Responses to Industry on Draft RFP 18 March 2020
1) Conflict of Interest If a potential offeror identifies an actual or potential conflict of interest under L.2.13, they are encouraged to engage with the Contracting Offeror immediately to discuss proposed avoidance and/or mitigation strategies for the conflict. An offeror is not precluded from an award if conflicts are properly addressed.
2) Retail Network Composition Government does not dictate the composition of the retail network and the pharmacy reimbursement rates. Offerors are welcome to employ whatever approach they prefer in managing their networks as long as it meets the minimum network access standards and the all network pharmacies at a minimum meet state and federal regulations. The Contractor is also accountable for managing the cost of drugs dispensed in the network under the retail network guarantee included in their proposals.
3) Specialty Network and Replenishment:
Offerors shall maximize the extent to which specialty drugs are replenished. The Offeror shall designate specialty pharmacy(ies) within their network that can receive replenishment.
Replenishment will be owed only for; 1) medications dispensed to TRICARE eligible beneficiaries; 2) medications available for replenishment; 3) medications which are not acquired through the MPPP. These designated pharmacy(ies) will have access to the NPV’s ordering platform to order replenishment and will request replenishment per C.5.8. The replenishing pharmacy(ies) will utilize their own process for validating replenishment received for accuracy and completeness and will account for replenishment still yet to be received.
Not all specialty drugs will be replenished due to limited distribution channels or other factors which may prevent access through the NPV. For non-replenished medications, the costs will be reimbursed and the Contractor’s cost control measures will be incentivized per the specialty network guarantee included in their proposal.
4) Approach to Q&A for the RFP
Once the RFP is posted the Government will accept questions via email. All responses provided by the Government will be posted on beta.SAM.gov for all potential offerors to review. There will be a deadline for a receipt of questions; any questions received after the deadline may not be answered. The Government will attempt to make these responses timely although a specific response time is not known. Any identifying information will be redacted in the posted responses.
5) Approach to Requirements and Expectations from Offerors The approach taken in this RFP is unique in that it contains prescriptive elements typically found in a Statement of Work, performance-based requirements typically found in a Performance Work
Statement, and high level Statements of Objectives. The intent with combining these requirements is to maximize the ability of offerors to apply industry standard practices, the offeror’s proprietary solutions, or other innovative approaches to meet the requirements.
Expectations for offerors are described below.
Statement of Work Requirements: The Government states precisely the services needed to support unique operational needs, specific approaches, tools and processes. Offerors must propose solutions that align with the Government-determined parameters and take responsibility for the requirements.
Performance-Based Requirements: The Government’s outcome-based work statement for performance-based acquisition describes the required results in clear, specific, and objective terms with measureable outcomes. The offeror’s approach is expected to meet the outcomes provided by the Government.
Statements of Objectives: For the identified statements of objectives, the Government is providing overall performance objectives and leaving the requirements to be defined by offerors. Where indicated, offerors must provide a statement of work that includes reporting methods and performance standards that will meet the objectives provided.
This approach allows offerors maximum flexibility to offer unique and innovative solutions and propose metrics best aligned with their approaches.
