C.1 ADMINISTRATIVE INFORMATION

a. The purpose of this subsection is to provide general information, facility descriptions, mission statements, and definitions related to this specification and the Federal Law Enforcement Training Centers (FLETC), Artesia, New Mexico.

b. Except for Government-Furnished Property (GFP), the Contractor shall furnish all personnel, supervision, management, equipment, materials, transportation and supplies required to plan, schedule, coordinate and assure effective performance of all required services necessary to provide operational and student support services for the FLETC, Artesia, New Mexico.

c. Unless otherwise stated in this description/specification/work statement, the normal work hours at the FLETC shall be 0700 to 1700 (Monday – Friday).

d. The Contractor shall provide an on-site qualified contract manager (“Project Manager”) during the hours of 0700 to 1700 Monday through Friday, excluding Federal holidays, who will also be on-call 24 hours a day seven days a week, to administer all services described in the following specifications, receive any complaints concerning the contract requirements, and rectify the causes of the complaints.

C.1.1 FACILITY DESCRIPTIONS AND MISSION

C.1.1.1 Location

The FLETC is located at the corner of 13th Street and West Richey Avenue at approximately the northwest corner of the City of Artesia, New Mexico. The city is located at the intersection of U.S.

Highways 285 and 82.

C.1.1.2 Description

a. The FLETC encompasses approximately 2620 acres of Government real property, including firing ranges. The Center has limited access with a controlled gate. The Contractor may experience a delay in entering the Center due to vehicle inspection, registrations, failure to present proper identification, non-use of seat belts, etc. No price adjustments will be made for any delays resulting from gate controls.

b. A representative listings of existing buildings, structures, and facilities is in Section J Atch 27.

C.1.1.3 Mission

The FLETC or "the Center" is host to approximately 88 participating agencies/bureaus and responsible for providing certain core instructional law enforcement programs as well as a variety of support services. The FLETC has on-campus housing for approximately 1800 students and occasionally houses additional students off-campus in local motel facilities. The Center and participating agencies have a staff of approximately 500.

C.1.2 PROJECTED WORKLOAD

a. The projected workload for this contract is delineated either in the form of historical data (see Section J Atch 23) or an estimated number of occurrences in each paragraph.

b. Monthly, the Government will provide the Contractor with a class schedule via the Student Administration and Scheduling System (SASS) which the Contractor shall use in projecting his/her requirements under this contract. The Contractor is responsible for supporting any Government changes to the class schedule. The Government will attempt to provide the Contractor five (5) days advance notice of any changes to the class schedule; however, changes at times are made up until the last minute and the Contractor will be responsible for those changes.

c. Work required to support new or changed facilities, not included in Section B, will be added as needed, by contract modification in accordance with the FAR 52.243-1 Changes-Fixed Price Clause in Section I.

C.1.3 ABBREVIATIONS, ACRONYMS AND DEFINITIONS

Abbreviations, Acronyms and Definitions used throughout this document are defined in the Abbreviations, Acronyms and Definitions attachment in Section J – Atch. 30

C.1.4 REFERENCES AND TECHNICAL DOCUMENTS

The Government will furnish all required forms and publications in Section J; publications include

FLETC Traffic Regulations, Lock & Key Management Program, and Environmental and Safety Requirements.

C.1.5 GOVERNMENT FURNISHED FACILITIES

C.1.5.1 Office Space & Parking

The Government will provide, without cost, approximately 1600 square feet of Center space for Project Management (location to be determined). The Contractor shall provide any additional facilities required. Land, facilities and utilities provided by the Government shall be used only for performance of work related to this contract. The Contractor shall not construct any new building facilities or structures on Government property nor make any structural changes or alterations on the provided buildings without the express written approval of the Contracting Officer. Structural repairs required during the term of the contract shall be reported to the COR for appropriate action. The Contractor shall reimburse the

Government for repairs not attributable to fair wear and tear. Parking on the FLETC is extremely limited, with Government staff and students having priority, the Government will designate areas for Contractor staff parking after award – lack of sufficient parking space does not relieve the Contractor from being fully staffed and available for the support required.

C.1.5.2 Storage

The Government will furnish the Contractor available space for the storage of an inventory of bulk supplies, replacement parts, and the equipment, which is to be used in the performance of work under this contract. The Government will determine what space is available. Cited storage facilities shall be used exclusively for the purpose of this contract only. The Contractor shall maintain this space in a neat and orderly condition. The Government will not be responsible for damage or loss to the Contractor's stored supplies, materials, replacement parts, or equipment. This storage space may not be adequate to meet the requirements of this contract.

C.1.6 GOVERNMENT FURNISHED PROPERTY (GFP)

a. The Government will provide, without cost, the facilities, equipment and materials listed in Section J Atch 2. The listing of GFP shall not be construed as being sufficient or adequate to meet the requirements of this contract.

b. At the beginning of the contract, the Contractor shall acknowledge in writing to the Inventory Management Specialist an inventory and receipt of all Government-furnished accountable property and non accountable property; a copy of the acknowledgment shall be furnished to the COR. There are currently six (6) separate property lists associated with the Student Support Services. The Contractor shall inventory such equipment as firearms and radios a minimum of every thirty days (however, see the Firearms requirements in Section C.3.5) and all others on an annual basis. The Contractor shall assist in identifying excess, obsolete, or worn-out GFP by promptly initiating a form FTC-ADM-44 "Survey Report" (Sample in Section J Atch 5) and submitting it to the COR. The Contractor shall notify the COR and Property Administrator for verification and removal of excess/surveyed property.

Note: During the Phase-in and Phase-out period(s) joint inventories will be conducted by the incoming and outgoing contractor with Government representatives present.

c. GFP shall be managed in accordance with the guidelines set forth in the GFP clauses of this contract. The Contractor shall provide an updated quarterly listing for office supplies to the COR. The Contractor listing shall include:

(1) FLETC Bar Code and Nomenclature

(2) Value

d. Upon completion of this contract the Contractor shall submit, in a form acceptable to the Contracting Officer, inventory schedules covering all items of Government property not consumed in the performance of this contract.

e. The Contractor shall furnish all consumable supplies except for those specifically identified in the contract as Government furnished. The Contractor shall order consumable supplies and equipment specified as Government supplied using normal procurement ordering procedures and forms. Contractor Purchase Requisitions must be approved by the COR and CO.

f. Any Government property going off the FLETC (for example, vehicles to be repaired) requires a temporary hand receipt. The Contractor shall prepare FTC-ADM-80 "FLETC Inventory Control Form" (Sample in Section J Atch 8), when required and provide a copy to the COR.

C.1.7 CONTRACTOR FURNISHED PROPERTY

The Contractor shall provide all collateral office furniture and equipment such as desks, file cabinets, calculators, computers, typewriters, copy machines, consumable and general office supplies. The Contractor shall be responsible for providing all facilities, equipment and materials, not provided as GFP, as necessary to fulfill the requirements of the contract.

C.1.8 CONTRACTOR PERSONNEL REQUIREMENTS

NOTE: Portions of work under this contract may be performed at other than journeyman level;

therefore, the Contractor shall structure his workforce to the level of work stated within these specifica-tions.

C.1.8.1 Project Management

The Contractor shall submit a resume in the format shown in Section J Atch 12 for project management personnel and any proposed replacements. These personnel shall be subject to the Contracting Officer's approval. The Project Manager and Assistant Project Manager must meet the minimum requirements as follows:

1. Project Manager

a. The on-site Project Manager (PM) shall have previously had experience as a PM on Federal Contracts.

b. Demonstrated experience and a working knowledge typical of work under this contract (for example: Firearms, Vehicle Maintenance, Scheduling, Transportation, Inventory, etc…).

2. Alternate Project Manager

a. The on-site Alternate Project Manager (APM) shall have previously had experience as an

APM on Federal Contracts.

b. Demonstrated experience and a working knowledge typical of work under this contract

(for example: Firearms, Vehicle Maintenance, Scheduling, Transportation, Inventory, etc…).

a. The Project Manager and Alternate(s) shall have the authority to speak for and act for the

Contractor in all matters related to providing services under this contract. This delegation of authority includes, but is not limited to all matters concerning the day-to-day effective operation of Student Support services such as personnel supervision, training, purchasing, and cost controls.

b. A designation letter shall be included with the resume(s) and cite any limitations to the Project Manager's/Alternate Project Manager's ability to bind the Contractor to changes or adjustments. The letter shall cite specific dollar levels PM and APM may bind the contractor to.

c. The Project Manager shall be on-call and available at all times when not on duty. The Contractor shall provide the Contracting Officer, in writing, the name(s) of the designated on-site Project Manager and Alternate Project Manager(s) who shall act for the Contractor when the Project Manager is absent, the telephone number(s) where contact may be made at all times and the assigned normal area of responsibility.

NOTE: Either the Project Manager or Alternate Project Manager(s) shall be on site at the FLETC during all times when work is being performed. During normal duty hours, the Project Manager or Alternate(s) shall be available within thirty (30) minutes notice to meet on the Center with Government personnel designated by the Contracting Officer to discuss contractual issues. After normal duty hours, the Project Manager or designated Alternate shall be available on-Center within two (2) hours.

f. The Project Manager and Alternate(s) shall be able to read, write, speak, and understand English and shall be capable and experienced in the type of work they are assigned under this contract, be physically able to perform their assigned work and shall be free of communicable disease(s).

C.1.8.2 Transportation and Vehicles (paragraphs C.3.2 and C.3.3)

a. Driver Training Range master must possess the following minimum requirements:

(1) Two years of experience in automobile repairs.

(2) Ability to prepare clear, concise work orders, explaining required vehicle repairs.

(3) Ability to perform operator maintenance and conduct safety inspections of training vehicles to include fluid replacement, tire changes, windshield wipers, etc. and assist the auto shop as necessary in getting vehicles on-line for training.

(4) Ability to test drive training vehicles and evaluate repairs made to the vehicles to insure repairs are proper and complete.

(5) Possess a valid operator’s license in the State of New Mexico

(6) Capable of operating the following vehicles and equipment: (Current certification to be on file at the Contractor’s office):

(a) Forklift with a 6-ton capacity

(b) Tow truck properly and safely with a vehicle in tow

(c) All-terrain vehicle

(7) Ability to complete government provided training and perform Hazardous Waste Satellite Accumulation Area and Universal Hazardous Waste management responsibilities in accordance with the FLETC-OAO Hazardous Waste Management Plan provided in Section J – Attachment 71.

b. A detailed resume containing the same information specified for supervisory employees must be submitted for each Range master to the Contracting Officer or his designee for approval prior to the assignment of that Range master to the contract. (see section J- Atch 12).

Note: The range masters must have training and certification in accordance with the Code of Federal Regulations (40CFR262.34(d), 40 CFR273.16, 49CFR172.700 & 704, and 29CFR1910.120) located at www.gpo.gov/fdsys/browse/collectioncfr.

C.1.8.3 Firearms Range (paragraph C.3.5)

a. Firearms Range Master/Certified Armorer must possess the following minimum requirements:

(1) At least two years’ experience in weapons maintenance and gun repair for semi-automatic handguns, rifles, shotguns and specialized weapons systems.

(2) Experience in range operations (military or police).

(3) Graduate of a recognized agency Gun Smith/Armorer or Range master school for law enforcement, i.e., National Rifle Association, military service school, federal service school, etc.

(4) Ability to complete government provided training and perform Hazardous Waste Satellite Accumulation Area and Universal Hazardous Waste management responsibilities in accordance with the FLETC-OAO Hazardous Waste Management Plan provided in Section J – Attachment 71.

b. A detailed resume containing the same information specified for supervisory employees must be submitted for each Range master to the Contracting Officer or his designee for approval prior to the assignment of that Range master to the contract.

Note 1: The range masters must have training and certification in accordance with the Code of Federal Regulations (see the Note under C.1.8.2 above).

C.1.8.4 Equipment/Uniform Issue (paragraph C.3.6)

The individual in this position must be sensitive to the accountable nature of the job and ensure that accurate, reliable and current records are maintained. The individual must be well organized and have held a position of similar responsibilities in the past five years. The individual in this position must also have the ability to complete government provided training and perform Universal Hazardous management responsibilities in accordance with the FLETC-OAO Hazardous Waste Management Plan provided in Section J – Attachment 71.

C.1.8.5 Recreation Specialist (paragraph C.3.7)

Prior to assignment to the contract, the Contractor shall submit a resume in the format shown in Section J-Atch 12 for individual (s) meeting the following minimum requirements:

(1) Two (2) years of experience in Physical Education/Recreation, or a related field.

(2) Red Cross certified in first aid and CPR (both must remain current).

(3) Knowledge of rules and regulations covering a variety of recreational sports, to include basketball, volleyball, softball, etc.

(4) Experience at conducting recreational activities, such as, softball, volleyball, basketball tournaments, run/walk events, and other activities as requested.

C.1.8.6 Audio Visual (AV)(paragraph C.3.8.2)

Employee(s) must have an understanding and five years experience in the operation and maintenance of AV equipment and related supplies (to include, but not limited to: speakers, microphones, cameras, DVD players, monitors, projectors, amplifiers, screens, etc.). Additionally, employee(s) must have experience in the installation of sound systems, AV equipment, cabling and operation of Microsoft Office products (Word, Excel, and Powerpoint). The individual in this position shall also have the ability to complete government provided training and perform Hazardous Waste Satellite Accumulation Area management responsibilities in accordance with FLETC-OAO Hazardous Waste Management Plan provided in Section J – Attachment 71.

C.1.8.7 Educational Aides (paragraph C.3.9)

Educational aides shall have the following minimum qualifications:

(1) High school diploma or equivalent certification.

(2) Ability to type 40 words per minute with 95% accuracy.

(3) Ability to operate a computer terminal, photo copier and other office equipment.

(4) Able to lift up to 40 pounds.

(5) Able to read, write and speak fluent English.

C.1.8.8 Role Player(s) (paragraph C.3.10)

Role Players must ‘live’ the part and freely adapt the character in response to how the student reacts to a situation. It is impromptu acting ‘in role’ as the training situations develop. Be aware, due to the nature of the training on the FLETC all Role Players shall be subject to background investigations.

Role Players may be assigned compliant or non-compliant roles, may need to pass a Spanish language ordinate exam and some scenarios are gender specific

C.1.8.9 Quality Control Technician (QCT)

a. Prior to assignment to the contract, the Contractor shall submit a resume in the format shown in Section J-Atch 12 for a Quality Control Technician and any proposed replacements. These personnel shall be subject to the Contracting Officer's approval. The Quality Control Technician (QCT) shall have previously had a minimum of two (2) years QC/lead technician experience utilizing formal QC systems/processes in industry and/or business related to functions to be performed under this requirement (For example: Firearms, Vehicle Maintenance, Scheduling, Inventory, Transportation, etc…). (Note that the QCT may perform other duties under the contract, e.g. safety officer and Environmental Coordinator provided that quality control is maintained).

b. The QCT shall be able to read, write, speak, and understand English and shall be capable and experienced in the type of work as assigned under this contract, be physically able to perform their assigned work and shall be free of communicable disease(s). A monthly QC report shall be due the 5th working day of each month and given to the COR. Report should show all areas inspected, findings, the solution and/or recommended solution to correct the problem, and the date problem was corrected or the status.

C.1.9 TYPES OF SPECIFICATIONS

C.1.9.1 Performance

Performance specifications describe the service to be performed as an end result and provides to the Contractor quantities, limits, or areas that the service covers. The Contractor shall be responsible for achieving the results described in the specification. Furthermore, as this is performance specification, and the Government will measure the end result and not effort or level of effort, there is no required answer or preferred approach as to manning levels and offerors are free to propose manning levels as they see fit to take advantage of efficiencies, and different approaches.

C.1.10 PHASE-IN (CLIN 0001)

A phase-in period is required in order for the Contractor to become familiar with the required work and services and participate in the inventory of Government Furnished Property. The Government requires a four week phase-in period.

C.2 PROJECT MANAGEMENT

This section specifies the plans required to be submitted, the types of support requirements, miscellaneous information and security of rooms and spaces.

C.2.1 REQUIRED PLANS

Plans called out below are to be submitted as specified in the individual subparagraphs.

C.2.1.1 SERVICE PLAN

A Service Plan is a detailed description of the Contractor's intended plan for accomplishing work and is used to ensure that the Contractor has developed sufficiently responsive and cost effective procedures to deliver adequate service(s). A Service Plan also serves as a basic information and reference document describing the methods, procedures, and controls that the Contractor intends to use in providing the required services. The Contractor shall submit a Service Plan at the time of proposal for Contracting Officer approval and within 30 days after the exercise of the option to renew and whenever the methods, procedures, or controls used are changed by the Contractor. The Contractor shall comply with the approved Service Plan unless a new Service Plan is submitted and approved by the CO. In any circumstance in which the contract specifications conflict with the Service Plan, the contract specifications shall take precedence (contractor format of the Service Plan is acceptable).

C.2.1.2 QUALITY CONTROL (QC) PLAN

a. In accordance with the "FAR 52.246-4 INSPECTION OF SERVICES-FIXED-PRICE" Clause, the Contractor shall establish and maintain a complete Quality Control Program (QCP) that is acceptable to the Contracting Officer, to assure the requirements of the contract are provided as specified.

b. The QCP (also, see Section L.9 for QC Plan requirements) is to be submitted with the Technical Proposal for review. Also, no later than five (5) days after Notice of Award, two (2) copies of the complete QCP shall be provided to the Contacting Officer for final review and approval. An updated QCP shall be provided to the Contracting Officer no later than 15 days after start of option years, and again as changes to the program are requested, reviewed and approved.

c. The program shall include, as a minimum:

(1) A quality control inspection system covering all services included in the contract. It must specify areas to be inspected on either a scheduled or unscheduled basis or how inspections are to be conducted.

(2) The name(s) of the individual(s) tasked to perform the quality control inspections, their qualifications, and the extent of their authority.

(3) A method for identifying deficiencies in the quality of services performed and for taking corrective action before the level of performance becomes unsatisfactory.

(4) A customer complaint feedback system, for correction of validated complaints and to inform the customer of corrections. At a minimum, the Customer Complaint System shall contain procedures for the customer to file complaints with the Contractor, forms to be utilized by the customers, procedures for investigation of the complaint and feedback to the customer and the Government on the results and actions taken on the complaint.

(5) Procedures for written and verbal communication with the Government regarding the performance of the contract.

(6) Specific surveillance techniques for each contract service identified in the Performance Requirements Summary (PRS) (See PRS - Section E Technical Exhibit).

d. The Contractor file of all Quality Control Inspections, inspection results, and any corrective action shall be the property of the Government. The file shall be turned over to the Contracting Officer within ten (10) calendar days after completion or termination of the contract.

e. The parties to this contract agree that the Contractor, as a result of the contractual obligation to supervise the personnel furnished and oversee the quality of their performance, shall be conclusively presumed to have actual knowledge of work not performed, and that therefore a written notice shall not be a prerequisite for reducing payment or assessing liquidated damages for non-performed service(s).

C.2.1.3 DISASTER PREPAREDNESS PLAN

NOTE: The Government must plan, in advance, how it will meet mission requirements in the event of mobilization, natural disaster, or labor disputes. The Government must be able to react to such events without undue delay. Sudden or unusual events could result in a great impact upon Contractor performance and contract requirements.

a. In the event of warnings of impending disaster situations such as severe weather, terrorism, acts of war, severe fire, etc., the Contractor may be required to provide additional services to protect Government property and personnel.

b. No later than five (5) calendar days after award notification, or as otherwise directed by the Contracting Officer, the Contractor shall submit a Disaster Preparedness Plan to the Contracting Officer.

This plan shall outline the Contractor’s procedures for meeting contract requirements under the following circumstances:

(1) Natural disasters such as severe weather, major incapacitating storms, floods, and earthquakes.

(2) Labor disputes and strikes.

(3) Mobilization or sudden buildup of students and Government personnel.

(4) Pandemics (i.e. “swine” or “bird” flu, etc.)

(5) Shutdown of the FLETC for any reason.

c. The Contractor’s Disaster Preparedness Plan shall include procedures for maintaining

Contractor personnel on site to continue essential services up until any necessary evacuation takes place and for returning necessary personnel to the work site on a prompt basis for any services required to return the Center to operational status. The minimum elements of the contingency plan shall consist of:

(1) Minimum staffing requirements.

(2) Designated staff positions for remaining on-site until evacuation.

(3) Replacement or supplemental staff to meet emergency requirements.

(4) Safeguarding Contractor personnel who remain until evacuation time.

(5) Maintaining supply lines, or obtaining emergency supplies.

(6) Continuing essential services in the event of equipment damage or disruption of utilities and/or water supply.

(7) Maintaining a list of evacuation destinations.

(8) Contact information for recall of all essential personnel for post disaster services.

(9) Procedures for rescheduling postponed services.

d. The Contractor shall initiate these emergency services based on a verbal Notice to Proceed (to be followed in writing within 72 hours) from the Contracting Officer. The Government will equitably compensate the Contractor for such services rendered under this contract. The Government reserves the right to take over or supplement performance of these services. The Contractor agrees, under such circumstances, to permit the Government to use any essential Contractor-furnished property. The Government will equitably compensate the Contractor for use of such property.

C.2.1.4 KEY CONTROL PLAN

a. Keys to include keyless entry cards or other similar control devices will be issued to the Contractor as appropriate. The Contractor shall receive, service and account for all keys issued for use in the performance of this contract. The Contractor shall develop a system of key control and submit the written plan for the CO’s approval five (5) days prior to contract start. This plan shall become a part of the quality control plan. The Contractor’s plan shall ensure that all keys and lock combinations issued to the Contractor by the Government are not lost, misplaced, or used by unauthorized persons.

b. Neither the Contractor, nor any Contractor personnel, shall duplicate or fabricate any Government key in its custody. Should replacement be required, the Contractor shall submit a WRITTEN REQUEST to the COR. The Contractor shall report loss or unauthorized duplication of Government issued keys to the CO or his/her designated representative within 48 hours of learning of the loss or duplication by Contractor and subcontractor personnel.

c. The Contractor shall control access to all Government provided lock combinations to preclude unauthorized entry. The Contractor shall immediately notify the COR when lock combinations have been compromised.

d. Should the security of a facility become compromised by the loss of a key by Contractor personnel, the Contractor shall be responsible for replacement cost for rekeying of locks or lock replacements as determined appropriate by the CO. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced and replacement cost borne by the Contractor.

e. Contractor employees shall not allow anyone the use of any Government key in their possession. They shall not open locked rooms or areas to permit entrance by persons other than Contractor personnel performing assigned duties. Any room unlocked by Contractor at the start of work shall not be left unattended during the service process and shall be re-locked by Contractor personnel after completion of their service duties. (Also noted in Section H.19)

C.2.1.5 PROPERTY CONTROL PLAN

a. Upon commencement of work, the Contractor shall implement a Property Control Plan for the management of all GFP and GFE in their possession under this contract. Within fifteen (15) days from date of award, two copies of the property control plan shall be submitted, in writing, the Contracting Officer for approval. The requirement for a property control plan shall be included in all subcontracts. The Contractor shall provide updated/revised copies to the Contracting Officer five (5) work days prior to any planned change (subject to Government acceptance).

b. The Contractor’s property control plan shall:

(1) address overall GFP and GFE management and administration

(2) contain methods of verbal and written communication with the Contractor’s representative and the Government

(3) contain specific security and surveillance techniques/procedures for the accounting, utilization, protection, storage and disposal of GFP and GFE

(4) contain detailed security violation reporting procedures

(5) designate direct accountability to the Contractor’s top management

C.2.1.6 DRUG FREE WORKPLACE PLAN

Within fifteen (15) days prior to contract start date, or as otherwise directed by the CO, the Contractor shall submit a Drug Free Workplace Plan to the CO for approval. This plan details the Contractor’s plan for identifying drug abusers and eliminating drug users for positions that involve health, safety, and security. The Government will not pay for the testing of Contractor employees for controlled substances.

C.2.1.7 ENVIRONMENTAL PROTECTION PLAN

The Contractor shall establish and implement an Environmental Protection Plan (EPP) for the execution of this contract. All environmental protection matters shall be coordinated with the COR/CO and the Master Plan Construction Branch (MCB), Environmental Specialist. The EPP shall comply with FLETC plans, policies, or procedures pertaining to: Environmental Protection and Enhancement; Natural Resources: Land, Forest and Wildlife Management; Cultural Resources Management; Pest Management;

and with all Federal, State, and local laws, regulations, and Office of Artesia Operations (OAO) plans regarding pollution control, clean air, clean water, toxic substances control, resource conservation and recovery, and other environmental matters. The EPP shall provide for minimization of the discharge of pollutants and all other influences on environmental quality. The EPP shall address hazardous and non-hazardous waste, universal hazardous waste, municipal solid waste, and recyclable material management, handling, neutralization, and disposal. The Contractor shall prepare a comprehensive EPP describing policies and procedures and submit it to the CO fifteen (15) days prior to contract start date for approval, or as otherwise directed by the CO. Changes to the EPP shall be submitted to the CO ten (10) days prior to implementation of the change for approval.

C.2.1.8 SAFETY PLAN

The Contractor shall develop and submit a Safety Plan at least fifteen (15) working days prior to contract start date for approval, or as otherwise directed by the CO, delineating processes and procedures the Contractor shall use to prevent accidents and preserve the life and health of Contractor and Government personnel and that protect work and Government property. The Contractor shall implement and maintain a Safety Program based on the Safety Plan at contract start date. The Contractor Safety Program shall fully comply with the provisions of Federal, State, and local regulations and FLETC’s directives. In cases where standards conflict, the stricter provision shall apply. The Contractor shall update the plan as changes occur and shall submit a copy of the proposed plan to the CO ten (10) days prior to the proposed effective date of the updated plan for approval.

C.2.1.9 FIRE PREVENTION AND PROTECTION PLAN

The Contractor shall establish and maintain a comprehensive Fire Prevention and Protection Plan IAW 29 CFR 1910.39. The plan shall complement the FLETC’s Fire Protection Program. The Contractor shall implement the plan in each Government-furnished and Contractor-operated facility. The final plan shall be submitted to the CO for approval fifteen (15) days prior to contract start date, or as otherwise directed by the CO. The Contractor Fire Prevention and Protection Plan shall be implemented on the contract start date. The Contractor shall update the plan as changes occur and shall submit a copy of the proposed plan to the CO for approval thirty (30) days prior to the proposed effective date of the updated plan.

C.2.1.10 HAZARDOUS MATERIAL SPILL PLAN

The Contractor shall develop a detailed spill plan with site map for each facility that stores hazardous materials. The plan shall be submitted to the CO for approval fifteen (15) days prior to the contract start date for approval, or as otherwise directed by the CO. The Contractor shall submit updates to the CO for approval at least three (3) days prior to implementation of such updates, unless the updates are required immediately for safety or to avoid injury or damage; in such an event, the updates may be implemented immediately and furnished to the CO for review and approval.

C.2.2 SUPPORT REQUIREMENTS

C.2.2.1 Telephone Desk/Reception

The Contractor shall operate and maintain a telephone desk/work reception function during the hours of 0700 to 1700 Monday through Friday, excluding Federal holidays, to receive and process work requests in support of the requirements delineated in C.3 Student Support Services. Note that certain requirements (i.e. Firearms range master services, role player services) may require support after 1700, on Federal holidays and/or weekends – a contact/trouble line number is to be provided in order for the Government to contact the Contractor for any schedule changes and ad hoc requirements.

C.2.2.2 Schedules

The Contractor shall review Government provided training schedules for required support.

C.2.2.3 Work Control

The Contractor shall schedule all work in accordance with the training schedules or as specified in the Section C.3. Perform all work so as not to cause interference with Government work or work being performed by other Contractors. All work schedules/requests shall be available for the Government to review upon request.

C.2.2.4 Facilities Maintenance

The Contractor shall ensure that Contractor personnel are alert to and report all facilities discrepancies observed to the Facilities Maintenance contractor’s work reception desk. The Contractor’s personnel shall report damaged, clogged, or inoperable drains, light fixtures or other conditions that prevent the proper performance of their duties. Additionally, the Contractor shall notify the COR of recurring problems or failure of the Facilities Maintenance contractor to correct problems in a timely manner.

C.2.3 MISCELLANEOUS

C.2.3.1 Equipment, Tools and Cleaning Gear

a. The Contractor shall furnish everything required to perform the work prescribed within this specification, except for those items specifically stated to be Government furnished (See Section J). All items are subject to inspection for compliance with all existing safety and health standards. Contractor's equipment shall be of a size and type suitable for accomplishment of the various types of work described (for example, weapon repairs). At all times equipment shall be in operating condition as designed by the equipment manufacturer. The Contractor shall ensure that all custodial equipment, tools and cleaning gear not in actual use are stored in designated storage areas in such a manner to ensure the safety of both Government and Contractor personnel.

b. All vacuum cleaners and equipment used for vacuum pickup (wet and dry types) shall be equipped with air filter systems which will filter out all dust and bacteria particles in excess of three-tenths (.3) micron in size (i.e. used for vehicle cleaning).

c. All of the Contractor's electrically operated equipment, which is used in occupied spaces, shall be equipped with hospital quiet-type motors.

C.2.3.2 Electrical Safety

All electrical equipment shall be third-wire grounded or double insulated and equipped with 3-conductor electrical cord, which is approved and properly rated by the Underwriters Laboratory, Inc.;

permanently attached to the machine; and equipped with proper fittings to operate from corridor outlets.

Electrical equipment shall not exceed the rated capacity of the circuits from which they are operated. No Government equipment shall be unplugged from receptacles to accommodate Contractor cleaning equipment.

C.2.3.3 Cleanliness

The Contractor shall ensure that employees clean, sanitize and rinse sponges and similar tools and cleaning gear after each use. Sponges and similar tools and cleaning gear shall be replaced with new or clean items when rinsing does not restore them to a reasonable state of cleanliness. Contractor is responsible for keeping their work spaces neat and clean.

C.2.3.4 Inspection

Equipment, tools and cleaning gear used by the Contractor shall be subject to inspection by the Government. The Contracting Officer may reject use of equipment, tools and cleaning gear determined to be in non-compliance with the requirements of this specification.

C.2.3.5 Materials and Supplies

a. Unless specified otherwise in this specification, the Contractor shall furnish all materials and supplies required to perform the work prescribed in this contract.

b. Samples of all materials and supplies shall be submitted to the Government for approval prior to start of work. New, changed, or substituted materials and supplies shall be submitted and approved by the Government prior to being used. No materials or supplies shall be used which will cause damage to equipment, facilities or other items being cleaned. Materials and supplies which do not fully comply with FLETC Safety Regulations, or which are of a highly caustic or toxic nature, shall not be used or permitted in any building or areas covered by this contract. A Safety Data Sheet (SDS), for applicable products are to be submitted to the FLETC Environmental Specialist.

c. Hazardous Material Management – All Hazardous Material acquisitions, receiving, distribution, storage and accountability shall be accomplished in accordance with the FLETC-OAO Hazardous Material Management Plan provided in Section J – Attachment 71.

C.2.3.6 Trash Disposal

a. The Government will be responsible for dumpster pickup.

b. The Contractor shall properly dispose of all controlled material waste used in performance of this contract. Such material shall not be placed in Government waste containers or dumpsters.

c. All Hazardous and Universal Waste generated by the contractor shall be managed and disposed of in accordance with the FLETC-OAO Hazardous Waste Management Plan provided in Section J –

Attachment 71.

C.2.4 SECURITY

Contract employees shall not open locked rooms or areas to permit entrance by persons other than the COR, FLETC Security and other custodial employees performing assigned duties. All rooms found locked shall not be left unattended and shall be re-locked by Contractor personnel after completion of duties. Each facility shall be checked by the Contractor's supervisor subsequent to performance of assigned duties to ensure security of the facility is maintained and appropriate lights are extinguished.

C.3 STUDENT SUPPORT SERVICES

In support of the staff, students and training programs at the FLETC, the Contractor shall provide all identified support services. As programs evolve and develop and new requirements are identified they may be added for support via contract modification, if determined to be within the scope of the contract.

The Contractor needs to be aware that duplicated requirements maybe required simultaneously at multiple sites.

C.3.1 Indefinite Delivery/Indefinite Quantity Contract Line Items

CLINs 0004A-F/X003A-F and 0005A-B/X004A-B shall be performed on an indefinite quantity basis when ordered by the Government. Prices shall include all: management; supervision; safety; quality;

scheduling; reporting; administrative costs; indirect costs; and profit. CLINs 0004A-F/X003A-F are for additional unscheduled support for services falling outside the normal work hours of operation noted in Section C, such as remedial weekend training. These lines do not apply to services required under the statement of work even though work may be performed outside the normal hours of work. See Section G.8 for ordering procedures.

C.3.2 TRANSPORTATION

a. The Contractor, using Government-furnished vehicles, shall:

1. Provide local scheduled and ad hoc administrative transportation for students, staff and VIPs, along with their baggage, if applicable, when requested, from 0500 to 2400, Monday thru Sunday, this may include Federal Holidays;

2. Provide outbound student and/or staff transportation from the FLETC to local airports (the Roswell or Carlsbad, New Mexico Airports, approx. 35-40 miles one-way) based upon the Government provided class schedules (normally provided 2-3 days in advance).

Also, from the schedule, the Contractor shall meet all flights at the Roswell airport on student arrival days. In addition, provide transportation to and from these airports for drop off and pickup of students and/or staff in response to trip requests by the Government. These ad hoc trips may require same day response and can occur any day of the week, including Federal holidays.

Note: There may be a need for more than one airport trip/day. For proposal purposes, it is estimated that five days/week require local airport trips.

3. Provide transportation to El Paso, TX Monday thru Saturday (inclusive of Federal holidays designated as training days). The Government will designate the time and place for pickup and drop off (i.e. pickup in the morning in the dorm area & drop off at the El Paso airport).

4. In addition to the Monday through Saturday El Paso airport trips there may be occasional requirements to transport students, or staff, to and from other regional airports (e.g.

Lubbock, TX; Albuquerque, NM, etc.). Estimate 2 round trips per month.

b. Using Government-furnished vehicles, the Contractor shall transport students to same day and follow-up medical appointments (normally with-in a 50 mile radius, but occasionally up to 200 miles one-way). Note that there may be back-to-back and/or simultaneous trips on any given day (e.g. two morning trips to Roswell medical facilities and a morning trip to Carlsbad at the same time). Additionally, there are occasional trips, approx. 3/calendar quarter, required to facilities in locations up to 200 miles one-way (i.e.

Albuquerque, NM).

c. The Contractor, using Government-furnished vehicles, shall make ad hoc trips to off-center locations to accommodate the transportation and courier needs of FLETC. Additionally, provide transportation for students traveling off center when requested.

d. Provide driving tours of the training facility for VIP's, in coordination with the Government;

normally these trips are scheduled one week in advance, but may be with little or no advance notice.

e. Perform operator maintenance and inspection services for Government-furnished vehicles in accordance with FTC-FAC-55 "Daily Vehicle Usage Report" (Attached in Section J-Atch 42) and FTC- OST-66 "Vehicle Repair Request" (Attached in Section J-Atch 4).

f. Maintain vehicle usage records using FTC-FAC-32 "FLETC Daily Motor Vehicle Trip

Ticket" (Attached in Section J-Atch 26) for FLETC vehicles.

g. Ensure that all drivers have a valid commercial driver's license (CDL), with a passenger endorsement, approved by appropriate Federal, State, and municipal laws, codes, and regulations in connection with operating a transportation service. In addition, all drivers must comply with all driver qualifications as directed by Part 391, Federal Motor Carrier Safety Regulations.

h. The Contractor shall comply with the following:

(1) Accidents involving a vehicle operated by the Contractor shall be reported and investigated as directed by 41 CFR Part 101-39.4 and, in accordance with FLETC Directive No. 70.09.I (FD 70.09.I to be provided). A copy of the directive will be placed aboard each vehicle for the use of drivers when needed.

(2) Use of interagency motor pool vehicles, their service and maintenance, and the use of related services shall be in accordance with 41 CFR Part 101-39, and instructions in the operator's packet, furnished with each interagency motor pool vehicle.

(3) The Contractor shall assume the responsibilities of the agency under 41 CFR, Subpart 101-39.8.

(4) The Contractor shall ensure that vehicles are used solely for duties in the performance of the contract.

NOTE: Unauthorized use of vehicles may result in consideration to the Government and possible default of the contract under FAR 52.249-8.

C.3.2.1 Roswell & Local Shuttle

a. The Contractor shall operate a Roswell shuttle service, using Government furnished vehicles, every Saturday, and four (4) holidays Memorial Day, Independence Day, Labor Day, and Thanksgiving).

This service will run 1200 to 2000, a sample schedule is attached in Section J; changes to the drop off/pickup points will be approved by the Government in advance, but total service time(s) remain unchanged. The Contractors operator/driver shall perform all required vehicle safety checks and supporting documentation in accordance with applicable directives and regulations.

b. The Contractor shall operate a local shuttle service, using a Government furnished vehicle, to transport students to areas within the town of Artesia, NM. This service will run Fridays from 1900 to 2200; Saturdays beginning at 1400 and returning by 2200; Sundays beginning at 0900 with the last run to occur at 1700. Sample drop off/pickup schedule is included in Section J-Atch 59. Changes to the drop off/pickup points will be approved by the Government in advance, but the total daily service time(s) remain unchanged. Contractor’s operator/ driver shall perform all required vehicle safety checks and supporting documentation in accordance with applicable directives and regulations.

C.3.2.2 Recreation Outings

a. The Contractor shall provide a driver or drivers for FLETC-furnished transportation (e.g. van, bus or buses and gas) for recreational outings for students. Dates for these outings will be scheduled by the Contractor and coordinated with the COR, at least two months ahead of the scheduled outing. The Government reserves the right to cancel or rearrange the schedule at any time and at no cost to the Government, provided 24 hours advance notice is provided the Contractor.

b. Examples of outings: four (4) different destinations per month to be structured as follows:

(1) Ruidoso, NM Depart center at 0800hrs for downtown Ruidoso (bus to be parked in public parking lot).

Depart Ruidoso at 1600hrs for Center

(2) Carlsbad Caverns/Living Desert Depart center at 0900hrs for National Park

Depart National Park at 1400hrs for Living Desert Depart Living Desert at 1600hrs for Center

(3) Roswell (UFO Museum and Roswell mall) Depart center at 0900hrs for UFO Museum Depart UFO Museum at 1200hrs for Roswell Mall Depart Roswell mall at 1700hrs for Center

(4) White Sands National Park/Cloudcroft Depart Center at 0800hrs for National Park Depart National Park at 1200hrs for Cloudcroft Depart Cloudcroft at 1600hrs for Center
