QUESTIONS AND RESPONSES
HQ023618R0004-0001
Offeror Questions and Government Responses.
1. Regarding Addendum to Provision 52.212-1, can DSCA confirm that a smaller font will be allowed for text boxes, tables, and graphics?
Government Response: No. In accordance with the instructions in Addendum to Provision 52.212-1, Volume I shall be typed in 12 point, Times New Roman font.
2. Regarding Addendum to Provision 52.212-1, can DCSA confirm that a cover page, Table of Contents, Acronyms list, and CVs are not counted in the specified page limits?
Government Response: The maximum numbers of pages for Factors 1, 2, and 3 are stated in Addendum to Provision 52.212-1, and the only exception is for Curriculum Vitae (CV)/Resumes in Factor 1.
3. Regarding Section 1.7.2 Identification of Contractor Employees, can DSCA confirm that they will clarify the process for obtaining the correct ID and CAC card upon award?
Government Response: PWS Section 1.7.2. only refers to the identification badge to be worn by Contractor employees, and to be provided by the Contractor. This section does NOT refer to the Common Access Card (CAC); PWS Section 3.6 contains all requirements and instructions for the CAC.
4. In Quote Submission Requirements, Factor 1 Staffing Plan (page 56), DSCA specifies that the Offeror can submit up to four Curriculum Vitae of proposed personnel. Can DSCA confirm that these four CVs are comprised of two CVs for proposed personnel and two CVs of potential substitutions?
Government Response: In accordance with the Factor 1 Submission Requirements, historically these services have been provided by 2 personnel. Offerors may submit up to 4 CV/resumes, and the intended service to be performed shall be specified, along with the availability of all proposed personnel. Beyond these requirements, if an Offeror chooses to recommend primary and alternates among the proposed personnel, this is the Offeror’s business decision.
5. In Quote Submission Requirements, Factor 4 Past Performance (page 57), DSCA specifies that the Offeror shall provide the Government’s Past Performance Questionnaire to each reference who will provide a return submission to the CO. Can DSCA clarify if there is a deadline for this?
Government Response: Solicitation page 1, Block 8 states the “offer due date/local time”. This is the due date/time for all elements of the offer.
6. Regarding Addendum to Provision 52.212-1, can DSCA clarify if the Offeror can also submit a word document of budget notes, in addition to the requested excel document?
Government Response: As long as factor submission requirements and page limitations are followed in accordance with Addendum to Provision 52.212-1, it is the Offeror’s business decision on what additional information to provide which may assist the Government’s technical evaluation.
7. In Section 1.6.4.2, DSCA specifies that an optional travel CLIN with a not-to-exceed amount will be provided, however this amount is not included in the budget template attachment. Can DSCA confirm that this NTE amount will be added to the contract after award and that the Offeror should not provide an estimated budget for travel in our proposal?
Government Response: Yes. As stated in the travel Contract Line Items (CLINs) 0003, 1003, 2003, 3003, 4003, the Government will insert a not-to-exceed (NTE) amount at time of award. Offerors shall not provide a travel estimate in the Solicitation attachment Pricing Proposal – Part II Excel spreadsheet, which only allows the pricing for services to be filled in.
8. Can DSCA confirm if the NTE amount for figure given for Travel is exclusive or inclusive of the Contractor’s indirect costs and profit?
Government Response: Exclusive; Contractor’s indirect costs and profit are NOT allowed under the not-to-exceed travel CLINs. As stated in PWS section 1.6, each NTE CLIN is for travel, and all travel is in accordance with FAR 31.205-46.
9. Is there an incumbent contract or contractor associated to the requirement? If any, please provide the contractor's name and contract number. Thank you.
Government Response: Solicitation HQ023618R0004 is a follow-on requirement for two (2) current contract actions.
HQ023618R0004 CLIN 0001 Operations Staff Specialist Services: HQ0236- 15-P-0009, contractor TechTrans International Inc., Houston, Texas.
HQ023618R0004 CLIN 0002 Program Management Assistance Services:
HQ0236-15-P-0008, contractor SB Security Governance Group Limited, Ontario, Canada.
10. Will there be just one contract awarded or two?
Government Response: As stated in Addendum to Provision 52.212-2, the Government will award one
(1) contract as a result of this solicitation.
11. Would the government consider awarding the contract to a local vendor (German registered company) who meets all the requirements, and legal stipulations referenced in the solicitation and is therefore in compliance with the US Federal Acquisition Regulations as well as any supplements that may be applicable to this procurement?
Government Response: As stated in Provision 52.212-2 and the Addendum to this provision, the Government will award to a responsible contractor, who meets all requirements of the Solicitation. This is not limited to Offerors from any particular country. Offerors shall note, in addition to all stated requirements, per clause 52.204-7 a prospective awardee shall be registered in the System for Award (SAM) database prior to award.
12. Paragraph 1.6.1: The pre-solicitation states that during non-resident events, “The Government will provide office space for Contractor to complete routine tasks related to events IAW 6.0. Government Furnished Property and Services.” Does this also include appropriate office materials to perform required tasks (computer, office supplies, printer, etc.)? If not, is the contractor required to provide?
Government Response: PWS Part 3 provides a description of all Government furnished equipment and property.
13. Paragraph 1.6.1: The pre-solicitation states that events may occur at resident (Garmisch-Partenkirchen) and non-resident locations. Is it possible that two events can occur at the same time in two different locations and if so, are contracted personnel representatives required to be at each?
Government Response: It is possible that more than one event may occur at the same time. However, as stated in PWS section 1.6.4. the Government will provide notice to the Contractor at least 14 days prior to an event, and travel is not to exceed the amount specified in the Travel CLIN.
14. Paragraph 1.6.2 and 1.7.0: The pre-solicitation states that contracted personnel are required to work an average of 1,920 hours in the year. However, it also states in paragraph 1.7.0 that individuals under the Host Nation system are eligible for employment. German labor laws require full time personnel to receive 20 days of paid vacation per year and German holidays off. This means any full-time employee under the German system will not meet 1,920 hours. Will the government accept two part-time individuals, each working an average of 20 hours per week, to fill a full-time position?
Government Response: As stated in PWS section 1.6.2. the estimated annual hours are 1,920, and contractor personnel can expect to work an average 40 hours per week. Therefore, 1,920 annual hours divided by 40 hours per week results in 48 working weeks. This leaves 4 non-working weeks (52 weeks minus 48 weeks), which is 20 non-working days per year.
15. Paragraph 1.11: The pre-solicitation states that the Government will not provide logistical support such as housing, transportation, meals, and incidentals for any Contractor employees performing under this contract. Does this also mean that the individuals employed under this contract do not have SOFA status?
If so, does that also include times when the individuals are performing duties outside of Germany and what legal protections do they have?
Government Response: Contractor employees are not accorded Status of Forces Agreement (SOFA) status under this contract. During performance of this contract, any legal protections for contractor employees are those provided by the Contractor and/or those accorded to a citizen of the contractor employee’s country of origin.
Further Questions: As stated in Addendum to Provision 52.212-1, any questions submitted less than eight days prior to the close of the solicitation may not receive a response. Per Amendment Block 14, there is no change to the Offer due date 11:00 pm local time on 3 Sep 2018, which is seven days from the date of this Amendment.
Therefore, Offerors may submit further questions, but these questions may not receive a response.
