Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity:

USPFO for Oregon 1776 Militia Way Salem, OR 97309

2. Description of Action: A new firm fixed price construction contract for project which includes “Brand Name Only” component for the Intrusion Detection System by Advantor Systems Corporation. The funding source will be MILCON.

3. Description of Supplies/Services: ANG Project # KJAQ199077 ADAL Communications B210 at Klamath Falls Airport, Kingsley Field, OR, included one Brand Name for Intrusion Detection System by Advantor Systems Corporation and associated installation by a certified installer.

MILCON funds will be utilized for this requirement.

4. Authority Cited: 10 United States Code 2304(c) (1), as implemented in Federal Acquisition Regulation 6.302-1 Only one responsible source and no other responsible source and no other supplies or services will satisfy agency requirements - it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: Only one responsible source, Advantor Systems Corporation and no other source of supply will satisfy agency requirement for the Intrusion Detection System. The 173rd Security Forces Squadron currently uses the Advantor System at Kingsley ANGB. The new communications facility will need to fully integrate with the existing System. Acquiring a different system as a whole would incur the additional cost of training as well as doubling maintenance and equipment costs due to maintaining two different systems. The Advantor VMS is a USAF-approved CCTV system. The cameras and applicable accessories are to be installed by Advantor Systems Corporation and incorporated into this system. The system uses proprietary technology approved by the Air Force for this purpose, and accordingly is maintained by Advantor Systems Corporation under a consolidated maintenance contract issued by NGB-AQ-AF.

6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(6) this item will synopsized in the GPE. The brand name components represent a small portion (0.0028%) of the overall construction project that is being competed. Effective competition for this component is not applicable.

7. Actions to Increase Competition: None

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 6 months:

a. Contacted knowledgeable individuals in the Government, including the ORANG Base Civil Engineer and Deputy Base Civil Engineer, Fire Prevention Officer, Base Electricians and the ANG Civil Engineer Technical Support Center regarding the market capabilities to meet the requirements.

b. Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies that provide information relevant to agency acquisitions.

Search of www.fbo.gov indicated within the last 12 months that the Departments of the Army and Air Force has posted similar justifications for brand name requirements for their applicable construction contracts.

c. In addition, the pre-solicitation notice specifying the intent to purchase this brand name equipment will be posted to FebBizOpps. This notice will invite persons who may have interest or capability to provide compatible equipment to respond accordingly. Any responses will be evaluation accordantly.

9. Interested Sources: There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and expert judgement by the subject matter experts and experience of the Oregon Air National Guard, National Guard Bureau, and Air Force.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The estimated cost of $20,036 is determined based on the A-E’s cost estimate for this procurement action. The A-E received the cost directly from Advantor. The estimated cost comparable with standard practice M2 cost estimating software estimates quoting similar Systems from $19,000-$27,000.
