About this file
This is an Employer Certification document for the Wage Theft Ordinance Responsibility Criteria issued by the City of Austin, Texas, in conjunction with a rental activated carbon-based air treatment units contract. The certification requires all employers submitting offers to the City to certify compliance with wage theft regulations under City of Austin Ordinance No. 20221201-031 and Austin City Code Chapter 4, sections 4-22-1 through 4-22-6. All employers awarded contracts with the City must complete the City of Austin Wage Theft Training within thirty days of contract award. The document serves as a pre-award responsibility criterion that must be completed and submitted as part of the solicitation process.
The certification requires the employer to attest under penalty of perjury that the firm has not been adjudicated for wage theft-related incidents as defined in Austin City Code Chapter 4, sections 4-22-1(G) and (H) within five years prior to the solicitation posting or agreement start date. The certifying firm must agree to abide by the obligations outlined in Austin City Code sections 4-22-5(B) and 4-22-6(A). The document must be signed by an authorized representative of the firm, including the firm's full legal entity name, the signatory's printed name and title, and the location and date of execution. Questions regarding the wage theft certification requirements may be directed to wagetheft@austintexas.gov.
