modified, the Contractor is to verify ALL dimensions on job.
D. Where a clear understanding of the work is prevented, due to discrepancies, contradictions, or omissions on contract documents or subsequently issued instructions (regardless of source), the Contractor shall not proceed with work and the Contracting Officer should be consulted for clarification of the uncertainty. Should any mistake result due to pursuit of work without this

clarification, the Contractor must make necessary corrections at his expense and as directed by the Contracting Officer.
1.09 WORK UNDER OTHER CONTRACTS:
A. Separate Contracts: North Dakota Air National Guard (NDANG) may award separate Contracts for performance of certain construction operations at, and adjacent to, the site. Those operations will be conducted simultaneously with work under this Contract.
B. Cooperate fully with separate Contractors so that work under those Contracts may be carried out smoothly, without interfering with or delaying work under this Contract. Trailers and stored materials shall be relocated as necessary to permit work under separate contracts to be performed without interference or delay.
1.10 WORKMANSHIP:
A. Manufacturer's printed instructions covering details of installation shall be followed where not in conflict with these specifications. If there is a conflict, notify the Contracting Officer and obtain his approval before proceeding.
B. Completed work shall be left plumb, level, true to line or plain, anchored securely in place free from damage.
C. Unless otherwise called for, all pieces of material shall be as large a stock size as is in conformity with standard good practice of the trade.
D. Except where in conflict with these specifications, current manufacturer's printed specifications of herein specified proprietary products are made part of these specifications.
1.11 CONTRACTOR USE OF SITE AND PREMISES:
A. General: The North Dakota Air National Guard is a controlled access Federal Military
Reservation. As such, there are strict controls over access to the Base and its facilities.
1. Contractor's use of the site will be limited to 7:00AM-4:30PM, Monday-Friday. Coordinate with Owner regarding Holidays and monthly Mondays off.
2. All vehicles entering the NDANG do so with the understanding they will be subject to periodic inspections for contraband or Government property. Any person found with unauthorized Government property in their possession will be prosecuted to the fullest extent of the law.
B. All of Contractor's personnel must register and obtain badged base access credentials from the 119th Security Forces Squadron.
C. Passes: All persons entering the NDANG must request and display temporary passes. All persons operating a vehicle must have a valid driver’s license.
1. Comply with all regulations for obtaining, maintaining, and returning passes.
D. Restricted Areas: No vehicle or individual shall enter a restricted area, including flight line access.
1. Do not enter Security Zone beyond fence without prior authorization from the Contracting
Officer’s Representative OR Base personnel.
2. Project work is located inside a controlled area. Contractor's personnel shall check in and out at Building 350 upon entry and exit to the controlled area.
E. Material Deliveries: Verify haul route with Contracting Officer. The Contractor shall ensure that all material and equipment deliveries are routed via this designated route. The Contractor shall escort all deliveries to and from the construction site. Also, all debris that is hauled off Base shall be moved via the designated haul route. The Contractor is cautioned to give suppliers the exact title of the job and location of where materials are to be delivered. The Contractor is cautioned to also instruct suppliers that gate guards will not sign for deliveries.
F. Blocking of Streets: In the event the Contractor or any of his subcontractors find it necessary to barricade any street or road on Base, the Contracting Officer must be notified at least 24 hours

in advance. Adequate notification must be given in order to coordinate re-routing of emergency vehicles.
G. Material and Tool Security: The Contractor is solely responsible for the securing of his tools, equipment, and materials. The U.S. Government takes no responsibility or liability for any materials, tools, or equipment that are missing. Should the Contractor notice that he is missing any materials or equipment, he shall notify the Contracting Officer immediately and complete the required reports.
H. Seat Belts: The wearing of seat belts is mandatory while operating a vehicle on the North Dakota Air National Guard Base. Periodic checks will be made and individuals not wearing seat belts will be restricted from driving on Base. Cell phone use is prohibited on base while operating a vehicle.
I. Posted Speeds: All personnel operating motor vehicles on the North Dakota Air National Guard Base must observe all posted speeds and all pedestrian walkways. Any person stopped for exceeding the posted speeds or not stopping for pedestrians in crosswalks will be restricted from driving on Base.
J. Vehicle Parking: All Contractor personnel shall park in the Contractor’s designated…
