SIERRA ANCHA BUILDING DEMOLITION

SECTION 024230 – ASBESTOS ABATEMENT

PART 1 - GENERAL

1.1 SCOPE

A. Work shall consist of furnishing all labor material, equipment and supervision to perform asbestos removal and disposal in accordance with these specifications, EPA (AHERA, Asbestos NESHAPS), OSHA, NIOSH, State of Arizona Department of Environmental Quality (ADEQ) Air Quality Division, and other applicable federal, state, or local regulations.

B. Note: Depending on the type, condition, and location of the asbestos containing materials, sections or parts of this specification may not be applicable.

1.2 DESCRIPTION OF WORK

A. Removal of all asbestos-containing materials (ACMs) from the Mess Hall, comprising approximately 300 SF of vinyl sheet flooring and 3 LF of asbestos-cement pipe, by an EPA-certified asbestos abatement contractor. See attached excerpt of asbestos survey report dated June 14, 2012 for further details.

1.3 QUALIFICATIONS

A. The contracting firm shall provide documentation of the company’s qualifications in asbestos removal work and that the employed workers are trained and certified by EPA (see section 7.1, Training). In addition, the asbestos contractor must carry active “occurrence” type liability insurance while performing any work under this contract.

1.4 APPLICABLE REGULATIONS AND PUBLICATIONS

A. The regulations listed below form a part of this specification to the extent referenced.

The publications are referred to in the text by the basic designation only. The latest version of applicable regulations shall take precedence over the requirements of this specification when the regulation results in a higher standard of performance.

2. State of Arizona Regulations:

a. In the State of Arizona, the Arizona Department of Environmental Quality (ADEQ) regulates the abatement and disposal of asbestos-containing materials from any public or private building involving demolition, renovation, repair, construction, and maintenance activities.

b. EPA certifies and licenses asbestos-removal contractors, inspects asbestos-abatement projects, and enforces laws regarding the proper removal and disposal of asbestos-containing materials.

1.5 DEFINITIONS

A. Refer to Federal and State Regulations for definitions of terms used in this document.

1.6 PROTECTION OF GOVERNMENT PROPERTY

A. All abatement work shall be performed without contamination of adjacent areas, equipment or materials. Should existing equipment or materials become contaminated by work done under this contract, the contractor shall restore all areas to original condition at no additional cost to the government.

1.7 MEDICAL REQUIREMENTS

A. Upon request of the Government, the contactor shall provide documentation for the workers initial and annual medical surveillance requirements.

1.8 TRAINING

A. The contactor shall provide documentation (as required in the Submittals, Section 1.12) that the workers are trained and certified in accordance with state and federal regulations and have completed the requirements for the annual 8 hour refresher course(s) for the work areas in which they are certified. Training for asbestos abatement professionals is required under the Asbestos Hazard Emergency Response Act of 1986 (AHERA), which is the authority under which EPA issued the EPA Asbestos Model Accreditation Plan (MAP) (40 CFR Part 763, Appendix C to Subpart E). The MAP established five required training disciplines (worker, contractor/supervisor, inspector, management planner, and project designer) and one recommended discipline (project monitor).

1.9 LICENSES, PERMITS, AND NOTIFICATIONS

A. The contractor is responsible for obtaining all necessary permits in conjunction with asbestos removal, hauling, and disposal. Provide timely notification of such actions as may be required by federal, state, regional, and/or local authorities. Notification requirements shall be 10 working days prior to the commencement of work in accordance with applicable ADEQ and EPA regulations. Submit a copy of this notification to the Contracting Officers Representative (COR).

B. Notify the COR at least 48 hours prior beginning work. Failure to obtain proper permits, or failure to make proper notification, or beginning work without first coordinating with the COR in advance, will be sufficient grounds for termination of this contract.

C. EPA AHERA certification is required for all individuals engaged in any aspect of asbestos abatement or design. This certification shall be current.

1.10 SAFETY AND HEALTH COMPLIANCE

A. In addition to detailed requirements of this specification, comply with laws, ordinances, rules, and regulations of federal, state, regional, and local authorities regarding handling, storing, transporting, and disposing of asbestos waste materials. Comply with the applicable requirements of the current issue of 29 CFR 1926.1101 and 40 CFR 61, Subparts A and M. Where specification requirements and performance documents vary, the most stringent requirement shall apply.

1.11 RESPIRATOR PROGRAM

A. Upon request by the Government, the contractor shall submit documentation of an established respiratory protection program as required by ANSI Z88.2 and 29 CFR 1910.134.

1.12 SUBMITTALS

A. Submittals shall be provided to the COR for approval 10 working days prior to commencing work involving asbestos materials.

1. The contracting firm shall provide documentation of the company’s qualifications in asbestos removal work and that the employed workers are trained and certified by EPA (see section 7.1, Training) for their respective discipline.

2. Asbestos Work Plan: Submit a detailed, project design plan of the work procedures to be used in the removal and abatement of materials containing asbestos. The plan shall be prepared and signed by the certified Project Designer.

Such plan shall include a sketch showing the location, size, and details of asbestos control areas, location, layout, and details of the decontamination area, and locations of local exhaust equipment. The plan shall indicate all temporary utilities and include interface of trades involved in the construction, sequencing of asbestos-related work, disposal plan, type of wetting agent to be used, air monitoring, respirators, protective equipment, and a detailed description of the method to be employed in order to control site access and the generation of air-borne asbestos including contingencies for containment breach, and fire. The plan must be approved by the government prior to the start of any asbestos work. Prior to beginning work, the Contractor shall meet with the COR to discuss in detail the asbestos plan, including work procedures and safety precautions.

3. Air Monitoring Plan: Submit a detailed air monitoring plan to address monitoring of the site and adjacent areas prior to, during, and after completion of the asbestos work. The air monitoring section shall address the use of a qualified independent third party (such as an Industrial Hygienist) not employed by the abatement contractor to perform any required air monitoring for this contract. This qualified person shall be EPA Contractor/Supervisor or Project Monitor certified for asbestos projects. If monitoring outside the asbestos control area shows airborne concentrations have reached the action level, stop work, correct the condition(s) causing the increase, and notify the COR immediately. In areas where the construction of an enclosed asbestos control area is not required, after initial Time Weighted Averages (TWA’s) are established, and provided the same type of work is performed, provide personal and area monitoring at the designated limits of the asbestos work area at a frequency noted in the asbestos work plan. This plan must be approved by the government prior to the start of any asbestos work. Prior to beginning work, the Contractor shall meet with the COR to discuss in detail the asbestos air monitoring plan.

4. Testing Laboratory: Submit the name, address, and certification documents of the testing laboratory selected to perform all sample analysis when required by this contract. The lab shall be certified under the National Voluntary Lab Accreditation program (NVLAP) and American Industrial Hygiene Agency (AIHA) accredited.

5. Landfill: Submit evidence that the landfill selected is approved for disposal of asbestos by the EPA, State, and local regulatory agencies.

6. Submit proof of Insurance: Contractor shall submit proof of an active occurrence type liability insurance policy that covers asbestos abatement. Claims made policies are unacceptable.

7. Submit evidence of notification: Contractor shall submit documentation of the required notification to the ADEQ/EPA, as specified in paragraph “Licenses, Permits, and Notifications” above, prior to starting work.

8. Air Monitoring results: Submit documentation of fiber counts. Submit monitoring results to the COR within 24 hours of receipt, signed by Director of the testing laboratory.

9. Waste shipment records: Submit completed waste shipment records for regulated asbestos containing materials [RACM] as required by the National Emission Standards for Hazardous Air Pollutants [NESHAPS] regulations. The term “owner” shall refer to the Government. The term “operator” shall refer to the contractor. The signature block for the operator shall be signed by an authorized agent of the contractor. At the completion of the project, submit a final report.

This report shall contain, all air monitoring results, all clearance testing results, and the WSR record for disposal of the asbestos removed.

1.13 MEASUREMENT AND PAYMENT

A. Payment shall be a lump sum for the removal and disposal of existing asbestos flooring materials and pipe and will include and all equipment, material, work and incidentals required to complete the item as described in the scope of work.

PART 2 - PRODUCTS

2.1 EQUIPMENT

A. Warning Signs and Labels: Provide warning signs in accordance with OSHA 29 CFR

1926.1101 at all approaches to asbestos control areas. Provide all drums, bags, wrapped components, or other similar asbestos laden containers with appropriate warning labels.

B. Local Exhaust System: Local exhaust systems (for enclose work areas) must be installed and operated in accordance with ANSI Z9.2. The contractor shall notify the COR immediately of any variance in the pressure differential which could cause exposure of adjacent unsealed areas to asbestos fiber concentrations in excess of 0.01 fibers/cc.

C. Temporary Utilities: The contractor must supply water and power to the work site as necessary. In most cases, though not always, electrical power and cold water for use will be available within 200 ft of work site. The contractor may be required to provide electricity with an electric generator or to transport water onto the work site for use.

However, hot water in quantities needed for showers will not be available and must be provided by the contractor.

PART 3 - EXECUTION

3.1 WORK AREA

A. Perform asbestos-related work in accordance with OSHA, EPA, and any State of Arizona Department of Environmental Quality (ADEQ) Air Quality Division regulations, and as specified herein.

1. Asbestos Control Area Requirements: The construction of a totally enclosed asbestos control area may at times be impractical or impossible within the project limits (such as for outdoor asbestos work). When this determination is made, the contractor may submit the details of alternative control measures as part of the Asbestos Work Plan. Provide a 20-foot roped off perimeter around the area where the asbestos handling procedures are performed and maintain other requirements for asbestos control areas.

2. Control Area Requirements for Removal of Non-friable Asbestos Materials: For interior surfaces where the non-friable asbestos surface material (such as Resilient Floor Coverings, Vinyl Asbestos Tiles, or Asbestos Cement panels) can be removed intact, perform the work in accordance with applicable OSHA regulations.

3. Monitoring: Monitoring of airborne concentrations of asbestos fibers shall be in accordance with 29 CFR 1926.1101 and as specified herein using NIOSH Method 7400. The Government shall have the option to perform independent monitoring.

4. Site Inspection: While performing asbestos removal work, the Contractor shall be subject to on-site inspection by the COR who may be assisted by Government safety or environmental personnel. If the work is found to be in violation of any part of these specifications, the COR will issue a stop work order which will take effect immediately and remain in place until the violation is resolved. Standby time and expenses required to resolve the violation shall be at the Contractor’s expense.

3.2 CLEARANCE SAMPLING AFTER FINAL CLEANUP

A. For enclosed containment areas, after the removal site has passed the visual inspection, the contractor shall perform an aggressive air sample of the area (at least 3 samples per removal site, with minimum volume of 3000 liters per sample). Submit the results of these samples to the COR. The contractor shall not remove the containment area until written permission is received from the COR. Before authorization to tear down the containment structure will be granted, the fiber counts from all three samples must be less than 0.01 fibers per cubic centimeter of air. If the baseline TWA, established before work began, is greater than 0.01 f/cc, then all three samples must not exceed the baseline count. Should any of the three final samplings indicate a higher value, the Contractor shall re-clean the area and shall repeat the clearance process until the fiber count is equal to or below that set by the above limits. All costs associated with re-cleaning and re-testing as a result of failure to meet clearance sampling limits or visual inspections mentioned above shall be borne by the contractor.

3.3 DISPOSAL OF ASBESTOS

A. Collect asbestos waste, scrap, debris, bags, containers, equipment, and asbestos-contaminated clothing which may produce airborne concentrations of asbestos fibers, in sealed double 6 mil plastic bags labeled in accordance with 29 CFR sec. 1910.100 (j)

(2) or 1926.1101 (k) (2) (iii). The name “US Forest Service” and the location of the site where the asbestos waste was generated must be clearly and permanently affixed to the container label or wrapping. Where the asbestos material is hard or otherwise has sharp

edges the material shall be prepackaged in burlap, nylon or other material to prevent puncture of the plastic. Dispose of waste asbestos material in the approved landfill designated in the submittals. No asbestos waste will be permitted to leave the site without a completed and signed waste shipping record. Upon arrival at the approved disposal site, the WSR is to be signed by the site personnel and a copy of the signed WSR is to be sent to the contractor within the time frame as required by 40 CFR 61.149(e). A copy of the returned WSR is to be provided to the COR. If the signed copy of the WSR is not received by the contractor within 35 days, the contractor must contact the site to determine the status of the waste shipment. If after 45 days a copy has still not been received, the contractor must notify U.S. EPA Region 9 Asbestos NESHAPS Coordinator in writing and provide the following information: (a.) A copy of the WSR for the load in question, and (b.) A cover letter signed by the contractor explaining his efforts to locate the waste shipment and the results of those efforts. Failure to comply with this or other requirements of the specification will constitute sufficient grounds for termination of this contract. Procedure for hauling and disposal shall comply with 40 CFR 61, Subpart M, 49 CFR 172-177, 40 CFR 241 and 257, and state, regional, and local standards.
