Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements -
BRAND-NAME
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and Contracting Activity.
The Office of Contract Operations (CG-9127), the United States Coast Guard Headquarters, Department of Homeland Security, Washington, DC, proposes to enter into a contract on a basis other than full and open competition, brand-name.
(2) Nature and/or description of the action being approved.
The Coast Guard Office of Aviation Acquisition (CG-931) has a requirement to provide a Gulfstream Long Range Command and Control Aircraft (LRCCA). This Justification and Approval for other than full and open competition (J&A) brand-name serves to document that Gulfstream is the only source of supply that will meet the Coast Guard’s requirement. This aircraft will be specified in the contract that will initiate a lease no later than September 2016.
This will be a competitive contract to lease a product made by Gulfstream Aerospace Corporation, 500 Gulfstream Road Savannah, Georgia, 31408, Cage Code 59734.
(3) Description of Supplies.
The requirement is to provide a brand-name Gulfstream 550 (G550) aircraft to serve as a second leased LRCCA at Coast Guard Air Station (AIRSTA) Washington, DC. The Air Station currently operates two Gulfstream Vs (G-Vs): CG-01 and CG-02. The Coast Guard owns the CG-01 and leases the CG-02. The lease for the CG-02 will expire in September of 2016 and a new lease must be in place to satisfy mission needs.

(4) Identification of the justification and the rationale.
The statutory authority permitting other than full and open competition is:
FAR 6.302-1(c) Application for brand name descriptions.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
The Coast Guard owns one and operates two G-V aircrafts, CG-01, and CG-02. AIRSTA Washington is fully equipped to support a Gulfstream aircraft with trained pilots, maintainers, and support equipment. In order for AIRSTA Washington to effectively complete its mission to provide rapid, secure, and connected transportation to its principals, it must operate two LRCCAs. The Coast Guard is considering a G550 aircraft for this lease in the interest of commonality. An aircraft awarded other than a Gulfstream aircraft would incur additional costs on AIRSTA Washington because it would require aircraft operators and technicians to operate and maintain two dissimilar assets. Over the last 15 years, the Coast Guard has invested into Gulfstream non-recurring infrastructure and recurring logistical costs for purchasing CG-01, testing, training, maintenance and support equipment for an estimated $M-$M. For purposes of this J&A, a G550 is needed as it will also reduce avionics obsolescence issues currently experienced in the G-V fleet. It is estimated a G-V and G550 is 90% common with no changes to engines or aircraft dimensions.
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.
A FedBizOpps notice will be publicized, as required by FAR 5.102(a)(6) and FAR Subpart 5.2 upon approval of this J&A.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The Contracting Officer determines that market competition will dictate that the anticipated price will be fair and reasonable. The Contracting Officer also has sufficient historical pricing insight based on the current LRCCA lease contract prices, and based on the responses to the RFI posted on FedBizOpps on October 22, 2015.
(8) Description of market research.
Results of the market research from RFI dated October 22, 2015 indicated numerous companies (Large and Small) were interested in participation. Due to the existence of the minimum of two potential Small Business vendors, a small business Set-Aside has been initiated for this effort.
(9) Any other facts supporting the use of other than full and open competition.
N/A
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
A RFI was issued in the FedBizOps on October 22, 2015 requesting that parties express their interest in writing to the Contracting Officer. xxxx responded to the RFI and expressed interest in being the prime contractor for the lease.
(11) A statement of actions.
The Coast Guard, in conjunction with DHS, is developing the LRCCA requirements through a Joint Aviation Commonality Portfolio Team (ACPT). When the ACPT has completed its analysis of Command and Control requirements for the entire department, a competition for aircraft and provider will be conducted to support the LRCCA mission. This J&A serves to allow a new leased asset to continue operations at AIRSTA Washington until the ACPT finishes its analysis.
