SECTION H

SPECIAL CONTRACT REQUIREMENTS

PERFORMANCE MANAGEMENT

The contractor shall be responsible for the performance metrics specified herein. The following paragraphs define the performance metrics and specify measurement and calculation requirements. The aircraft operational availability (Ao) for the contract is 95%. All data relevant to these calculations shall be provided to the Coast Guard upon request. All maintenance actions shall be included in the performance metric calculations. Any maintenance action exclusions or exclusions of data from performance metric calculations shall be disclosed in the applicable reports with a full explanation.

a) Operational Availability (Ao).

i. Availability of the LRCCA to perform its operational missions is dependent on a wide range of variables. These included availability of mission, maintenance crews, special tools, ground support and launching equipment, and spare parts. The U.S.

Coast Guard has assigned a hierarchy to the LRCCA when the aircraft is Fully Mission Capable, Partially Mission Capable, or Not Mission Capable. The LRCCA Operational Availability (Ao) percentage is designed to maximize availability to Coast Guard Air Station Washington, while meeting the manufacturers FAA-approved maintenance requirements of the aircraft. The Ao is to be computed and verified semi-annually.

b) Fully Mission Capable (FMC)

i. The LRCCA will be considered FMC when it is available for dispatch with required systems, subsystems, and accessories in fully functional working order as designed.

c) Partially Mission Capable (PMC)

i. The LRCCA will be considered PMC when the aircraft is in a flyable condition but one or more of the required systems, subsystems, or accessories to those systems are degraded.

d) Not Mission Capable (NMC)

i. The LRCCA will be considered NMC when it is not available for dispatch for required missions.

e) Computing Availability

i. Semi Annual Ao = Uptime/ (Uptime + Downtime)

ii. Required Ao = 95%

iii. Uptime represents the amount of time the system has been fully operational based on

8760 hours per year (365 days * 24 hours/day).

iv. Downtime represents the sum of NMC time and PMC time in hours or fraction thereof. Outside of any normal wear and tear, any downtime which is caused by the aircraft entering scheduled depot maintenance will not be included in computing Availability to determine compliance with the Required Ao. The Coast Guard and the Contractor mutually agree that downtime will be measured from the time the Contractor is notified by the Coast Guard Air Station Washington Maintenance personnel the affected aircraft system is returned to Ready for Issues (RFI) status.

f) Calculating NMC and PMC Time

i. Not Mission Capable (NMC) uses 100% of the time to calculate NMC time.

ii. Partially Mission Capable (PMC): The calculation of PMC time shall be applied to systems not impacting safety of flight, but reflecting level of service provided.

Examples may include impacts on aircraft range, ability to operate at short airfields, impaired aircraft avionics, intermittent cabin communications and galley equipment.

A rate of 25% shall be used to calculate PMC time for such components. PMC time impacts on Ao will be addressed in each semi-annual review by the COR.

Components not providing 95% reliability shall be repaired or replaced by the Contractor.

iii. Example 1: If the Microwave Oven was inoperative on the LRCCA for a 24 hour period due to supply or maintenance issues, then PMC would be calculated as (24 hours x .25 = 6 hours). This value would be added to “downtime” in determination of Ao.

iv. Example 2: If multiple systems were not mission capable for the same time period, PMC would equal the applicable time not available. However, the calculated total PMC shall never exceed 100%.

g) Inability to Meet Required Availability Rates.

i. A 1.05% price reduction on the Contractor will be applied if the required availability rate is not met over the measured semi-annual period. The price reduction shall be included in the next invoice period after the contractor is notified by the Coast Guard of a failure to meet 95% availability. This formula will be applied on a linear scale and shall consider lost mission capability, cost of travel on commercial airlines, and lost executive work time. The data will be based only on officially- documented maintenance records and flight logs. The chart below is based upon an example annual lease price of $3,000,000 and will be adjusted at contract award to reflect 1.05% of the proposed lease price.

Availability Price Reduction 94% $ 31,578.95 93% $ 63,157.89 92% $ 94,736.84 91% $ 126,315.79 90% $ 157,894.74

ii. Note 1: Data calculations continue at same rate below 90%.

L.2. PROPOSAL INSTRUCTIONS, PREPARATION AND SUBMISSION

A. OVERVIEW

This acquisition will be conducted using FAR Part 12 and FAR 15 – Contracting by Negotiation.

In determining source selection, a lowest price technically acceptable (LPTA) process will occur.

The Government intends to select one Offeror for award of a firm fixed price contract on initial offers.

B. GENERAL INSTRUCTIONS

1. Proposal Instructions

Portions of the Offeror’s proposal may be incorporated by reference into any resultant contract at award. If discussions are conducted, specific areas to be incorporated will be identified. If discussions are not conducted and award is based upon the initial proposal, the Government reserves the right to incorporate specific areas without consent of the Offeror. Because the Government intends to award without discussions, the Offeror is responsible for providing its best submission on its initial offer. These instructions prescribe the format of proposals and describe the approach to be used in the development and presentation of proposal information. Proposals must be prepared in accordance with these instructions, providing all required information in the format specified. Failure of a proposal to comply with these instructions may be grounds for exclusion of the proposal from further consideration. Specific instructions on the content requirements for each volume are identified below. The information must be presented in sufficient detail to allow a comprehensive evaluation of the Offeror’s ability to deliver the leased aircraft. The proposal shall clearly demonstrate these in a concise, logical manner, which is easy to read and understand. Excess verbiage, unnecessary elaborate brochures, or repetitious, disorganized presentations beyond those sufficient to present a complete and effective proposal are not desired and may be construed as an indication of the Offeror’s lack of understanding of the requirements or lack of cost consciousness. No cost/price data shall be included in any other volume than the Cost/Price Volume. This program is unclassified. No classified data shall be submitted as part of an Offeror’s proposal. Failure to submit any of the information requested by this solicitation may be cause for unacceptable consideration.

The Government will not pay any costs incurred by any Offeror in the preparation and submission of a proposal in response to this RFP.

M.1 CLAUSES

FAR 52.252-1, “SOLICITATION PROVISIONS INCORPORATED BY REFERENCE

(FEB 98)

The following FAR clauses incorporated by reference:

NUMBER TITLE DATE

52.217-5 EVALUATION OF OPTIONS JUL-90

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

(End of clause)

M.2 PROCEDURES FOR AWARD

Proposals shall be submitted in accordance with the instructions in Section L. Proposals will be reviewed for compliance with the solicitation requirements. Failure of a proposal to comply with the instructions in Section L may be grounds for exclusion of a proposal from further consideration. If proposals contain more than the specified page limits, only the pages up to the limiting number for that volume will be evaluated.

A proposal may be rejected as being grossly deficient and excluded from further consideration for award under any of the following conditions:

a. If a major rewrite of any section or sections is required to permit evaluation.

b. If proposals contain a charge for failure to exercise an option.

If a proposal has been rejected as grossly deficient, the Contracting Officer will notify any affected Offeror in writing no later than 30 days after the proposal due date.

The Government intends to evaluate proposals and award contracts without discussions with the Offerors, except clarifications as described in FAR 15.306(a), and will evaluate each offer on the basis of the Offeror’s initial proposal. Therefore, the initial proposal should contain the Offeror’s best terms from a technical and cost/price standpoint.

M.3 BASIS FOR AWARD

http://www.fbo.gov/

The selection decision will involve an evaluation of the proposals non-price factors. For LPTA source selections, this is accomplished by establishing the requirements to be evaluated on an “acceptable” or “unacceptable” basis. In order to be considered suitable for award, the proposal must receive an acceptable rating for every non-price factor. Once all the acceptable proposals have been evaluated, the lowest price proposal will be selected for award.

M.4 EVALUATION FACTORS AND RATING METHODOLGY

EVALUATION FACTORS

2. PAST PERFORMANCE

The Government will evaluate the Offeror’s ability to supply the required supplies and services that meet the Government’s needs, including schedule, based on the Offerors demonstrated record of past performance. This factor will be evaluated on the basis on relevant past performance for the Offeror, including performance on contracts of similar scope and complexity for similar products with similar installations.

The Government will evaluate Past Performance, including information in the PPQs, as it relates to the solicitation requirements. The information presented by the PPQs, together with information from any other sources available to the Government (e.g., Government maintained databases and other references, including contractual, technical, and end-user representatives), may provide input for this evaluation factor. Offerors are cautioned that the Government will use information provided by the Offeror and information obtained from other sources in the evaluation of past performance.
