Questions and Answers
1) Solicitation paragraph 7 states, “Under this contract, the Contract Manager and Supervisors are designated as “key personnel.” The Contractor shall submit a Key Personnel Resume clearly detailing the individual’s qualifications…” Under the Volume I - Technical Proposal subheading the solicitation states, “This volume shall address Past Performance and Socio-Economic Plan and include all information required for proposal evaluation.” Under the Evaluation subheading the solicitation states, “In addition to price, the following technical evaluation factors shall be used to evaluate offers:
Past Performance Socio-Economic Plan”
Are key personnel resumes required to be submitted as part of the proposal or at the first meeting with the CO/COTR after contract award? 2) If required to be submitted as part of the proposal, will the resumes be excluded from the page count?
ANSWER 1) RESUMES ARE TO BE SUBMITTED, UPON REQUEST, AFTER AWARD.
2) Solicitation instructions identify font limitations under subparagraph heading Requirements for Proposal Content. The reference states, “…with at least one inch margins on all sides, using a font with a point size of 12 or greater (e.g., "Times New Roman" style with 12 point font).”
QUESTION: Is it permissible to use a smaller font size for graphics, tables, etc., as long as the type is readable?
ANSWER 2) THE SOLICITATION IS CLEAR IN THIS REQUIREMENT.
3) Will FPS allow an opportunity to negotiate the Terms and Conditions provided in the RFQ?
ANSWER 3) NO.
4) Please clarify if the incumbent guard force satisfies all the requirements provided in the RFQ.
ANSWER 4) THE INCUMBENT GUARD FORCE SATISFIES THE REQUIREMENTS IN THEIR
CURRENT CONTRACT.
5) Will FPS accept American Heart Association certification standards in addition to American Red Cross for CPR/First Aid/AED Certification?
ANSWER 5) NO.
6) Please indicate if the there is a requirement for Body Armor. The line item is not marked for quantity, however, the Body Armor is listed.
ANSWER 6) IT IS NOT NECESSARY.
7) Can FPS provide the make and model of the current firearm being utilized by the incumbent work force?
ANSWER 7) A 38 CALIBER REVOLVER..
8) Please clarify if Contractor is to provide OC Spray/Pepper Spray to personnel and any associated training hours?
ANSWER 8) CONTRACTOR IS REQUIRED TO PROVIDE THE TRAINING AS REQUIRED
UNDER THIS SOLICITATION.
9) RFQ, Section 7 Key Personnel, Item A (page 30): Please clarify if the Supervisors provided within the Key Personnel section are included within the provided hours for the “Supervisory Guard” line items.
ANSWER 9) YES.
10) RFQ, Section 8 Work Schedule Procedures (page 32): Are there posts that have been or could be designated as “relief posts” where guards can rotate to take their lunch but still maintain the post? If so, can FPS identify these posts?
ANSWER 10) NO, A RELIEF GUARD IS REQUIRED.
11) RFQ, Section 17.2 Security Management (page 52): Please clarify the position of “Corporate Security Officer” and any requirements.
ANSWER 11) SOLICITATION IS CLEAR AND BACKGROUND CLEARANCE IS REQUIRED.
12) RFQ, Contract Clauses, HSAR 3052.209-70 (page 73): Please clarify if Contractor is to complete and submit the foreign incorporated disclosure (f). If yes, please provide the Volume in which this information is to be contained.
ANSWER 12) INCLUDE DISCLOUSURE AS PART OF VOLUME I. THE DISCLOUSURE WILL
NOT COUNT TOWARDS THE PAGE LIMITATION.
13) RFQ, Submission of Proposal, Item (4) Page Limitation (page 77): Please clarify if the completed Past Performance Information Forms provided on page 88 will count towards the 15-page limitation of the Technical Proposal Volume.
ANSWER 13) YES.
14) Exhibit 1, Post Breakdown: For the Unarmed – Not Uniformed position at the security clerk main entrance located at 500 C Street, please clarify if Contractor is to provide any of the listed uniform items for this position.
ANSWER 14) THIS POST REQUIRES A SUIT BLAZER IN ADDITION TO THE LISTED UNIFORM
ITEMS.
15) Exhibit 1, Post Breakdown: Please clarify the Armed – SPO position and if this requires any additional training as provided for in RFQ. Please provide the Labor Wage Determination Classification that would apply.
ANSWER 15) THERE IS NO SPO REQUIREMENT. POST EXHIBIT IS HEREBY CORRECTED TO
DELETE “SPO”. ALL ARMED POSTS ARE GUARD II.
16) Exhibit 2A (page 4): Please clarify if Contractor is to provide any communication equipment (i.e.
radios, cell phones, etc.) for the guard personnel.
ANSWER 16) CONTRACTOR WILL PROVIDE ALL COMMUNICATION EQUIPMENT DOR THE
GUARD PERSONNEL.
17) Please describe what FPS will require regarding payment of accrued benefits such as vacation, sick and personal time to incumbent personnel selected to continue duty but now employed with a new service provider.
ANSWER 17) THE PREVAILING CBA/WAGE DETERMINATION MUST BE HONORED.
18) Will FPS provide a seniority list from the provided Collective Bargaining Agreements?
ANSWER 18) WE CURRENTLY DO NOT HAVE THIS LIST. IN ANY CASE, AND IN
ACCORDANCE WITH THE SOLICITATION, THE LIST WILL BE PROVIDED AFTER AWARD
TO THE SUCCESSFUL OFFEROR.
19) Please clarify if the provided CBA is the most current agreement as the dates provided are from May 1, 2005 to April 30, 2008. Can FPS provide the most current agreement?
ANSWER 19) A CURRENT AGREEMENT IS NOT AVAILABLE AT THIS TIME.
20) CBA, Wages Addendum (page 20 of 25): Please define the position and job description of a “Senior Guard” as this position is not provided for in the RFQ.
ANSWER 20) THE SENIOR GUARD IN THE CBA IS AN ARMED GUARD, AS REQUIRED, BUT
IT IS NOT A SUPERVISOR.
21) Would you please provide the vacation schedule for the current contract guard force to include anniversary dates (we need to know how long an employee has been working at your locations in order to properly price vacation pay)? This could simply be a list (no names) that identifies the seniority schedule of the current guard force with the employees start date at your facility.
ANSWER 21) SEE ANSWER 18.
22) Training - Would you please provide the training record of all current guard force employees (we need to know what training has been completed in order to properly price training)? Or, have all current guards completed all required training?
ANSWER 22) SEE ANSWER 18.
23) I am coming up with a total of 176,126 base period hours from the SF 1449, but 152,978 base period hours the exhibit 1 spread sheet. Which document depicts the correct number of base period hours?
ANSWER 23) THE SF1449 SHOWS THE MAXIMUM HOURS FPS EXPECTS TO PURCHASE. .
ALL HOURS ARE ESTIMATES AS THE INSTANT CONTRACT IS A LABOR HOUR CONTRACT,
NOT FIXED PRICE. IN ADDITION, THERE IS A NEW POST EXHIBIT AND ALL CLINS HAVE
BEEN UPDATED TO REFLECT THIS CHANGE. USE THE HOURS AS STATED IN THE SF30 TO
EXTEND YOUR TOTAL CONTRACT PRICE.
INTERESTED OFFERORS MUST REQUEST A COPY OF THE AMENDED POST EXHIBIT
TO THE CONTRACT SPECIALIST.
24) Although this acquisition is unrestricted, will 8(a) utilization provide for additional evaluation points?
ANSWER 24) NO.
25) Is the language provision provided under Guard Services Requirements, Section 2.2 and its subparts included in the incumbent’s contract?
ANSWER 25) INCUMBENT SHOULD COOPERATE DURING TRANSITION AS THIS IS STILL
PART OF ITS CURRENT CONTRACT PERFORMANCE AND MAY AFFECT ITS PAST
PERFORMANCE EVALUATIONS.
26) Section 5 entitled “Quality Control” provides for “Contractor’s Quality Control Monitors”. Are the Quality Control Monitors the same position as “Supervisor”?
ANSWER 26) THEY CAN BE BUT IT IS SUGGESTED THAT QUALITY CONTROL BE
PERFORMED BY DIFFERENT INDIVIDUALS.
27) Guard Services Requirements, Section 6.2.A provides for “Security guards shall perform all tasks in accordance with the duties outlined on the Security Guard Post Assignment Record (Post Orders), which are prepared by FPS for all shifts on each post. The Post Orders define the specific duties that the contract security guards are to perform. The security guards shall not deviate from the directions provided by the Post Orders except in emergencies or as directed by the COTR. The COTR may modify, amend, and/or revise the Post Orders to change shift duties, start and stop times, and post locations provided the change is within the Contract scope has no impact on the Contract cost. Such changes shall not require modification to the task order or Contract.”
Please provide a sample copy of the Post Orders and Officer Duty Book.
ANSWER 27) NO.
28) Guard Services Requirements, Section 6.3-4 entitled “Receipt, Use, and Safeguarding of Keys” provides “Based on the Post Orders and coordination with the COTR, security guards will be responsible for receiving and using keys and access control devices (i.e., “key cards,” lock combinations) that are issued for the guards’ use.”
Does each location with keys and access control devices have a lockable container?
ANSWER 28) IT WILL DEPEND ON THE POST ORDERS.
29) Guard Services Requirements, Section 6.3-13.C entitled “Reports, Records, and Testimony” provides “Security guards may be required to testify in various judicial proceedings on behalf of the Government.”
Is the contractor able to bill OT for the personnel who stand post while other Officers testify?
ANSWER 29) NO.
30) Guard Services Requirements Section 8 provides in relevant part “Breaks and/or lunch reliefs shall be provided by the Contractor in accordance with DOL regulations.” Attachment I, Exhibit 1 provides “Where indicated, relief periods (lunch, breaks, etc.) are authorized by Contract. The Contractor must provide a replacement guard for each employee on an authorized break. Unless otherwise specified, patrol (rover) guards and Supervisors shall not be used for replacement. All full time productive guards working a minimum 8-hour shift shall be provided a paid 15-minute break for each 4 hours of work. This break should normally be scheduled in the middle of each 4-hour period. A 30-minute unpaid lunch break shall also be provided to those individual. All guards working a 6-hour shift shall be provided a paid 15-minute break and 30 minute unpaid lunch break. Part-time productive guards working a minimum of 4 hours shall be provided a paid 15 minute break every 4 consecutive hours worked. The cost to cover relief for the productive hours indicated herein must be included in your offer.”
Which guidance should contractors follow? There are no minimum rests or meal break requirements for Washington, DC or Maryland according to DOL regulations. Alternatively, must contractors adhere to the requirements provided in Attachment I, Exhibit 1? Please clarify if it is “Otherwise Specified” that Patrol (Rover) Guards and Supervisors can be used to provide breaks.
ANSWER 30) ALTHOUGH THE FEDERAL GOVERNMENT HAS NO SPECIFIC REQUIREMENTS
FOR BREAK TIME, OFFERORS SHALL FOLLOW THE GUIDANCE PROVIDED IN THE POST
EXHIBIT. SEE ANSWER 30 FOR ADDITIONAL RELIEF INFORMATION.
31) Guard Services Requirements Section 9 provides “Only DOL category Guard II Security Officers may be utilized to perform services under this Contract. All category Guard II Security Officers must be firearms qualified.”
Does this mean that the unarmed guard is paid as a Guard II and must also be firearms qualified?
ANSWER 31) NO.
32) Guard Services Requirements, Section 11.2-1.B provides for “One-time only courses are defined as courses that, if the employee successfully completes, do not have to be taken again during the Contract term. One-time only courses are (1) basic training; (2) FPS “orientation” training; (3) current FPS Basic Firearms Training; and, (4) the written exam. However, additional training may be required on Magnetometer/x-ray if or when the equipment or technology is changed. The training certifications, excluding FPS orientation, are transferable to other FPS security guard service contracts, provided that the Contractor can furnish evidence (e.g., a valid, signed certification) that the training was successfully completed during the predecessor Contract.”
Does the Government have evidence that incumbent security guards have successfully completed the aforementioned training?
ANSWER 32) THE INCUMBENT SECURITY GUARD HAVE ACTIVE CERTIFICATIONS IN THE
TRAINING REQUIRED UNDER THEIR CONTRACT.
33) Section 11.2-2.A states that supervisors require 9 hours of supervisory training. Is this “one-time only” training as defined in section 11.2-1.B?
ANSWER 33) THE TRAINING IS ONE TIME ONLY IF THERE IS NO BREAK IN SUPERVISORY
SERVICE.
34) Guard Services Requirements, Section 11.4.E provides for “Any Contract employee who has successfully completed a 40 hour firearms course under a predecessor FPS Contract may be exempted from the 32 hours of firearms training, provided the Contractor can furnish adequate proof (e.g., a valid, legible copy of a Training Certificate or firearms certification) that such training was successfully completed and that the training was relevant to the firearm requirement described herein. The COTR shall have the sole discretion to accept or deny proposed exemptions from training based on prior training experience. Prior successful training completion by the Contract employee shall not exempt the Contract employee from the annual range qualification requirements.”
Does the Government have evidence that incumbent security guards have successfully completed the aforementioned relevant 40-hour Firearms Course training?
ANSWER 34) SEE ANSWER 32.
35) Reference Guard Services Requirements, Section 11.4.G provides for “If the weapon platform required under this Contract is different from the guard’s previous qualification, the Contractor is responsible for providing adequate weapon transition training. The training plan shall include a weapons transition training plan, if applicable.”
What is the current weapons platform?
ANSWER 35) SEE ANSWER 7.
36) Guard Services Requirements, Section 11.4.I provides “The contractor is responsible for providing the certification training specified by the manufacturers’ recommendations and/or any state or local requirements that may apply pertaining to the use or carriage of any lethal or less-than-lethal weapons (i.e. expandable or straight police baton, sprays or repellants, conducted energy weapons, stuns weapons, etc.), equipment, or devices required in this Task Order.”
Please clarify the less-than-lethal weapons requirements for this Task Order.
ANSWER 36) SOLICITATION IS CLEAR.
37) Guard Services Requirements, Section 11.6.A provides for “All Contract employees must receive FPS-specific training. The COTR and the Contractor will schedule the site(s) and date(s) of the training session(s) after the award of the Contract and prior to the Contract start date. See Exhibit 4C.” Reference Guard Services Requirements, Section 11.6.B provides for “Security guards and uniformed supervisors who worked under the predecessor Contract may be exempt from this training, provided the Contractor can furnish adequate proof that such training was successfully completed (e.g., a valid, legible copy of a Training Certificate). The COTR shall have the sole discretion to accept or deny proposed exemptions from training based on prior training experience.”
Is the FPS-specific training in this RFQ the same as in the current contract? Does the Government have evidence that incumbent security guards have successfully completed the aforementioned FPS-specific training?
ANSWER 37) SEE ANSWER 32.
38) Guard Services Requirements, Section 11.7 entitled “Government-Provided Magnetometer/X-Ray Training” provides “All Contract employees shall receive up to eight (8) hours of Government-provided training on the use and handling of magnetometers and/or x-rays. Upon completion of this training, the FPS Training Representative will issue each Contract employee a certificate of training completion.”
If incumbents are retained, do they have to retake this training?
ANSWER 38) THE TRAINING HAS TO BE RETAKEN IF THEY CANNOT PRODUCE THEIR
CERTIFICATE OR IF THE TECHNOLOGY CHANGES.
39) Guard Services Requirements, Section 11.8.B provides in part for “The Contractor is responsible for scheduling, obtaining, and covering all costs associated with providing CPR, AED, and First Aid training to all employees assigned to work under this Contract. CPR and AED training and certification must include adult, youth, and infant training modules. Training certification shall be valid for one year.”
Please confirm that the CPR and AED training certificate is only valid for a one year period. Usually this training is valid for multiple years. Does the Government have evidence that incumbent security guards have successfully completed the aforementioned training?
ANSWER 39) SEE ANSWER 32.
40) Guard Services Requirements, Section 11.9.A provides for “In certain cases, the Contractor’s employees will receive special training that will be given by the tenant agency or by FPS. The number of training hours and the posts to which the special requirements apply will be provided when the requirement arises. The Contractor will be required to schedule the training, to compensate all security guards for off-duty training at their regular hourly rate/salary, and to ensure that all posts are manned while training is in progress.”
Is the special training time billable?
ANSWER 40) THE CONTRACTOR IS RESPONSIBLE FOR ALL COSTS FOR SPECIAL TRAINING
REQUIRED BY STATE AND LOCAL JURISDICTIONS. AT PRESENT, THERE IS NO
IDENTIFIABLE REQUIREMENT FOR THE GOVERNMENT MANDATED SPECIAL TRAINING.
THE CONTRACTOR WILL BE ENTITLED FOR AN EQUITABLE ADJUSTMENT IF SPECIAL
TRAINING IS REQUIRED AFTER AWARD.
41) Section 12.2.A states that “the Contractor shall require that all of its employees, who are prospective FPS contract guards, to undergo a pre-employment medical/physical examination every three years” Are incumbent employees who have passed this medical/physical examination within the last three years exempt from retaking the pre-employment examination? Does the Government have evidence that incumbent security guards have successfully passed the medical/physical examination?
ANSWER 41) THE INCUMBENT GUARDS HAVE PASSED THE EXAMINATIONS AS REQUIRED
UNDER THEIR CONTRACT.
42) Guard Services Requirements Section 15.2-2(3) provides “Unless stipulated otherwise in a task order, no firearms or ammunition shall be removed from the premises. All firearms shall be stored UNLOADED in an on-site safe or other security cabinet provided by the Contractor that complies with Government standards for storage of weapons. Ammunition will be stored separately from weapons and secured under a separate lock.”
Does the Government or the Contractor furnish clearing barrels?
ANSWER 42) CONTRACTOR FURNISHED.
43) Guard Services Requirements Section 18.1.G provides “The Contractor is responsible for all costs associated with obtaining and renewing the applicable security clearances for each affected Contract employee. The costs should be factored into the offering prices, as they will not be itemized or paid for separately by the Government.”
Please confirm if the Contractor is responsible for these costs. If so, please provide the cost of obtaining the security clearance.
ANSWER 43) CLEARNACE ABOVE HSPD12 SUITABILITY IS NOT CURRENTLY REQUIRED
ON THIS SOLICITATION/CONTRACT.
44) The hours for each option year as detailed in the Schedule of Supplies and Services are different from the hours in the base year as detailed in Exhibit 1, Post Coverage spreadsheet. Is it the government’s intent to have the hours fluctuate over the years?

45) Exhibit 2A “Contractor Furnished Communication Equipment Requirements” does not provide specific equipment. Will the government provide details of the current communications equipment in use?

46) Solicitation Exhibit 2C.3 lists body armor (faintly) and no quantity is listed. Is body armor a requirement as Exhibit 4.E indicates it is used in the course of fire?

47) Exhibit 2E, entitled “Contractor-Furnished Firearms and ammunition” provides “Contractor Guard Firearm Specifications 9mm semi automatic pistols”. Are the incumbent guards using this weapon currently?

48) What position in Attachment I, Exhibit 1, Post Exhibit Spreadsheet does the Sr. Guard position in the CBA correspond to?

49) Will the Government please provide the incumbent personnel seniority list to assist in determining vacation costs?

50) Attachment I, Exhibit 1 provides for both “Armed” and “Armed-SPO” descriptions. It is our understanding that generally all armed officers in Washington, D.C. must possess the SPO license. Please clarify why the Government listed two armed descriptions. Please note we also understand that when the weapon is a 9mm that Washington, D.C. will not issue a SPO license for that weapon.

51) Page 75, Section I, General provides in relevant part “Offeror shall submit their proposals in two separate volumes as follows: Volume I, Technical Proposal – 1 Copy; Volume II, Price/Cost Proposal – 1 Copy. In addition, Page 76, Section II, Requirements for Proposal Content, subparagraph (2) provides in relevant part “Identification of original signature copies”.
Is the required submission of each binder is one original and one copy, or one original only?

ANSWER 52) THE PAST PERFORMANCE QUESTIONNAIRE WILL NOT COUNT TOWARDS

53) Page 77, Note (4) Page Limitations provides in relevant part “Each page is defined as one sheet, 8 ½ x 11” with at least one in margins on all sides.”
Please confirm whether the Offeror can include headers and/or footers with essential information, such as RFP Section Name, RFP Solicitation Number, page number, and disclosure statement, within the one-inch margin limitations?

54) After reviewing the RFP, it seems that the post hours are missing from Exhibit 1. Please provide a list of the post hours by location.

55) What is the current protocol for post breaks and lunch breaks at the facilities?

56) Is office space and furniture government supplied? Are there any other Government equipment, such as Fax machines and copiers available?

162) The following inconsistencies in the RFP are causing confusion in efforts to price the contract:
• The location at 395 E. Street calls for SPOs (Special Police Officers) at posts 5, 6, and 7.
• Page 32 of the solicitation indicates that “Only DOL category Guard II Security Officers may be utilized to perform services under this Contract”; this labor category is separate from a SPO .
• Under Article I – Union Recognition of the CBA, it distinctly identifies the location (501 C
Street, S.W. Washington, D.C.) for which the CBA applies.
• Under the Addendum to the CBA, wage rates are called-out for Guard II and Sr. Guard positions, but there is no distinction between the two categories in the solicitation.
• On page 2 of the solicitation (second page of the SF 1449), it is indicated that “All sites are covered under this CBA with the exception of the unarmed guard (greeter) located at the 500 C Street, Washington, DC” location.
Given these inconsistencies, please provide finite and detailed clarification as to what locations (buildings) and posts are to be categorized as Guard II requirements, which are to be covered under the terms of the CBA, and direction as to how to categorize the SPO positions, as they are neither recognized by the CBA or the Wage Determination.

163) Section 6.3(D), Typical Duties (Page 25): The RFP states: “Off-going guards shall provide a brief to on-coming guards of the events and occurrences that have recently happened, are continuing, or are anticipated for the post.” In order to ensure that all bidders price this time appropriately and based on equivalent information, does the Government have an estimate of the time required to accomplish this briefing at the beginning and end of each shift?

164) Section 7.2(C), Supervisor (Page 32): It states: “The Contractor shall provide the level of supervision sufficient to meet the Contract requirements.” How does the Government intend to evaluate each contractor’s proposed level of supervision?
