JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: US Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059

2. Description of Action: Approval is requested to utilize a Fire Alarm and Mass Notification System (MNS) parts manufactured by Simplex as a sole source component for the Air Force Research Laboratory (AFRL) Building 20655 Renovate Research Facility for Hypersonics Lab project at Wright Patterson Air Force Base (WPAFB). The estimated cost for the Simplex equipment is $ . AF RDT&E (57 3600) funding will be used for this action.

3. Description of the Supplies/Service: Description of the Supplies/Service: The contract solicitation will include a sole-source brand requirement for a Simplex Fire Alarm and MNS parts.

These parts are required for the Building 20655 Hypersonics Lab Renovation to be able to tie into the current base-wide system that WPAFB utilizes.

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name acquisitions in accordance with FAR 6.302-1(c).

5. Reason for Authority Cited: Currently all buildings at WPAFB use the Simplex Fire Alarm and MNS. This system utilizes the IDNet protocol to communicate with the signaling devices, which is a closed-source system that utilizes proprietary communication protocols. Because of this, the Base mandates the use of Simplex parts in their project design requirements in order to ensure compatibility with the current base-wide network. This is especially critical on the Building 20655 Hypersonics Lab Renovation project because the work conducted inside the laboratories will involve flammable materials. Attempting to integrate parts outside the current network poses unacceptable risks, because it would affect the sy with the WPAFB Fire Department, which could negatively impact response times and lead to significant life, health, and safety consequences.

6. Efforts to Obtain Competition: None, for the reasons cited above.

7. Actions to Increase Competition: None, for the reasons cited above.

8. Market Research: Simplex parts are available commercially through various avenues and are not limited in availability to other sources.

9. Interested Sources: Simplex is the sole provider of fire alarm system parts that tie into the existing system at Wright Patterson Air Force Base.
