ACCORDANCE WITH THE GUIDANCE FOR THE AMERICAN RECOVERY AND REINVESTMENT ACT OF
2009 (ARRA).
I.4 GENERAL INSTRUCTIONS FOR THE PREPARATION OF PROPOSALS (OCT 2008)
Each offeror's proposal submitted in response to this solicitation shall be prepared in two volumes: Volume I – Technical Proposal and Volume II – Price Proposal. Each volume shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other.
The proposals shall be submitted for Volumes I and II, both in hard copy (original and six copies) and electronic media (CD-ROM, two copies) to the individual designated to receive proposals in the solicitation.) Responses to this request for proposals are due on May 17, 2010 at 4:00 p.m. EST.
The proposal shall be delivered to:

Proposals must be prepared in accordance with these instructions and provide all required information in the format specified. The required format is designed to ensure submission of information essential to the understanding and comprehensive evaluation of the offeror's proposal. There is no intent to limit the contents of proposals: the instructions permit inclusion of any additional data or information an offeror deems pertinent.
Formats Electronic applications: written documents, MS Word 2003; spreadsheets, MS Excel 2003 with formulas included; project plans/schedules, MS Project 2003; and portable document format, Adobe Acrobat 7 Professional; computer-aided design (CAD) documents, Visio 2003.

Hard paper copy: 8 1/2 x11 inch paper in three-ring binder(s), single-spaced.
Font size shall be Times New Romans, in no smaller than 12 point for text, 10 point for spreadsheets and tables and any font size for graphics as long as they are legible.
Page Limits The Volume I Technical Proposal is limited to 20 pages. Pages beyond this number will not be read or evaluated.
When both sides of a sheet display printed material, it shall be counted as 2 pages (single-sided preferable).
Printed pages and illustrations shall be legible and no larger than 11” x 17” foldouts as appropriate for the subject matter. Foldouts are considered part of the page limitations, shall be printed on one side only, and shall count as two pages. All pages must be numbered sequentially. Included in the page count are separate pages providing graphics, charts, illustrations, and pictures. Title pages, cover pages, table of contents, Executive Summary, section dividers, resumes, construction drawings, specification sheets, and technical bill of materials (BOM) will not count in page limits.
Failure of a proposal to comply with these instructions may be grounds for exclusion of the proposal from further consideration.
Volume I—Technical Proposal
This volume must not contain any reference to price.
The Technical Proposal shall be prepared in such a manner as to enable the Government reviewers to make a thorough evaluation and arrive at a sound determination of whether the proposal meets all technical requirements of the solicitation. To this end, the Technical Proposal should be sufficiently specific, detailed, and complete as to clearly and fully demonstrate that the offeror has a thorough understanding of the requirements set forth in the solicitation. The Contractor must submit an explanation of its proposed technical approach in conjunction with the tasks to be performed in achieving the project objectives. Proposals which merely offer to perform in accordance with the Government's requirements or which merely paraphrase the requirements document, or use phrases such as, "standard engineering practices will be employed," or "well established techniques will be employed," etc. may be considered non-compliant and ineligible for award.
This volume shall consist of the sections as outlined and described below, with separate tabs for each section.
Section 1—Transmittal Letter
A letter that formally transmits the proposal and states in general terms how the offeror meets the solicitation requirements.
Section 2 - Executive Summary and Table of Contents
In this section, the offer will be summarized, highlighting salient features of the proposal, including a description of the offeror's approach and plans to satisfy and support requirements of this solicitation.
A clear table of contents with page numbers referenced shall be included.
Section 3—Technical Approach
The technical approach shall address the topics listed below and be in as much detail as the offeror considers necessary to fully explain the proposed technical approach or method. It must be a clear and concise presentation that includes, but is not limited to, the requirements of the Statement of Work. The Technical Proposal should reflect a clear understanding of the nature of the work being undertaken. It shall clearly describe all subfactors described in the Evaluation Criteria:

The Offeror’s Technical and Management approach will be evaluated based on the assessed strengths, weaknesses, deficiencies, and risks of each offerors proposal. Subfactor ratings will be individually evaluated.
Subfactor ratings will be rolled up into an overall rating for the Technical Factor.
Factor 1 Technical and Management Approach
Ability to meet requirements and quality of technical and management approach proposed for the SOW requirements - the offeror’s proposal will be evaluated in order to determine its understanding of the requirements.
Subfactor 1.1 Equipment Procurement
The Offeror shall demonstrate its approach to procure the equipment listed resulting in the “best value” for the Government. The Offeror shall demonstrate its approach to conduct quality assessments of the equipment being procured while ensuring best pricing methodology (e.g., contracts being used to procure equipment, volume discount approaches). The Quality Assurance Plan to be submitted with the technical proposal shall be evaluated based on this approach. The offeror shall also submit a contractor-revised Bill of Materials with the proposal that indicates the proposed manufacturer and model of the equipment to be provided. Vendors shall provide specification sheets for all equipment listed in the BOM; this will not be counted against the page count.
Subfactor 1.2 Management Approach
Offeror shall demonstrate its management approach and methodology to effectively management the project. The Offeror shall be evaluated for their approach in these key factors:
• Coordination with and status reporting to TACCOM
• Program Management and Risk Mitigation
• Scheduling and sequencing -- ensuring that equipment is available when needed
• Recovery Act Reporting Requirements
Factor 2: Past Performance
Basis of Evaluation
Past Performance – Quality of past performance for recent, similar contracts/orders with other federal agencies (may also include past performance information for partner(s), if applicable) – The Offeror’s proposal will be evaluated based on the experience with meeting requirements that are similar in size and scope of the requirements of this proposal.
Vendors shall identify up to three (3) contracts/task orders with the Federal Government and/or commercial customers that demonstrate recent and relevant past performance, documenting the success of the technical approach with relevant past performance. Recent is defined as within the last three years. Relevant is defined as work similar in complexity and magnitude of the work described in the SOW.
Include project name and description, contract number and/or order number, period of performance and client/agency technical and contractual points of contact information. Provide Attachment IV.2 of the RFP to your three references.
Include a brief narrative as to why you deem the reference to be relevant to this effort.
The CBP may also consider information obtained through other sources. Past performance information will be utilized to determine the quality of the vendor’s past performance as it relates to the probability of success for the required effort.
FACTOR 3: PRICE

The Government will evaluate the offerors’ price proposals to determine reasonableness. Prices that are determined to be either unreasonably high or unrealistically low in relation to Independent Government Cost Estimate may result in the overall proposal being considered unacceptable.
Section 6—Assumptions, Exceptions, and Deviations The offeror shall state all assumptions, exceptions, and deviations at the end of Volume I. For every instance where the offeror does not propose to comply with or agree to a requirement, the offeror shall propose an alternative and describe its reasoning therefore.
Volume II—Price Proposal
The offeror shall provide all price tables in Microsoft Excel 2003®. This volume shall consist of the sections as outlined and described below.
Section 1—Table of Contents and Priced CLIN Structure Tables
A clear table of contents with page numbers referenced shall be included. The CLIN Structure Tables will be included in this section with prices for each CLIN included. The CLIN Tables are Attachment IV.1 to the RFP.
Section 2—Solicitation/Contract/Order For Commercial Items
Standard Form 1449, Solicitation/Contract/Order for Commercial Items, (SF 1449) is being used for this solicitation. This form is used by the Government as a Request for Proposal and upon submission by the offeror it becomes the offeror's proposal. As such, it is an "offer" which can be unilaterally accepted by the Contracting Officer and awarded on said SF 1449. The offeror’s proposal and the Government's acceptance form the contract. Therefore, the following points must be strictly adhered to by the offeror in submitting the proposal:
(SF 1449) When completed and signed by the offeror, the SF 1449 constitutes the offeror's acceptance of the terms and conditions of the proposed contract. Therefore, the form must be executed by representatives of the offeror authorized to commit the offeror to contractual obligations.
Offerors shall sign the SF 1449 in Block #30.
Three (3) originally executed copies of Standard Form 1449 (with Blocks 12, 17,23, 24 & 30); and Section III.3 fully executed shall be submitted.
The SF 1449 must be executed by a representative of the offeror authorized to commit the offeror to contractual obligations. The authority to sign a proposal, but not an offer, subject to unilateral acceptance and award, is not sufficient authorization to sign the SF 1449.
UNDER NO CIRCUMSTANCES MAKE ALTERATIONS OR CHANGES TO THE SF 1449 OR THE
RELATED PAGES WHICH ARE A PART OF THE ENCLOSED REQUEST FOR PROPOSAL AND
PROPOSAL PACKET. Offerors are to complete those parts that require items such as prices, place of performance, etc., when such items are called for in the enclosed request for proposal. A place is provided to insert such information.

Section 4—Exceptions
Any exceptions taken with respect to the clauses in the solicitation shall be noted. For the purpose of facilitating discussions, for every instance where the offeror does not propose to comply with or agree to a requirement, the offeror shall propose an alternative and describe its reasoning therefore.

I.5 STATEMENT OF WORK
1.0 OBJECTIVE
The objective of this statement of work (SOW) is to obtain an effective and efficient Supply and Supply Chain Management (SSCM) solution for the Houlton Focus Area. The solution shall enable the successful provisioning of open market, commercial communications site equipment for the United States Customs and Border Protection (CBP) for various geographic locations within the CBP Houlton Focus Area1 within the State of Maine.

2.0 SCOPE
The purpose of this SOW is to describe the equipment that the Contractor will provide to CBP, associated with supplying and supply chain management of communication site equipment, shelters and materials needed for the modernization of CBP’s Land Mobile Radio (LMR) system in the Houlton Focus Area, within the State of Maine.
The Contractor shall provide all personnel, equipment, materials, supplies, travel and delivery logistics necessary to accomplish the tasks described herein.
1 Focus Areas follow the geographic boundaries of CBP Border Patrol sectors, but include the operations of Border Patrol, Field Operations, and Air & Marine.

3.0 APPLICABLE DOCUMENTS
All applicable documents within this SOW will be provided by the Government upon request and/or at the time of award, and are incorporated by reference.

4.0 TASKS
CBP operates LMR systems within the Houlton Focus Area in the State of Maine. The CBP Tactical Communications (TACCOM) Project Office has completed detailed designs for the modernization of LMR systems in this Focus Area. In order to implement this design, CBP needs communication site equipment to be acquired and delivered to locations within the Houlton Focus Area as indicated in Appendix A of this SOW.

PROJECT KICKOFF
The Contractor shall participate in a project kick-off meeting in the Washington, DC area within 14 calendar days of award with all involved parties to discuss specific aspects of the equipment provision.
The Project Kickoff Meeting will include both the Government and Contractor key project participants.
The Government and the Contractor will mutually agree upon the date, time, and location of the meeting.
The objectives of this meeting include:
• Introduce all project participants
• Review the roles of the project participants
• Review the overall project scope and objectives
• Review the integrated project schedule
• Review the Contractor-revised Bill of Materials (BOM)
The BOM shall detail the equipment and materials needed to meet the equipment provisions identified in Appendix A of this SOW.
EQUIPMENT AND MATERIALS PROVISION
The Contractor shall provide equipment and materials, including but not limited to:
• Equipment and materials, as identified in the BOM
• Delivery of equipment and materials to locations identified in the delivery schedule and Statement of Work.
• Quality assurance (QA) of the delivered equipment and materials through successful acceptance and transfer of equipment and materials, including manufacturers warranties, to the Government or its designee.
The Contractor shall perform the activities associated with acquiring and delivering equipment as follows:
Equipment and delivery: Acquisition of required equipment and materials. The Contractor shall provide supply chain management for all equipment and materials delivered under this SOW. The delivery points for the equipment and materials under this SOW are specified in Appendix A of this SOW.
Quality Assurance (QA) review: The Contractor shall follow a QA review process of all equipment and materials in accordance with its Quality Assurance Plan (as described in section 6.0 of this SOW) and will ensure compliance with industry and government best practices. All deliveries must be accompanied by the DHS acceptance form [DHS Form 700-21]. The Contractor shall resolve any deficiencies in the delivery of provided equipment and materials within thirty (30) calendar days upon notification by the http://www.tiaonline.org/standards/

Government. The Government will notify the Contractor within thirty (30) calendar days of delivery of unsatisfactory equipment and/or materials.
It should be noted that equipment and materials delivery to communication sites may require the use of high clearance trailers, and might not be accessible by “low boy” style trailers. The Contractor shall deliver the equipment and materials to some remote sites and is responsible for considering some remote site locations may not be accessible via improved roads. Site coordinates are provided in the Statement of Work.
It also should be noted that to deliver equipment and materials to some remote site locations may necessitate transshipping through Canada. Like Section 8.3 of this SOW, the Contractor shall be responsible for preparing the appropriate documentation to facilitate the exit from and re-entry to the United States of any equipment and materials that are transshipped through Canada. Likewise, the Contractor is responsible for adhering to any requirements of the Canadian Border Services Agency, including but not limited to preparing the appropriate documentation to facilitate the movement of any equipment and materials transshipped through Canada.
CONTRACTOR ACQUIRED PROPERTY MANAGEMENT
The Contractor shall provide the Government with a minimum of two (2) electronic copies and two (2) hard copies of the manufacturer documentation for all equipment and materials provided under this SOW.
This documentation shall include:
• Manufacturers’ Equipment Installation and Maintenance Manuals where applicable
• Manufacturers' documentation (including specifications and design limits)
• Commercial warranty information for all equipment and materials.
For the purposes of equipment and materials provision, acceptance is defined as the point where the COTR or their designee signs off on the completed DHS Form 700-21. For equipment and materials drop shipped to applicable sites in Appendix A, the Government will acknowledge receipt at time of delivery.
This does not imply acceptance by the Government, but it does initiate the thirty (30) calendar days for the Government to notify the Contractor of unsatisfactory equipment and/or materials. This task will be deemed complete when the Government (COTR or their designee) inspects the delivered equipment and materials and signs a Final DHS Form 700-21 Material Inspection Acceptance and Receiving Report.
All work performed by the Contractor will be inspected by the Government COTR or other Contracting Officer’s designated inspector for compliance, completion, and acceptance. The Contractor shall correct all noted discrepancies within thirty (30) calendar days after notification by the Government. In the event that inspections reveal noncompliance, the Government reserves the right to accept or reject Contractor materials. The Contractor shall correct all discrepancies that result in rejection as noted by the Government, at no additional cost to the Government.
Throughout the contract period, the government reserves the right to perform random inspections and/or to contract with other organizations to perform inspection services to ensure the Government’s interest is protected.
STATUS REPORTING
The Contractor shall submit monthly project status reports (PSRs) that summarize the Contractor's completed and planned activities as well as any anticipated project risks. Each PSR shall provide performance tracking and reporting, and a status toward completion of work in progress at the time of the PSR’s delivery. These PSRs shall include what has been bought, what has been shipped, what has been delivered, and what has been accepted by the Government or its designee. These PSRs should also contain open items (discrepancies) pending resolution for the purpose of follow-up actions to ensure that all problems are being tracked and addressed as specified. Upon request of the Government, the Contractor shall provide PSRs on a more frequent, mutually agreeable basis.
In addition, meetings/teleconferences will be held with the Contractor on an as-needed basis. Recent PSRs will be used during these meetings to guide the discussion.

5.0 DELIVERABLES
All materials and information developed or produced for this project, including but not limited to drawings, documents, presentations and databases are the property of the Government. At the conclusion of the project, all materials developed by the Contractor (to include all data, documents, work sheets and other working documentation) shall become the exclusive property of CBP.
The contractor shall successfully complete the tasks identified within this SOW. All equipment and materials described and/or required within this SOW shall be required deliverables.
Based on the tasks described within this SOW, and in addition to the required equipment and materials, the required deliverables for this project are shown in Table 5.1. Contractor format is acceptable for all deliverable items, unless otherwise specified.

6.0 QUALITY MANAGEMENT
6.1 QUALITY ASSURANCE PLAN
The Contractor shall produce and maintain a Quality Assurance Plan that describes the processes, procedures and controls that will be used to assure consistently high quality performance in the deliverables provided to the Government.
Within 30 calendar days after contract award, the Contractor shall submit for approval its Quality Assurance Plan, which shall be consistent with and further detail the approach contained in the

Contractor's proposal. The plan, as approved by the CO, and COTR shall be incorporated into the contract as a compliance document.
RISK MANAGEMENT PLAN
Any issues, risks, or changes identified during the course of performing this SOW shall be reported to the COTR in writing.
The Contractor shall produce and maintain a Risk Management Plan that describes the processes, procedures and controls that will be used to identify, characterize and mitigate risks associated with the Contractor’s efforts to successfully provide the deliverables described within this SOW.
Within 30 calendar days after contract award, the Contractor shall submit for approval its Risk Management Plan, which shall be consistent with and further detail the approach contained in the Contractor's proposal. The plan, as approved by the CO, and COTR shall be incorporated into the contract as a compliance document.
At a minimum, the Contractor’s Risk Management Plan shall cover the following aspects of addressing risks:
• Identify and document;
• Assess impact and prioritize;
• Assign responsibility;
• Monitor and report progress;
• Communicate issue resolution.
A mutually agreed issue escalation process will be defined at the outset of project, and shall be included in the Contractor’s Risk Management Plan.
7.0 SECURITY REQUIREMENTS
The Contractor shall comply with Government administrative, physical and technical security controls to ensure that the Federal Government’s security requirements are met. During the course of this task, the Contractor shall not use, disclose, or reproduce data, which bears a restrictive legend, other than as required in the performance of this work associated with this SOW. The Contractor and its personnel shall be required to sign a non-disclosure agreement prior to working on this task.
Contractors hired for work within the United States or its territories and possessions, and who require access to Government owned or controlled facilities, information systems, security items or products and/or sensitive but unclassified information shall either be U.S. Citizens or have lawful permanent resident status.
Contractor staff supporting this project (including staff from any and all subcontractors used on the effort) shall be U.S. Citizens, or have lawful permanent resident status, and shall be free of criminal convictions.
8.0 GENERAL REQUIREMENTS

Any other day designated by Federal statute, by Executive Order or by the President’s proclamation.
When any such day falls on a Saturday the preceding Friday is observed. When any such day falls on a Sunday, the following Monday is observed. Observance of such days by Government personnel shall not be cause for an extension to the delivery schedule or period of performance or adjustment to the price, except as set forth in the task order.
Except for designated around-the-clock or emergency operations, the Contractor personnel will be, without written consent from the COTR, unable to perform on site under this task order with CBP on the holidays set forth above.
In the event CBP grants administrative leave to its Government employees, at the site, on-site Contractor personnel shall also be dismissed if the site is being closed, however, the Contractor shall continue to provide sufficient personnel to perform around-the-clock requirements of critical efforts already in progress or scheduled and shall be guided by the instructions issued by the CO or her/his duly appointed representative.
TRAVEL
Government transportation of Contractor personnel via Government vehicles to and from existing and proposed RF sites is not authorized. Therefore, the Contractor is required to pre-coordinate all travel related activities in advance to mitigate project delays. The Contractor will be responsible for identifying and securing its own mode of transportation, separate from the Government. The Contractor shall take all reasonable safety precautions when traveling to and visiting RF sites or other sites of interest and will arrange for directions and access. The Contractor shall also be responsible to ensure that means of transportation adequate for the size of the party is available on time per the project schedule.
Since access to some of the applicable sites listed in Appendix A will necessitate entry into Canada and re-entry into the U.S., Contractor staff delivering equipment and materials or performing work at any of the applicable sites listed in Appendix A (including staff from any and all subcontractors used) shall hold personal identification document(s) for entry into Canada and re-entry into the U.S. that comply with the Western Hemisphere Travel Initiative .

APPENDIX A EQUIPMENT REQUIREMENTS
All equipment shall be "Free on Board" (FOB) to the destination points within the Houlton Focus Area, as indicated in the table below. Delivery of items such as equipment enclosures, towers and generators will be coordinated to achieve "Just In Time" (JIT) delivery to designated construction staging locations for the corresponding sites. Specific delivery locations will be reviewed during the project kickoff.
The information provided in this appendix is organized as follows:
• Table 1 provides a list of sites, including the site name and site coordinates (latitude and longitude) for the locations where equipment will be delivered under this SOW.
• Table 2 provides summary quantities and descriptions for the equipment required within this SOW. Also provided in table 1 is a reference to an attachment file (attachments A through X, and attachment Z) that contains the detailed specifications for each item type in the table.
• Attachment Y contains the detailed equipment and delivery schedule requirements for each site.

(d) (1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to--
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than--
