About this file
This is Amendment 1 to Invitation to Bid (ITB) 32701-13951 issued by the Tennessee Department of Environment and Conservation for the Clouse Hill Reclamation Project. The amendment updates the ITB schedule of events and provides critical clarifications on project specifications and bonding requirements. The pre-response conference is scheduled for August 4, 2026 at 10:00 a.m. CT, with written questions and comments due August 7, 2026 at 2:00 p.m. CT, and bids due August 26, 2026 at 2:00 p.m. CT. The project encompasses reclamation services on 84.5 acres of abandoned strip mine land across three sites in Grundy County, including mobilization, clearing and grubbing, area grading, excavation, placement of 2,150 tons of riprap and 500 tons of road limestone, 4,300 square yards of filter fabric, and 21,100 linear feet of silt retention barriers. The contract term is twenty-four months with an option for the State to extend an additional 180 days at its sole discretion, and work must commence within 30 days of order and be completed within 330 calendar days with enforceable milestones requiring 25% completion by Day 82, 50% by Day 165, and 75% by Day 247.
The amendment clarifies that contractors may substitute silt fence or 12-inch wattles for mulch berms for silt control, with all methods paid at the same unit price per linear foot, and may choose to burn clearing debris in compliance with Section 201.0 specifications and applicable laws. Performance Bond requirements are set at $2,203,350.00 or 100% of total bid price if the bid exceeds that amount, while Payment Bond requirements are $550,837.50 or 25% of total bid price if the bid exceeds $2,203,350.00, with both bonds issued by Tennessee-licensed companies. The contract is federally funded through a grant from the U.S. Department of Interior's Office of Surface Mining, and award will be made as a single contract to the lowest-cost responsive and responsible bidder meeting all licensing and compliance requirements. The amendment also replaces the project specifications attachment with "Clouse Hill Specifications (8.11.26)" and updates the terms and conditions document to "ITB 32701-13951 T&Cs (UPDATED)," with all revisions effective upon release.

QUESTION / COMMENT STATE RESPONSE
1) Can waddles or silt fence be used in lieu of the mulch berms?
Yes, the contractor may choose to use silt fence or 12-inch wattles in lieu of mulch berms. The silt fence or wattles must comply with Section 211.0 of the project specifications and be installed as specified in these same specifications. Whichever methods of silt control are used (mulch berm, silt fence, or straw wattles), all will be paid for at the same unit price bid per linear foot.
Additionally, while mulching all clearing debris up to 20-inches in diameter is the preferred method of clearing debris disposal, the contractor may choose to burn all clearing debris following the method described in Section 201.0 of the project specifications and in strict compliance with all applicable laws and ordinances.
2) What will the dollar amounts be for the Payment Bond and Performance Bond?
The State requests that the Performance Bond be in the amount of two million two hundred three thousand three hundred fifty dollars and zero cents ($2,203,350.00). If your bid price exceeds that dollar amount, then the Performance Bond would need to be in the amount equal to 100% of your total bid price.
The State requests that the Payment Bond be in the amount of five hundred fifty thousand eight hundred thirty-seven dollars and fifty cents ($550,837.50). If your bid price exceeds two million two hundred three thousand three hundred fifty dollars and zero cents ($2,203,350.00), the Payment Bond will need to be in the amount equal to 25% of your total bid price.
