About this file

This is a Living Wage Submittal document from the City of Austin, Texas, outlining mandatory wage requirements and compliance procedures for contractors and subcontractors engaged in city contracts. The document establishes that all contractor employees and subcontractors directly assigned to the contract must be paid a minimum living wage of $22.05 per hour. Contractors are required to submit a certification with their offer listing all employees directly assigned to the contract, including their names and job titles, with the list to be updated throughout the contract term as necessary. Within 30 days of contract execution, contractors must provide individual employee certifications signed by each employee assigned to the contract. Annual certifications must be resubmitted on the anniversary date of contract execution, and additional certifications are required when new employees are added or changes occur. The City Contract Manager will periodically review submitted employee data and may request access to employee records to verify ongoing compliance.

Contractors must certify that all known employees of the prime contractor and subcontractors at all tiers are compensated at rates equal to or greater than $22.05 per hour and commit that all future employees will receive the minimum living wage. Contractors agree not to retaliate against employees claiming non-compliance. Violations of the living wage provision require contractors to pay affected employees the wage deficiency for each day the violation continues. Willful or repeated violations, fraudulent statements on certifications, or failure to comply may result in contract termination for cause, suspension or debarment of the violating firm, or legal action. The City reserves the right to conduct periodic reviews and request documentation at any time during the contract term to ensure compliance with these living wage requirements.
