Number Sequence
RFP Section Questions/Comments Responses/Answers
RFP-0108 Tab 1D:
Technical Data and Computer Software Rights
(TS1)
The Technical Data and Computer Software Rights volume was moved under the Technical Volume when the Final RFP was released. The movement of this section now makes it classified. It is believed that the intent to is to instead keep this section unclassified. Would the Government confirm that the Technical Data and Computer Software Rights Tab 1D Attachments 1 and 2 should remain unclassified as a separate submitted unclassified attachment rather than be incorporated into the single Technical Volume document required in Line 836?
Volume II, Tab 1D Attachments 1 and 2 shall be properly marked in accordance with the DD Form 254 and the DoD 5220.22M NISPOM.
Unclassified paragraphs, pages, and Attachments may be included within the Technical Volume using the referenced marking instructions.
RFP-0109 Model Contract 52.211-11
It is understood that the liquidated damages rate is to be used as a "reasonable forecast of just compensation for the harm that is caused by late delivery or untimely performance". The Government does not contemplate providing the liquidated damages rate calculation.
RFP-0110 RFP Would the Government consider Performance Based Payments? The Government will consider modifying the contract after award with the successful offeror to use Performance Based Payments.
