About this file

This is Amendment #1 to an Invitation for Bids (IFB) issued by the New York State Department of Transportation (NYSDOT) for solicitation reference BA26-010, dated July 15, 2026. The solicitation concerns the purchase of one portable screener and one RC tracked skid steer for use by NYSDOT Region 6. The amendment updates the Bidders Worksheet and provides official clarifications to questions submitted during the formal Q&A period. Key specifications clarified include: an additional 2-wire harness extended to the rear of the unit with a capped Deutsch connector for optional safety lighting; a bottom screen model SCM-40C; and Flex-Mat options in both "S" type and 5/8" spacing with pricing required for both variants. Bidders must initial all amendment pages and return the fully completed and signed amendment document with their bid submission.

The amendment also addresses Section 165(6) of the New York State Finance Law regarding discriminatory jurisdictions. Entities with principal places of business in jurisdictions identified as discriminatory against New York State businesses—specifically Alaska, Hawaii, Louisiana, South Carolina, West Virginia, and Wyoming—are subject to contract denial if goods and services are substantially produced or performed outside New York State. The State agency head may waive these sanctions if determined to be in the best interests of the state, with notification required to the State Department of Economic Development. All bids will be evaluated based on this amendment, which constitutes a mandatory component of bid submissions.

RESPONSE: Section 165(6)(b) of the State Finance Law requires the Commissioner of the Department of Economic Development to develop a list of discriminatory jurisdictions. This is a list of states, provinces, countries, or other political subdivisions that employ preferences or price distorting mechanisms on or discriminate against New York state businesses in the procurement of commodities or services in their jurisdiction.

The current list of discriminatory jurisdictions identifies the following jurisdictions as continuing their discriminatory policies against New York State bidders: Alaska, Hawaii, Louisiana, South Carolina, West Virginia and Wyoming.

Section 165(6)(d) of the State Finance Law requires all State agencies to deny to a business in a jurisdiction that discriminates against New York State businesses an award of a contract if two conditions are met:

· the businesses’ “principal place of business” is in a jurisdiction that discriminates against New York businesses, and

· the goods and services being offered are substantially produced or performed anywhere outside New York State.

Sanctions may be waived by the head of a State agency if it is determined in writing to be “in the best interests of the state” to do so. In compliance with State Finance Law Section 165(6), a State agency must notify the State Department of Economic Development of a waiver of discriminatory jurisdiction sanction requirements.
