C. All work shall be installed in cooperation with all subcontractors, sub-subcontractors and material suppliers. The Contractor shall investigate interrelated conditions in the work and shall make proper provisions to avoid interferences before beginning of fabrication or installation of materials. All changes to the work caused by the Contractor’s neglect of these requirements shall be made by him at his expense.

Any changes caused to a subcontractor due to minor changes made by another subcontractor on the project shall be coordinated between them at no additional cost to the Owner.

H. The Contractor acknowledges that, even though Contract Documents may not be perfectly coordinated, his contract price includes all work reasonably inferable from any of the Contract Documents and he shall make all building components function in the manner intended. This may include such items as properly wiring all equipment requiring electricity to function even though the electrical drawings do not show a circuit to the equipment, coordinating the location of ductwork, piping, fixtures, etc., so as not to interfere with each other (so long as all components can physically fit within the designed space), etc.

I. Contractor is responsible for field check of quantity and type of existing equipment in the project shown or specified to be replaced by new. Contractor’s neglect of this requirement will not relieve him of furnishing all required new equipment at no additional cost to Owner.

1.03 DEMOLITION: CUTTING AND PATCHING:

A. The Contractor shall demolish and remove from the property all items shown on the drawings and/or scheduled elsewhere in these specifications to be removed. Coordinate with requirements of Section 02 41 16.

Provide protection from adverse weather conditions for portions of the project that might be exposed during cutting and patching operations.

E. Do all patching of new rough construction and new finish work required for completion of the work. Patches shall match adjacent work in materials, quality and appearance.

Patching of surfaces must be done by the appropriate trade. (Plaster by plasterers, masonry by masons, etc.).

SPECIAL CONDITIONS 01 30 00-4

F. Whenever existing structure and/or finishes are cut or otherwise disturbed by new work or remodeling work, they shall be patched properly, and patches shall be finished to match existing work as noted on the drawings and as required. This work shall be done in accordance with applicable sections of the specifications. New materials required to match existing materials shall be equal to existing materials in design, appearance and quality and shall be subject to approval of the Architect. Submit samples if requested.

1.04 ASBESTOS:

A. No asbestos work of any nature is included in this Contract.

B. Due to the age of the building, asbestos may be encountered. If during the construction of this project, work involving asbestos is suspected, or encountered, the Owner or the Owner’s representative shall be notified immediately and the Owner with his own forces or by separate contract shall be responsible for complete investigation, removal, and disposition of the asbestos hazard in accordance with applicable laws and regulations.

C. If the Contractor claims that delay or additional cost is involved because of such action by the owner, he shall make such claim as provided elsewhere in the contract documents.

D. No incidental or permanent materials containing asbestos in any form shall be used in this project.

E. Upon substantial completion, the Contractor shall submit a statement certifying that no materials containing asbestos in any form have been used on the project. The Owner reserves the right to make his own, independent tests for asbestos after Substantial Completion. Any asbestos found shall be removed in accordance with Federal, State and Local regulations at no additional cost to the Owner.

1.05 LEAD BASED PAINT:

A. Due to the age of the building, Lead Based Paint and other lead containing products may be encountered during renovation/demolition activities. All contractors shall complete all renovation/demolition work in accordance with the requirements found in 29 CFR 1926.62 and state and local requirements. Submit documentation of compliance with this standard to the Owner prior to start-up of work, including an air monitoring plan, dust control measures, etc. All compliance sampling and other control measures for potential lead dust shall be addressed within the exposure control and monitoring plan prepared by the Contractor. All compliance sampling shall be performed by individuals working under the direction of the Contractor’s Competent Person. Following completion of work, submit all monitoring documentation to the Owner. The Owner may elect to do independent testing.

SPECIAL CONDITIONS 01 30 00-5

B. The OSHA “Lead Exposure in Construction Rule (29 CFR 1926.62)” gives no guidance on acceptable levels of lead in paint at which no exposure to airborne lead (above the action level) would be expected. Rather, OSHA defines airborne concentrations and references specific types of work practices and operations from which a lead hazard may be generated (reference 29 CFR 1926.62, section d).

Environmental and personnel monitoring should be conducted during any removal or demolition process (as appropriate) to determine actual personal exposure. This monitoring information can be used to determine the levels of personnel protection and environmental controls required for the work involving specific renovation/demolition processes on specific structures. Under OSHA requirements, the Contractor performing the work will be required to conduct this monitoring and follow all of the other requirements found in 29 CFR 1926.62. It is important to note that environmental controls will vary dependent upon the content of lead in paint, the process used to remove it, duration of work, and the amount of paint to be removed.

C. The Environmental Protection Agency (EPA) requirements for testing of lead waste generated from the work will also apply for disposal characterization. EPA regulations require that a generator of waste determine if that waste is hazardous by performing testing in accordance with the requirements of 40 CFR 261.11 or for wastes that may be RCRA hazardous (such as items with high lead content), the generator may assume that the waste is hazardous and comply with the hazardous waste regulation.

1.06 PCBS IN CONSTRUCTION MATERIAL:

A. Due to the age of the building, PCBs may be encountered during renovation/demolition activities. The school building has not been tested for PCBs in the caulking and other building materials. All Contractors shall complete all renovation/demolition work in accordance with the requirements found in 40 CFR 761, the Toxic Substances Control Act (15 U.S.C.2605), State and Local regulations covering exposure, removal and disposal of PCBs. The General Contractor is also responsible for all testing, containment, and clean-up in accordance with the above regulations.

1.07 SALVAGE MATERIALS:

A. All existing materials which have been removed by the Contractor and which are not designated in the Contract Documents to be reused or turned over to the Owner shall become the property of the Contractor and shall be removed from the site. Material designated for the Owner shall be stored in a suitable protected location on the site as directed.

SPECIAL CONDITIONS 01 30 00-6

1.08 SCHEDULES AND CONDITIONS OF WORK:

A. The Contractor shall schedule the work to suit the Owner’s requirements. Scheduling shall be approved by the Owner and Architect.

B. Within fifteen (15) calendar days following the signing of the Contract as indicated in the Supplementary Standard General Conditions of Contract for A201 (2017), Specification section 00 73 00, a construction progress schedule shall be submitted in the form of a horizontal Gantt chart type as indicated. The schedule shall be reviewed periodically and updated as required.

C. The existing building will be occupied by the Owner and in full operation during construction.

D. The Contractor shall be responsible for maintaining the following systems and services in full operation during construction:

1. All existing utility services including, but not necessarily limited to, water, gas, electrical, telephone, sanitary and storm sewers.
