MOTCO Q and A #2

HTC711-18-R-R005

Q# Document Par. Ref. Subject Question Government Response

1 PWS 1.1.4. Rail Operations

Base Bid 'Monthly Fee - Standard Rail Operations; We understand this is for 2 locomotives with a 6 person trained crew. What is unclear to all the Q&A is the common reply of 24/7 requirement. The relationship of this base bid, 24/7, and 3 hour call out service needs to be more clearly described on what MOTCO is looking for in this base bid. It is our assumption and question to you that MOTCO is looking for a bid to be:

.6 man crew 0700 - 1530 at CNWS 5 days a week / 52 weeks per year (less Holiday if no work required).

.If ramp up or emergency service is required a 3 hour notice is given and paid for by "Emergent Circumstances" and the additional crews are paid by line items for 3rd and 4th and 5th locomotive items.

.24/7 requirement will be followed upon requirements for chosen size of crews and as directed by MOTCO.

The expectation for the basic rail operations CLIN (CLIN 009) is that within 48 hours train crews will be on site to operate two government locomotives.

This requirement is for up to 24/7 operations. The particular number of crews and exact staffing is left up to the offeror but must be within the bounds of industry regulations (i.e. crew rest requirements) and this PWS. Historical data is provided for informational purposes only to provide an idea of the workload in recent years.

If the "Emergent Circumstances" CLIN (CLIN

010) is needed, the contractor should provide crews to operate one government-owned locomotive within 3 hours. This requirement may also be needed for 24/7. The offeror is responsible to meet the basic performance standard.

All crews in all CLINs are required to be 3-person as described in PWS.

2 PWS 1.1.4. Rail Operations

If 24/7 is required by MOTCO and our bid is based on 8 hour days for quantity of locomotives needed then what bid item covers the additional crew time to meet 24 hours? 24/7 basically will require 3 shifts of new crew within the 24 hours, is this also what MOTCO is looking for?

This requirement is described as a performance level. The offeror should determine that a certain number of crew is required to meet the performance standard of this PWS while staying within the bounds of industry norms and regulations.

3 RFP/PWS various Hourly wages

Response to Q&A in addendum #3 is vague as hourly wages based on state and local labor laws vary with companies that are union or non-union and sometimes are project driven. Davis Bacon or Prevailing Wages are required when government agencies fund contracts so it is our assumption that this bid is Prevailing Wages and possibly that certified payroll is required. These rates are posted annually on this website for Caution-https://www.dir.ca.gov/oprl/2018- 1/PWD/Northern.html.

This requirement is a services contract. As such, the Davis Bacon Act would not apply. The Service Contract Act would have applied, however, the DOL exempted this effort from the SCA. The result of that exemption is each company must base their bid on their knowledge of the industry.

Q# Document Par. Ref. Subject Question Government Response

4 RFP/PWS various Hourly wages Please let us know if this is correct and if certified payroll is required monthly in order to get paid.

Certified payroll would not have to be submitted for the Firm-fixed price CLINS. You may have to submit payroll for the COST CLINS should that be part of the "cost" you are billing the Government for.

5 PWS 1.1.1.

Inspections and

Preventative Maintenance

Item 0002 Monthly Service - Preventative Maintenance includes a lot of required work within this RFP. Please comment on each of the following:

A) Animal & Vegetation control is included within this item for 43 miles correct? What is anticipated for animal control?

A) Correct. Animal and Vegetation Control is required over the entire track system. Animal control includes mitigation of any animals affecting the rail network. Example: A ground squirrel burrow that affects the integrity of the rail system or ballast would need to be mitigated.

6 PWS 1.1.1.

Inspections and

Preventative Maintenance

B) Drainage and culvert maintenance is included in this item for 43 miles correct? What is the expected maintenance required in bid and what is outside of bid to be covered by a quote as unscheduled repairs.

C) Furnishing new bolts, joint bars, lubricant, switch stands as required for maintenance is stated in RFP and also has been responded to in the Q&A that contractor is to furnish them. How will this unknown quantity of parts be paid for?

D) Item is a unit of months and qty of 12 each so does this mean that MOTCO is looking for contractor to do 1 day a month of track only maintenance only utilizing a full crew with equipment and tools as necessary to address deficiencies that can be tackled in 8 hours? If yes then what about deficiencies that cannot be tackled in 1 day of work?

B) See UFC 4-860-03 section 3-1 "Drainage" for what should be covered under preventive maintenance. Preventive maintenance includes visual inspection and clearing of obstructions.

Unscheduled repairs would be reserved for something unforeseen or an upgrade such as collapse of a culvert or upgrading the culvert to handle increased drainage flow.

C) The successful offeror will be expected to procure the replacement parts and consumables to support preventive maintenance. The amount of these materials needed should be based on industry expertise and estimates regarding expected rate of replacement for similar rail systems.

D) Contractor is required to spend as much time as needed to inspect rail and make repairs on that rail to maintain the track to Class B standard per UFC 4-860-03. This is costed and billed as a flat fee on a monthly basis.

7 General Question N/A General

Information

Is it possible for a rail contractor to bid the track maintenance and inspection items only without a partner to bid the locomotive operations?

No. This effort is considered to be one requirement and every offeror must show their capability to perform both rail maintenance and terminal operations whether a subcontractor is used or not.

8 PWS 1.1.4.1 Rail Support Operations

a) Please explain the locomotive fueling process and the contractor’s responsibility (e.g., does “fueling as necessary” mean that the contractor operates a MOTCO locomotive fuel pad or fuel truck or is this done by MOTCO)? b) Is the contractor required to provide a fuel truck or any other fueling equipment?

a) "Fueling as necessary" means that the fuel level in the locomotive should be monitored by the engineer and, when needed, refill should be coordinated and scheduled through the COR. The offeror is responsible for managing the flow of fuel into the locomotive during the refill operation.

This would involve monitoring the level of fuel and controlling the flow of fuel into the locomotive. Depending on the equipment and/or truck configuration, this may involve direction to the supplier/operator or it may involve direct control of a nozzle at the end of a hose. b) The government will provide fuel and infrastructure/equipment for fueling. The offeror is not expected to provide a fuel truck or any fueling equipment.
