1.0 Introduction to the Award Option Plan

a. The intent of this Award Option Plan is to encourage performance that exceeds a satisfactory level by rewarding such performance. The contractor must earn a Very Good or Excellent rating in accordance with Attachment 3 to earn an award option year. This Award Option Plan is the basis for evaluation of the contractor’s performance at the Baltimore Commercial Gateway. It describes the specific criteria and procedures used to assess the contractor’s performance and to determine the amount of additional award option years, if any, the contractor earns. In the context of this Award Option Plan, the term “earned” means the award option year will be made available for the CO to exercise in accordance with FAR 17.2 and the terms and conditions of the contract. Award Option determinations and the methodology for determining whether the contractor has earned any additional performance periods are unilateral determinations made solely at the discretion of the Government. This contract will contain a one-year base period, four one-year option periods, and the potential for the contractor to earn five additional one-year award option periods via the award option provisions of this plan. It is important to note that the Government is not required to exercise an award option merely because the contractor has earned it. The Government retains the unilateral right to exercise any award option period and will do so only if there is a continuing need for the services performed under this contract, sufficient funding is available, and the contractor’s performance continues to be at or above the Very Good performance level. Any contract option years will be exercised by a unilateral contract modification signed by the Contracting Officer.

2.0 Organization

The Award Option organization consists of the Award Determining Official (ADO); an Award Option Review Board (AORB) and the Performance Monitors. The ADO, AORB members, and Performance Monitors are listed in Attachment 1.

3.0 Responsibilities

a. ADO. The ADO reviews the recommendation of the AORB, considers all pertinent data, and makes the final determination as to whether an award option year has been earned. The ADO approves AORB members, approves the award option plan and any changes.

b. AORB Chairperson. The AORB Chairperson is responsible for convening the AORB, provides guidance and oversight to other AORB members, actively facilitates the AORB process, reviews action items, monitors follow-on action as necessary, and ensures the integrity of the award option process is maintained.

c. AORB. The AORB provides an objective, impartial review of the contractor’s performance. Members review the Performance Monitors’ evaluation of the contractor’s performance, consider all information from pertinent sources, and arrive at a recommendation. They may also recommend changes to the award option plan. If the contractor provides a written self-assessment of performance, they must consider this assessment when developing the award option recommendation.

d. Performance Monitors. Performance Monitors maintain written records of the contractor’s performance so that a fair and accurate evaluation is obtained. Monitors prepare interim, monthly, and end of period evaluation reports.

4.0 Award Option Process

a. Monthly Evaluation Process. Performance monitors submit monthly narrative performance reports to the Contracting Officer (CO) ten calendar days after the end of the month. In turn, within two working days, the CO will provide a letter to the contractor which includes pertinent information regarding the contractor’s overall performance.

b. End of Period Evaluation. The AORB Chairperson notifies each AORB member, performance monitor, and the contractor 15 calendar days before the end of the evaluation period. Performance monitors submit their evaluation report to the AORB Chairperson 30 calendar days after the end of the evaluation period. The contractor shall submit to the AORB Chairperson its self-assessment 30 calendar days after the end of the evaluation period. Each AORB member will consider all inputs and will make an independent recommendation. The AORB will, after careful consideration of each member’s input, finalize the board’s coordinated recommendation and associated rationale. The ADO determines the overall rating for the evaluation period within 45 calendar days after the end of each evaluation period. The ADO will inform the contractor, by letter, of the result of the evaluation and if the contractor has earned an award option year.

c. Contractor Self-Assessment. The contractor shall submit a narrative summary of accomplishments to be considered by the AORB. Within 30 calendar days after the end of each evaluation period, the contractor may submit a narrative self-assessment to the AORB Chairperson. This written self-assessment of performance throughout the evaluation period may contain information that could reasonably assist the AORB in the performance evaluation and the recommendation to the ADO. The contractor’s written self-assessment may not exceed five pages (eight pages for the first evaluation period). Pages submitted beyond this limit will not be reviewed nor considered in the Award Option evaluation process.

5.0 Cancellation/Termination of Earned Award Option Periods

a. The Government may unilaterally decide not to exercise any award option year. The Government shall not exercise any award option year that the contractor has earned, but not yet begun, if the contractor’s annual performance evaluation falls below the “Very Good” level. The award option plan will be cancelled and earned award option years in which performance has not begun will be forfeited.

b. If any option period or award option period is not exercised, any remaining award option years will not be available to the contractor.

6.0 Award Option Plan Changes. The Government may unilaterally change this plan prior to the beginning of an evaluation period. The contractor will be notified of changes to the plan by the Contracting Officer (CO), in writing, before the start of the affected evaluation period. Changes to this plan that are applicable to a current evaluation period will be incorporated via a bilateral modification. Unless the CO gives the contractor specific written notice of any changes to evaluation areas 15 calendar days prior to the start of a new evaluation period, the most recently approved evaluation criteria will be used.

PERFORMANCE EVALUATION CATEGORIES

The following categories reflect evaluation areas that the Contractor will be evaluated on during performance of this contract. Although the performance requirements listed in the PWS remain consistent in assessing Contractor performance throughout this contract, the following areas will be evaluated in determining the award option.

Contractor's performance of virtually all contract tasks is consistently noteworthy and provides numerous significant, tangible or intangible, benefits to the Government. There are very minor deficiencies with no adverse effect on overall performance. The few areas for improvement are all minor. There are no recurring problems. Services and other performance almost always significantly exceed expectations. Contractor demonstrates very high level of dedication and ability.
Very Good
Contractor's performance of most contract tasks is consistently above standard and provides significant tangible and intangible benefits to the Government. Although some areas may require improvement; these areas are minor and are more than offset by better performance in other areas. Few, if any, recurring problems have been noted, and Contractor takes satisfactory corrective action. Service exceeds an acceptable level to a significant degree. Contractor is highly dependable.
Satisfactory
Met requirements. Contractor's performance of most contract tasks is adequate. Although there are areas of good or better performance, these are more or less offset by lower-rated performance in other areas. Output contains few, if any, non-conformances. Areas of inaccurate work or unsatisfactory results are minor and do not have a significant adverse impact on mission. Deficiencies are minor with limited adverse impact and easily corrected.
Unsatisfactory
Contractor's performance of most contract tasks is inadequate and inconsistent. Quality, responsiveness, and timeliness in many areas require attention and action. Corrective actions have not been taken or are ineffective. Does not meet contract requirements. Deficiencies adversely impact on the Contractor's ability to complete tasks resulting in delays and increase government surveillance. Discrepancies are major and require extensive time and effort to correct.
