QUESTIONS AND ANSWERS FOR RFP HTC71120RR002

ROUND 2

(Questions #16 thru #27)

16. QUESTION –REF Section 3, Page 6, Paragraph 4: While we understand the requirement for fresh labor the historical work period in Texas is from 07:00 – 23:00. This is based on our current labor hiring rules and practices. Will we be allowed to continue the long standing work practice of working from 07:00-23:00?

16. ANSWER: In accordance with PWS Paragraph 3.4, the unit commander will conduct risk assessments and make the decision whether contractor labor may work beyond the requirement.

17. QUESTION – REF Page 8, Paragraph 5 & 6.1: Can you please clarify that training on military/specialized military equipment will not be paid for by the military, as customary, but will be at the Contractors expense? If at the Contractors expense, how will the contractor be compensated for the cost of the wages paid to labor?

17. ANSWER: Unless otherwise prohibited by SDDC Regulations, the Contractor will be compensated at man-hour rates. See amended PWS Dated 31 January 2020

18. QUESTION – REF Section 4, Page 13, Paragraph 4, 4.1, 4.2.1, 4.3, 4.3.1, 4.3.3: Can you please clarify how the contractor will be paid for OOP expenses? Section 8 of the SOR currently has a fix amount entered and the cell is locked. Where can the contractor place their proposed markup for purchasing administrative fees?

18. ANSWER: The amount for out-of-pocket expenses is merely an estimate which is established by the Government. The Contractor is not permitted to insert its own rate for the line item however if workload demands an increase for the line item amount, the COR will seek proper approvals.

Out-of-pocket expenses will be reimbursed in accordance with PWS Section 4.4.2 which states that the “Contractor shall coordinate with the COR and the OO regarding all OOP expenses prior to incurring any costs. The Contractor shall only provide items or services after receipt of written approval from the COR or CO for each item purchased in the form of a Task Order. The

Contractor shall not incur any OOP expenses valued at $3,500 or more per item or service without written approval of the CO, in addition to the signed TO.” Reasonable administrative fees, including all other OOP expenses, will be paid according to the procedure listed above.

19. QUESTION – REF Section 4, Page, 19, Paragraph 4.12: Can you please clarify the intent of this paragraph? Are you stating that you won’t pay overtime as required by CBA?

19. ANSWER: The Government will pay overtime as required and in accordance with the awardee’s prevailing CBA.

20. QUESTION – REF Section 5, Page, 25, Paragraph 2.1: Please clarify if the contractor will be required to work on the two defined no work days in our CBA?

20. ANSWER: The requirement is to provide labor 365-days per year, 24-hours per day. Labor provided under the contract will be in accordance with the governing CBA.

21. QUESTION – REF Section 5, Page, 28, Paragraph 9.6.1: How much of the cargo will require tarpaulins and the removal/installation of sideboard and rails. If no definitive number can be given it can only be assumed that all cargo will need these tasks performed.

21. ANSWER: The Government is unable to speculate on the amount of cargo moved that will require removing and reinstalling of transporter components. Compensation will be included in the commodity rates.

22. QUESTION – REF Section 5, Page, 29,30, Paragraph 10.2, 10.3, 10.6, 5.11: How is the contractor to know how much time it will take perform opening, closing, replacement of tarpaulins, battens, hatch covers, temporary covers and beams for an unknown operation and commodities? Please clarify if these services will be handled on extra labor as customary?

There isn’t any way to know how much cost to add to various commodities for these unknown services.

22. ANSWER: This shall be included in the commodity rates. This measure is common practice in loading and unloading vessels.

23. QUESTION – REF Section 5, Page, 31 Paragraph 11.4: Please clarify if the contractor is only responsible for cleaning, sweeping and removing debris created by their operation. Will sweeping and cleaning of debris resulting from the transport of the cargo, leaking/damaged cargo or others (loading) be paid on a man-hour basis?

23. ANSWER: This will be paid on the commodity rates however under special circumstances, and when approved by the COR, it can be paid through Extra Labor rates.

24. QUESTION – REF Section 5, Page, 34 Paragraph 20: This section states the contractor will be compensated based on the rates contained in section 1F of the SOR. There isn’t a section 1F in the provided SOR. Will a new SOR be provided?

24. ANSWER: The sentence should read as follows: If requested, compensation for services defined in this paragraph may be included in the commodity rates established in the SOR.

Disregard the “Section 1F” as this was a typo. See Amended PWS dated 31 January 2020.

25. QUESTION: Will price adjustments resulting from contractual labor increases (wage, fringe, etc.) be allowed over the life of this contract?

25. ANSWER: IAW the RFP, the following FAR clause is applicable: FAR 52.222-43, Fair

Labor Standards Act and Service Contract Labor Standards – Price Adjustment (Multiple Year and Option Contracts)

26. QUESTION: Based on the Round 1 Q&A, shouldn't section 6.5.4.1 remain in the PWS to cover these services in Ports Arthur? The original question was asked so rates could be established for this service in Port Arthur and, if needed, extra services in the other ports. Will this section be reinstated and the SOR revised.

26. ANSWER: No, because there will be no line item for it since the contact maintenance team and equipment is part of all commodity rates for truck, rail and vessel.

27. QUESTION: Base on Round 1 Q&A, Question # 6 : The provided answer addresses section

5, page 38, paragraph 34. However, it doesn't address paragraph 34.1. Due to the same reasons as paragraph 34 all crane hire should be OOP and not a fix rates. Will the SOR and PWS be amended accordingly?

27. ANSWER: Please see Amended PWS dated 31 January 2020 Paragraph 5.34.1. The

Government shall reimburse costs as defined in the PWS.
