About this file
This is a Solicitation Q&A Log for federal contract opportunity HTC71126QE156, Bremerhaven Stevedoring Services and Related Tasks (S&RTS), updated October 5, 2026. The document records five prospective vendor questions received between September 24 and October 1, 2026, with corresponding government responses and amendment status.
The questions and resolutions address critical contract execution issues: Question 1 identified and corrected formulas in the Schedule of Rates for 6-month extension pricing calculations in Columns Q and X, resulting in an RFQ amendment. Question 2 sought clarification on detention compensation line items in the Schedule of Rates for circumstances outlined in PWS Section 4.7.2, with the government confirming compensation is addressed in existing PWS language without requiring amendment. Question 3 clarified detention compensation applicability when a contractor's workforce is on standby due to delays caused by other contractors at the Port of Bremerhaven, confirming entitlement to compensation under PWS Section 4.7.2 when delays are beyond the contractor's reasonable control and distinguishing this from non-compensable internal delays under PWS Section 4.7.3. Question 4 confirmed all contract work must comply with local Bremerhaven access permissions, work authorization (Hafenarbeitskarte), and collective bargaining agreements per PWS Sections 4.1.1, 4.1.3, and 6.2.2. Question 5 resulted in removal of PWS Sections 3.3.1.2 and 3.3.1.2.1 regarding Site Safety Health Officer requirements, triggering an RFQ amendment. Two of five questions resulted in RFQ amendments.

In the Schedule of Rates document, Column Q intends to calculate the pricing rate for a 6-Month Extension period. However, the formula seems to be incorrect. The formula currently displays as “=(P7*$X$3)+P7/2”. However, when looking at the pricing sheet, line items are intended to be priced at the appropriate unit. As such, although the period is a 6-month period, the formula should display as “=(P7*$X$3)+P7”, taking out the “/2”. In turn, Column X also currently calculates as “=R7*Q7”, but should calculate as “=(R7/2)*Q7”
1-Oct-26 These formula updates have been made. Please see updated Attachment 2: Schedule of Rates 10.5.2026.

PWS Section 4.7.2 (Detention) provides for detention compensation under certain circumstances. Could you please assign a corresponding detention line item within the Schedule of Rates?
1-Oct-26 Compensation for Detention is stated in 4.7.2 of the PWS: "The contractor shall be compensated XL detention during the first shift and overtime for any other shifts than the first." No

PWS Sections 4.7.2 and 4.7.3 state that detention is not compensable while labor required for a commodity operation is actively performing commodity work. U.S. military vessel operations at the Port of Bremerhaven are facilitated utilizing 3 separate, primary portside contracts. Each contract awarded under this program serves a distinct and critical function in the successful execution of the overall operation. As a result, performance under each contract is inherently interdependent, with certain activities requiring the completion of preceding tasks by other contractors before subsequent work can commence. Given the operational dependency, could you please clarify how a contractor performing under the Bremerhaven S&RTS contract will be compensated for detention, delay, or standby time when its workforce and equipment are available and prepared to perform commodity-rate work, but are unable to proceed due to delays in the completion of prerequisite tasks by another contractor? Our understanding is that the non-compensable restriction applies only to labor assigned to the specific commodity operation under this specific S&RTS contract, but the restriction does not extend to labor performing commodity work under a different US Military contract at the Port of Bremerhaven
1-Oct-26
We have the same understanding. The contractor is entitled to compensation for detention time when its workforce is on standby due to delays caused by another contractor.
Both the contract's Scope of Work (PWS Section 1) and the government's IGCE confirm this separation. They specifically identify "LASHING ONLY" (Schedule 1A1a) as a unique service. This shows that lashing is not just a part of loading, but its own defined job.
Detention Pay 4.7.2: Because the work is separate, a delay caused by the Longshoring contractor is considered "beyond the contractor's reasonable control."
This is the exact trigger for compensable detention time as defined in this section of the PWS.
Example: It is compensable if the Stevedore must wait because the Longshoring contractor has not loaded any cargo for them to lash.
Non-Compensable Time 4.7.3: This rule is not applicable in this situation. It is meant only for internal delays within the Stevedore's own team, for instance, if one lashing gang has to wait for another.

Please confirm that all work under this contract should be implemented by using the local Bremerhaven access permission and work authorization to operate on the BLG terminal (Hafenarbeitskarte) for all labor in accordance with the local Bremerhaven collective bargaining agreement.
1-Oct-26
This statement is fully confirmed by the PWS.
PWS 4.1.1 and 6.2.2: These sections mandate that all personnel must possess the required local port access credentials ("Hafenarbeitskarte").
PWS 4.1.3: This requires the contractor to operate in accordance with the local collective bargaining agreement.
No

PWS 3.3.1.2 Site Safety Health Officer (SSHO) – A qualified Site Safety Health Officer must be on-site during all periods of operation when directed by the COR. As this is a COR preference, will this be ordered as Extra Labor in the Schedule of Rates?
5-Oct-26 PWS 3.3.1.2 - 3.3.1.2.1 have been removed from the Bremerhaven Stevedoring PWS.
Please see updated PWS.
