The Offeror shall provide the Contracting Officer with complete information of any previous or ongoing work that is in any way associated with this acquisition, or related acquisitions. The Offeror shall submit a mitigation plan that addresses actual or perceived conflict of interest related to the services required by this effort for Government review. The Government will conduct an independent assessment review of any submitted OCI Mitigation Plan to determine if any actual or perceived OCI exists and what further actions are necessary, if any. If the Offeror believes there is no OCI, a statement as such shall be included.

Volume II - Technical Approach (shall not exceed 20 pages).

The proposal should not simply rephrase or restate the Government’s requirements but rather shall provide convincing rationale to address how the offeror intends to meet the requirements of the PWS. Statements that the offeror understands, can, or will comply with the PWS; statements paraphrasing the PWS or parts thereof; and phrases such as “standard procedures will be employed’ or “well known techniques will be used,” etc., will be considered unacceptable.

Volume III - Past Performance. The Offeror shall provide no more than three (3) examples of Government or commercial contracts/work efforts, which they consider both recent and relevant. Recent efforts are those that are currently ongoing or were performed within the last three years of solicitation issuance date, and which demonstrate their ability to perform the rail maintenance and terminal operations support requirements as detailed in the PWS.

Relevant past performance means the references have a logical connection to the work described in the PWS in terms of magnitude and scope. A reference is defined as a single contract or task order for actual performance. The Government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of this RFP. The Government will use information submitted by the offeror and other sources, such as other Federal Government offices and commercial sources, to assess performance.

Each Offeror shall provide a Past Performance Reference Submission Sheet (Attachment 3) for each reference submitted.

Past Performance Questionnaire. Offerors shall complete Section 1 of the Past Performance Questionnaire (Attachment 4) and send to each of the Offeror’s references identified in the proposal. If more than three (3) questionnaires are received, the government will only evaluate the first three (3) that are received. Note: The Contracting Officer will not accept surveys emailed by the Offeror. Offerors should use every diligent effort to follow-up with each Office/Agency to ensure the Contracting Officer receives the past performance questionnaires no later than the offer due date/time. The responsibility to send out the Past Performance Questionnaire rests solely with the Offeror. Once the questionnaires are completed by your reference points of contact, the information therein shall be considered procurement sensitive and shall not be released to you, the Offeror. Completed Past Performance Questionnaires should be submitted via email to michael.d.heth.mil@mail.mil and nicole.a.radake.civ@mail.mil.

Volume IV – Price. The offeror shall submit proposed rates for each Contract Line Item Number (CLIN) by completing the pricing schedule (Attachment 5). Do not alter the format of Attachment 5. Efforts should be made to ensure totals are divisible by the number of months in the base year and all option periods to allow for equal monthly payments. Offers without proposed rates for each CLIN will be determined incomplete and un-awardable.

(End of Provision Addendum)

ADDENDUM TO FAR 52.212-2, EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. Past Performance Trade-Off (PPT) procedures will be utilized in accordance with FAR Part 15.101-1 in conjunction with FAR Part 12 and DoD Source Selection Procedures.

Offerors’ past performance will be evaluated on a basis approximately equal to price. To receive an award, the offeror(s) must (1) be deemed responsible in accordance with (IAW) FAR Part 9, (2) conform to all required terms and conditions, and (3) represent the best value to the Government price and other factors considered. This may result in an award to a higher rated, higher priced Offeror, where the decision is consistent with the evaluation factors and the Source Selection Authority (SSA) reasonably determines that the superior past performance of the higher priced Offeror outweighs the cost difference. However, the Government will not pay a price premium that it considers to be disproportionate to the benefits associated with the proposed margin of service superiority.

(1) Each Offeror’s proposal will be evaluated against the following criteria:

a. Business Proposal

b. Technical Capability

i. Transition Plan

ii. Technical Approach

iii. Staffing Plan

iv. Safety Plan

c. Past Performance

d. Price mailto:michael.d.heth.mil@mail.mil

(2) Relative order of importance: Business Proposal and Technical Capability Proposal subfactors are rated on an Acceptable/Unacceptable basis. Offerors' past performance will be evaluated on a basis approximately equal to cost or price considerations. Price is evaluated but is not rated.

(b) The above factors shall be evaluated in the following manner:

Factor 1 – Business Proposal. Each offeror’s Business Proposal will be evaluated to determine if it complies with all terms and conditions of the solicitation. Business proposals shall be submitted in accordance with the instructions to offerors and will be evaluated as Acceptable or Unacceptable.

General Compliance Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Factor 2 – Technical. Each offeror’s Technical Capability Proposal will be evaluated as Acceptable or Unacceptable at the subfactor level, as defined below.

Technical Capability Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

If any technical subfactor is rated as Unacceptable, the overall technical rating will be Unacceptable. If all technical subfactors are rated as Acceptable, then the overall technical rating will be Acceptable. Proposals that merely paraphrase the requirements of the Government’s PWS, or use such phrases as “will comply” or “standard techniques will be employed” will be considered unacceptable and will not be considered further. Offeror’s proposals must receive a rating of Acceptable for all of the following technical subfactors in order to be considered for award:

(1) Subfactor 1 - Transition Plan. To be rated Acceptable, the offeror must…
