About this file

This is an Invitation to Bid (ITB) solicitation document issued by Charles County Government, Maryland, seeking qualified contractors to provide new vehicles on an as-needed basis. The solicitation covers light, medium, and heavy-duty vehicles including sedans, crossovers, SUVs, pickup trucks, vans, and chassis cabs that may be factory ordered, sourced from bailment pools, or obtained from contractor inventory. Bidders must be authorized dealers in good standing for their respective manufacturers and physically located within 50 miles of the Department of Public Works Facilities Vehicle Maintenance building in La Plata, Maryland. The contract base period runs from the execution date through December 31, 2024, with one optional one-year renewal at the County's sole discretion, automatically renewing unless either party provides 45 calendar days' notice of non-renewal prior to the contract anniversary date. Bidders must acknowledge all addenda, submit responses through the County's OpenGov Procurement Portal, and maintain bids as valid for a minimum of 120 days from the due date. A pre-bid meeting is optional with advance registration required, and bid opening will occur virtually with pricing available immediately thereafter on the eProcurement Portal.

Pricing shall be quoted as a dollar adjustment amount (plus, minus, or zero) applied to dealer invoice pricing, which includes Original Equipment Manufacturer (OEM) invoice pricing, manufacturer-to-dealer transportation costs, advertising adjustments, and upfitter pricing for installed or modified equipment. The County will not accept manufacturer suggested retail price (MSRP). All applicable government bid concessions, discounts, and incentives must be included in quoted prices. Unit prices shall remain firm through the base contract term; thereafter, pricing may be adjusted annually by the percentage change in the Consumer Price Index upon written request and County approval. The County intends to award to the lowest responsive, responsible bidder and may make awards to single or multiple firms. Contractors must provide comprehensive documentation including experience forms demonstrating five years of relevant commercial fleet sales experience with three client references, a Maryland "Dealer - License to Sell New Vehicles" license, proof of Maryland trader's license within ten working days of intent to award, and detailed warranty information from manufacturers. Additional requirements include insurance certificates meeting specified limits, MBE utilization affidavits (with an aspirational 25% MBE goal), SLBE certification forms for registered Charles County SLBEs, non-collusion affidavits, and intended subcontractor information. Vehicles must be original and complete from the OEM or completed by intermediate or final-stage manufacturers with proper certification labels; dealer-added items on on-the-lot inventory vehicles are reimbursable only at dealer cost of materials and labor, itemized on quotes and invoices. The County reserves the right to reject any or all bids, cancel the solicitation, modify the ITB process, and conduct facility inspections of responsive bidders.

B. Except as herein provided, no order, statement, or conduct of the CONTRACTING OFFICER shall be treated as a change under this article or entitle the CONTRACTOR to an equitable adjustment hereunder.

C. B. No claim of the CONTRACTOR under this article shall be allowed unless the CONTRACTOR has given the notice required in paragraph (A.) above; provided, however, the time prescribed therefore may be extended by the County.

C. No claim by the CONTRACTOR for an equitable adjustment hereunder shall be allowed if asserted after final payment under this contract.
