Solicitation Questions Round 4

1. 17 PAGE of Solicitation 5.A.6) Offerors shall submit Written authorization from the Port Authority 18 Page of Solicitation 5.B.(1)Stevedore Business License. Offeror proposal shall include documentary evidence of a valid and current business licensure.

We thought that written authorization from the Port Authority and Stevedore Business License is the same. Because the Port Authority issued the Stevedore Business License. Please explain this in detail if any difference between them exists.

In addition, should we submit the business license to both Contract Documentation and Part1-Technical Proposal?

ANS: The business license indicates that the offeror is a valid stevedore contractor. The letter from the Port Authority only authorizes the offeror to operate at the Port. As such the two documents are not necessarily interchangeable, although it is conceded that the Port Authority would not normally authorize a contractor to operate at the port if they did not have a valid license as a stevedore contractor. You should submit the business license with your Technical Proposal.

2. Price Proposal - In the pricing schedule, M/T was used as Unit of Measurement. Generally, R/T(Revenue Ton) is used in stevedoring work as measurement. In previous biding, R/T was used as well. It would be much better if you change the unit measurement to R/T.

ANS: The unit of measure will remain MT.

3. Commodity Quantity - The stevedoring rate applied to each items is different. But new contractors are not informed of the quantity of each commodity posted on the table except for the present contractor. And the consolidated unit price should be offered for overall item. The estimation of consolidated unit price should be calculate based on quantity information of each items. Otherwise it can cause arguments between government and contractor after contract. It is too difficult to offer the unit price without quantity information of each commodities.

ANS: In establishing the format for the schedule of rates (SOR) we used the previous year’s cargo totals in measurement tons, not “each.” As such it is our best estimate of what we anticipate in the future;

however, we cannot guarantees those figures because of the IDIQ nature of the contract. Without regard to what the specific commodity is the contractor gets paid for every ton handled.

4. Premium Rate - In the pricing schedule, Do we put the 150% & 200% rate of basic extra labor in the Premium extra labor?

When the premium rate is applied ?

In previous bid, 150% is subjected to pay for any work done on weekends of holidays, and 200% is for any work done in adverse conditions, and premium case was applied with all CLIN. We can't find the explanation about premium pay in PWS.

ANS: There are no specific provisions for premium rates. However, the premium rates are factored into the overall rates. On the basis of work done during FY16, we had the following estimated results:

a. 85% of all work was done on normal duty days during normal duty hours.

b. 10% of all work was done on weekends, holidays and/or after normal duty hours.

c. 5% of all work involved 200% commodities.

We will not “stack” rates. We expect offerors after doing their calculations based on the previous year’s experience to provide a rate for all work done for each of 8 separate functions to incorporate whenever and whatever cargo is handled. As such we expect that the rate for what would have been normal duty hours/days will be more than if separately calculated for just normal duty hours/days and this will cover what would have been charged for at 150% and 200% rates, but without “stacking.”

5. Detention/standby, Minimum Time - Do you apply detention rate separately (Additional to basic rate)? Or basic rate is not applied when detention rate is applied?

Regarding minimum time, is less than 8 hours considered equal to 8 hours?

ANS: The detention rate should be the rate at which the contractor pays his employees and a pro-rated portion of any equipment costs he may have for equipment rentals for detention/standby time.

Minimum time is 8 hours, for all work done between 1 and 8 hours day/shift.

6. Contractor Furnished Materials - In 21Page of PWS, we are confused about out-of-pocket (OOP) expenses. Should Contractor purchase materials using OOP on behalf of Government for all material used in this contract? Or should we purchase all material (wire, cables, etc) at our own expense? In PWS, "at a minimum" was stated but not clear to understand.

ANS: Contractor will purchase supplies, materials and services used in support of each operation as an out-of-pocket expense for which he will be reimbursed for actual costs incurred as agreed upon with the

COR in advance and for which receipts are provided documenting the actual expenses. The listing of specific materials is not all-inclusive as there may be other things that could apply. The only restriction is that KO approval is required for purchases above $3,500.

Question: If equipment is included in the commodity rates, detention/standby & mintime rates for equipment should be established at SOR Rev-1. Can you add these equipment rates to SOR? Rates for cargo checker are also missing from detention/standby & mintime rates. Can you add these rates as well?

Answer: Any rates not in the SOR should be included in the commodity rates. The daily rate for equipment will be used for detention/standby & minimum time rates.

8. Reference: Pre-proposal Teleconference

Question: Some important issues and concerns we discussed during the Pre-proposal

Teleconference held on 20 Jan 2017 were not posted at https://www.fbo.gov/. Are you not going to post them?

Answer: All potential offerors were told to submit their questions in writing following the teleconference. Questions submitted in writing as requested were answered and posted to the FBO website.
