Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity:

USPFO for Oregon 1776 Militia Way Salem, OR 97309

2. Description of Action: A new firm fixed price construction contract for project which includes “Brand Name Only” component for the Fire Alarm Panel/Transmitter - Monaco Fire Detection and Alarms System. The funding source will be MILCON.

3. Description of Supplies/Services: ANG Project # KJAQ199077 ADAL Communications B210 at Klamath Falls Airport, Kingsley Field, OR, included one Brand Name for Fire Alarm Panel/Transmitter - Monaco Fire Detection and Alarm including the Panel, Transmitter and all associated installation by a certified installer, commissioning and training requirements for the implementation of a complete Fire Alarm Panel and Mass Notification System.

4. Authority Cited: 10 United States Code 2304(c) (1), as implemented in Federal Acquisition Regulation 6.302-1 Only one responsible source and no other responsible source and no other supplies or services will satisfy agency requirements - it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: Only one responsible source, Monaco Enterprises, Inc. and no other source of supply will satisfy agency requirement for the Fire Alarm System. The 173rd Civil Engineering Squadron currently uses the Monaco Fire Alarms System at Kingsley ANGB. The new communications facility will need to fully integrate with the existing Fire Alarm System. The central supervising station receiving equipment is Monaco D2100 and the transceiver must be fully compatible with this equipment.

Acquiring a different alarm system as a whole would incur the additional cost of training as well as doubling maintenance and equipment costs due to maintaining two different systems. By procuring an identical system, maintaining will be standardized and costs would be easier to control. Kingsley Field currently send three (3) personnel to annual Monaco training at a cost of approximately $7,500 annually.

Procuring a different panel would add an additional annual training requirement that Kingsley Field’s travel authorizations may not be able to guarantee.

6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(6) this item will be synopsized in the GPE.. The brand name components represent a small portion (0.01%) of the overall construction project that is being competed. Effective competition for this component is not applicable.

7. Actions to Increase Competition: None

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 6 months:

Open Competition

a. Contacted knowledgeable individuals in the Government, including the ORANG Base Civil Engineer and Deputy Base Civil Engineer, Fire Prevention Officer, Base Electricians and the ANG Civil Engineer Technical Support Center regarding the market capabilities to meet the requirements.

b. Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies that provide information relevant to agency acquisitions.

Search of www.fbo.gov indicated within the last 12 months that the Departments of the Army and Air Force has posted similar justifications for brand name requirements for their applicable construction contracts.

9. Interested Sources: There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and expert judgement by the subject matter experts and experience of the Oregon Air National Guard, National Guard Bureau, and Air Force.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The estimated cost of $35,700 is determined based on the A-E’s cost estimate for this procurement action. The A-E received the cost directly from Automatic Logic. The estimated cost comparable with standard practice M2 cost estimating software estimates quoting similar Systems from $29,000-$37,000.
