About this file

This is a Questions and Answers (Q&A) document for solicitation HTC71124RR012 regarding Stevedoring and Related Terminal Services (S&RTS) at the Port of Gulfport. The document contains a single question dated January 13, 2025, where a prospective vendor asked about completing the Technical Worksheet Evaluation Questions as a small business commercial subcontractor.

The government's response clarifies that subcontractors should not submit proposals directly to the government for this solicitation. While the FAR doesn't explicitly prohibit subcontractor submissions, the response explains that proposals should come from prime contractors, who may then subcontract portions of work if awarded. The response emphasizes that any package submitted to the government must be complete to be considered for this Department of Defense United States Transportation Command opportunity.

PROSPECTIVE VENDOR'S QUESTION DATE OF REPLY GOVERNMENT'S RESPONSE AMEND RFP?

I need some clarification on the technical worksheet.

We will be submitting our proposal as a small business commercial subcontractor so should we still proceed with completing the Technical Worksheet Evaluation

Questions as a Subcontractor?

13-Jan-25

While the Federal Acquisition Regulation (FAR) does not explicitly state that a subcontractor cannot submit a proposal for a solicitation, the FAR is structured in a way that generally assumes a prime contractor submits proposals and then may subcontract portions of the work if awarded the contract, meaning a subcontractor would typically need to be invited by a prime contractor to bid on a subcontract, not directly submit a proposal to the government on their own.

In specific situations, depending on the nature of the solicitation and agency policies, a subcontractor might be allowed to submit a proposal directly, but this would usually require explicit guidance from the contracting officer. With regard to HTC71124RR012, a subcontractor would not submit anything to the government but may submit something to a prime contractor. The package submitted to the government, in response to the RFP, needs to be complete to be considered.
