CAT/BPSS RFP AMENDMENT 0003

May 20, 2011 The purpose of this amendment is to implement the following changes:

(1) Delete the table in RFP Section B.4.3 “RMA Disincentives (Applicable to CLIN 0011)” in its entirety and replace with the following:

The following information shows the amount (in percentage terms) of the adjustment of CLIN 0011 if the contractor is not able to meet the threshold.

(2) Delete the contents of Section C3.12.1 in its entirety and notate as RESERVED.

(3) Delete the following sentence from Section C.3.12.3: “If dismantling of existing airline or airport facilities or equipment or other measures is necessary to complete the installation, the Contractor shall be responsible for the full restoration to pre-installation conditions of these unrelated facilities or equipment.”

(4) Delete the title of Section C.4.3.2 in its entirety and replace with “Preventative Maintenance (CLIN 0011).”

(5) Delete Section C.4.3.2, numbered sub-paragraph 2 in its entirety and replace with the following:

2. Level II PM - This is primarily PM that is performed every month, quarter, or year. PM activities shall be performed by trained Contractor personnel. Level II PM will include verification of the performance of Level I PM by TSA personnel. This verification will be accomplished by TSA reviewing airport logs for the SE and through physical observation. TSA will ensure that weekly logs are available to the Contractor for review during Level II PM.

(6) Delete the following clause from Section E.1: “52.246-11 – Higher-Level Contract Quality Requirements (FEB 1999).”

(7) Delete Section F.2.1 “Contract Period of Performance” in its entirety and replace with the following:

“F.2.1 Contract Period of Performance

The contract Period of Performance (POP) shall be three (3) years and shall begin upon contract award. This is the period in which delivery orders can be placed under the contract”

(8) Delete the last paragraph in Section F.2.2 in its entirety and replace with the following:

“Services for sub-CLINs 0002A and B include all support listed in Section C and the recurring CDRL submissions in Section F.4 for two (2) years after award of a given DO. CDRL submissions shall address contract level data unless otherwise specified in a given DO.”

(9) Add the following sentence to Section F.2.2: “Services for CLINs 0010 and 0011 extend for two (2) years after acceptance of a given CAT/BPSS system.”

(10) Delete CDRL “D002” and DIDs “DI-D-002” and “DI-L-011” from the table at Section F.4.

(11) Replace RFP Section I.1 list of FAR Clauses incorporated by reference in its entirety with the following:

(12) Delete Section I.2, Clause 52.216-22 – Indefinite Quantity (Oct 1995), subparagraph (d) in its entirety and replace with the following:

“(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 12 months after the end of the contract ordering period; however, the services under sub-CLINs 0002A and 0002B and CLINs 0010 and 0011 are dependent upon delivery and/or acceptance of systems and shall remain in effect as set out in Section C and/or Section F.”

(13) Delete Attachment J.2 “Procurement Specification” in its entirety and replace with the attached.

(14) Delete Attachment J.5 “CDRLs and DIDs” in its entirety and replace with the attached.

(15) Delete Attachment J.8 “Bailment Agreement” in its entirety and replace with the attached.

(16) In Section L.4.2, the due date for Submission 1 is changed from 26 May 2011 to 02 June 2011, and the due date for Submissions 2 and 3 is changed from 06 June 2011 to 13 June 2011.

(17) Delete the following sentence from Section L.5.3.1: “Offeror shall support the configuration audit described in L.5.2, number 3,” and replace with “Offeror shall support the configuration audit described in L.5.1, sub-paragraph (3).”

(18) Delete Section L.5.2.5 bullet #2 in its entirety and replace with the following:

“2. Part B: Labor Rates Applicable to CLINs 0006 and 0007

The offeror shall propose fully loaded hourly labor rates on all Government-provided labor categories listed by inputting the proposed labor rate corresponding to each labor category for each year of the contract, years 1-4.”
