Contract Security Guards

Question Question Answer

Reference: Performance Work Statement, Section C, subsection 4.1.7, page 4 of 101, states the following: The Contractor shall provide the necessary certified training personnel, space, and facilities to accomplish this requirement. Documentation will require the signature of the training officer as well as the officer performing the test. Question: There are no other mentions related to a Training Officer in the solicitation. Is the Training Officer a contractor provided position and is this a contract-dedicated position required under the solicitation?

ANSWER: The Training Officer is a contractor provided position, but not necessarily dedicated to the contract.

Reference: Performance Work Statement, Section C, subsection 4.4.9, page 8 of 101, requires the contractor to perform the following: Provide continuous random roving patrols for monitoring security and building safety, including relief personnel to ensure assigned fixed and roving posts are covered at all times.

Attachment B, Section 6.2.2 stipulates that Supervisors, roving patrol personnel and relief officers can be used to conduct breaks.

Question A: Will the government clarify which of these two differing solicitation stipulations are correct? Are contractors required to provide dedicated relief CSOs for all non-supervisory posts identified on Attachment A?

Question B: May roving positions self-relieve, or must a contract-assigned, dedicated relief CSO provide the roving CSOs with relief?

ANSWER A: The statements aren't meant to conflict with each other. When the non-static posts, i.e., rovers and supervisors aren't performing breaks, they are to be in a mobile state to monitor security. ANSWER B: Self-relief is permissible as long as the person relieved is able to answer an emergency call when on break.

3 Reference: Performance Work Statement, Section C, subsection 8.0, page 14 of 101, identifies Contract Transition activities. Question: What is the period of transition time for Phase-In? ANSWER: 1 NOV 2016 - 30 NOV 2016

Reference: Performance Work Statement, Instructions to Offerors subsection III, page 87 of 101, stipulates that the Management Approach is limited to 50 pages. A component of the Management Approach are resumes for Key Personnel. Question: Are the resumes for Key Personnel (which may be as many as 47) included or excluded from the 50-page limitation?

ANSWER: Resumes are not included in the page count for the Management Approach Volume II. The instructions have been revised. Section 7.0 Key Personnel has been revised.

Reference:

Performance Work Statement, Instructions to Offerors subsection III, page 89 of 101, states the following: Provide resumes of the key personnel identified in paragraph 7.0 of the PWS that demonstrate how the personnel meet the minimum requirements in paragraphs 7.1.1 through 7.1.3.6, and include the following information as applicable. Section 7.0 states: The Program Manager, Quality Control Manager, and the CSO Supervisors are key personnel under this contract. Question: Working as contract employees on a federal government contract, the incumbent Supervisors typically have first right of refusal. As such, awardees may be obligated by law to hire qualified incumbent supervisors, thereby placing them in violation of the requirements under this solicitation to provide proposed key personnel for a period of 180 days at a minimum following Government approval of their resumes (Section 7.0). Additionally, depending on offeror’s staffing approaches this may represent as many as 45 supervisory resumes, placing a significant burden on any new offeror and giving the incumbent contractor a significant and unfair advantage.

This very issue was subject to protest under a prior solicitation for the United States Holocaust Museum (Protest File B311331), resulting in the requirement to submit resumes for Shift and Field Supervisors being removed from that RFP. Typically, the Shift and Field Supervisors are afforded the first right of refusal under FAR Clause 52.222-17.

In requiring proposers to include new resumes, it is implied that the current supervisors would be displaced.

A. What is the PFPA‘s intent in potentially displacing the entire supervisory force?

B. Will the Government revise this language to require offerors to provide resumes for the Program Manager and Quality Control Manager and not the supervisors?

ANSWER A: PFPA has no intention of displacing guards. Reference 52.207-3 of Section I, Contract Clauses and PWS section 8.1.4 per 29 CFR 471.

ANSWER B: Resumes are required for the Program Manager (PM) and the Quality Control Manager (QCM). NOTE:

The PWS sections 4.4, 7.0, and H.8.1 have been revised where it pertains to Key Personnel.

Reference: Performance Work Statement, Instructions to Offerors subsection III, page 90 of 101, requires the following to be included in the resumes of Key Persons: Program management certificate number and scanned copy of the actual current certificate. Question:

As there are no requirements identified within section 7.0 as it relates to such certificates for Key Persons, will the government clarify this requirement?

ANSWER: Program Management Certificate is unnecessary. This requirement was removed from the solicitation.

Reference: Attachment A, page 1 of 3, identifies two Transition Manager positions posted between the hours of 0700-1500, Monday through Friday. Question: Is the Transition Manager required to be on-site at the DOD-designated facilities each day, Monday through Friday between these hours?

ANSWER: No, the Transition Manager is not required to be on-site at the DoD designated facility(ies) Monday - Friday between 0700-1500. The Transition Manager may need to be mobile and perform their duties outside of these hours. These hours have been established for payment cap purposes only.

Attachment A has been revised to remove the 0700-1500 and replaces it with 40 hours per week.

Reference: Attachment C, provides the PFPA Contract Security Officer (CSO) Medical Standards Overview. Question: Do all incumbent personnel meet the medical standards of the new contract?

ANSWER: All current contract security officers meet the medical standards in Attachment C.

Reference: Attachment M.1, is the current Collective Bargaining Agreement (CBA) and includes pay rates for all Armed Officers assigned to the contract. Supervisors are not included as employee members of the CBA. Question: Will the government provide the pay rates and all benefits currently being given to the supervisors on this contract?

ANSWER: The supervisors on the current contract are not part of the CBA, therefore, the Government does not have this information.

Reference: ADMINISTRATIVE (VOLUME I) Insurance Requirement: As stated in Section

12.0 of the PWS, offerors are required to submit proof of securing insurance. Question: Please clarify who, the prime alone or both the prime and the subcontractor, is required to submit proof of securing insurance

ANSWER: See clause 52.228-5, The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors’ proofs of required insurance, and shall make copies available to the Contracting Officer upon request. Both the Prime and Subcontractor must provide proof of insurance.

11 Reference: Section B Question: Is the incumbent personnel trained to the standards specified in the RFP?

ANSWER: Yes, but will need refresher training. See section 5.2.2 of attachment B for refresher training requirements.

Reference: Section B Training: This section outlines the training requirements for this contract.

Question A: Are the training requirements outlined in the solicitation new or are the required for the existing contract? Question B: If any of the training is new, please specify what portion of the required training is new or not currently performed on the existing contract?

ANSWE : The Active Shooter Response Training (See Section 5.8 of Attachment B) is new and is not a requirement of the current contract. All other training is required under the current contract.

13 Reference: Section 6 – Administration 6.1 discusses Gear-up and Gear-down. Question: What are the Gear-up and Gear-down requirements for this contract?

Reference: Section B part 4.2.2., page 5 of 101, states the following: Subtask 2 - Annual Training. In addition to the annual training identified in the standards documents, each CSO through the Project Manager and Contractors Quality Control Manager and Training Personnel will be required to attend up to twenty (20) hours per calendar year of Government furnished Training/Briefing at no additional cost to the Government. The Contractor is expected to employ personnel with the requisite skills to perform the requirements of this contract.

Therefore, the Government will not reimburse those costs associated with the training of Contractor personnel in any effort to initially attain or maintain the requirements of this contract. Question: Under the FLSA, contractors will be required to pay the CSO an additional twenty hours per year for attending the training mentioned above in addition to other training requirements. Would the government please clarify how the offeror will be reimbursed for payroll expenses that will be incurred as a result of each CSO having to attend the additional training mentioned above?

ANSWER: The vendor may include any expenses incurred as part of their fully burdened labor rate, which will be evaluated in accordance with the evaluation criteria outlined in the solicitation.

Reference: Section B part 4.3.3.3, page 6 of 101, states the following: The QCP shall clearly show how the Contractor will provide a surge force of 50% of normal staffing within 90 minutes, while maintaining the integrity and quality of the permanently assigned posts.

Question: Would the government please provide historical data on frequency of surge force on this contract?

ANSWER: This information does not exist as the Government has not had a need to exercise the surge requirement under the current contract.

Reference: Section B part 5.5, page 10 of 101, states the following: Surge ceiling is provided at 25% above the contract value per year. Reference: Attachment K – Pricing Matrix states the following in cell B31: Surge – FFP (Not to exceed value up to 25% of Sub-clins 1001-1010) Refer to Section 5.0 of the Performance Work Statement. Question: Section B states a ceiling at 25% above the contract value per year, whereas Attachment K provides a Not to Exceed value up to 25%. Please clarify whether this item is intended as a plug value of 25% of the sub- CLINs or whether bidders may enter a lower price?

ANSWER: The 25% is a plug value. Vendors may not enter a lower price.

Surge, if utilized, is limited to 25% of the total of each year, excluding transition and the Temporary Additional Service (TAS) Posts. Surge is not considered a CLIN and will not be included in the price evaluation.

Reference: Section B part 4.4.8, page 8 of 101, states the following: Whenever hazardous conditions are discovered, the Contractor shall make every reasonable effort to immediately warn the public of these conditions by placing traffic cones, warning signs, blockades, security tapes, and other warning signs as needed at the site. Question: Would the government please confirm whether the warning signs mentioned (traffic cones, warning signs, blockages, and security tapes) are government provided or contractor provided? If contractor provided, would the government please clarify how many of these items will be required?

ANSWER: The Government will provide this equipment as Government Furnished Equipment (GFE)

Reference: Section B part 4.4.9, page 8 of 101, states the following: Provide continuous random roving patrols for monitoring security and building safety, including relief personnel to ensure assigned fixed and roving posts are covered at all times. Question: Would the government please confirm that these roving patrols are only located at the CLINs with roving posts specified in Attachment A, CLINs 0004, 0008, and 0011? Question: Would the government please confirm if all posts require relief?

ANSWER A: Yes, however, all supervisors are considered mobile posts in addition to CLIN 0004, 0008, and 0011. ANSWER B:

Yes, all posts require relief. Supervisors and Rovers can self relief.

Reference: Section B part 4.4.12, page 8 of 101, states the following: Provide information and assistance to authorized visitors, guests, and DoD employees. Also, provide escorts for individuals in possession of items that require protection for which the safety of the individual and property is of concern. Reference: Attachment A – Security Post Matrix, Reference: Attachment K – Pricing Matrix Question: CLINs 0001 through 00013 in Attachment A and Attachment K have discrepancies between the two documents (for example, CLIN 0001 is Transition in Attachment A, whereas the transition is CLIN 0013 in Attachment K). Would the government please confirm which CLIN structure should be utilized by bidders?

ANSWER: Attachment K is correct. Attachment A has been revised.

Reference – Clearance information. Question: When the SBA has approved a Mentor-Protégé team where both the Mentor and Protégé are cleared, will PFPA accept the proposal and sponsor the JV for clearance after award?

ANSWER: Per PWS Section 10.2.6. The Contractor shall hold, at a minimum, a final Secret Facility Clearance (FCL) as granted by the DSS, Facility Clearance Branch (FCB) by the start date of the contract. PFPA will not sponsor potential offerors or their employees for Facility Security Clearances.

The solicitation sections 10.2.6, H.1.c, 52.212-1(I)(a), 52.212-2(a)(8)(g) have been revised.

Reference: RFP pg. 1 ii, Section ii states the solicitation number is HQ00034-16-R-0204.

35 Is the Supervisor/ Response position at National Center II the same as the Supervisor for National Center III?

ANSWER: National Center (NC) II and III are separate buildings only because they have different addresses. The Govt considers them as one large building for CSO purposes. The NC-II Supervisor/Response(Post 5) handles calls for NC-II as a response element, but supervises both NC-II and III. The NC-III Screener/Response (Post 3) screens visitors, but handles calls for NC-III as their response element. There is 1 supervisor for both buildings and a response elements in each building that are separate. Attachment A has been revised to reflect supervisor area of responsibility

Currently the RFP asks for past performance summaries from only the prime contractor.

Because this procurement is an 8(a) set-aside, where large company subcontractors are common, it would appear that significant past performance information from major subcontractors would be a key indicator of overall team performance, and should be included in the government’s evaluation. Will the Government accept performance summaries from both prime contractors and major subcontractors?

ANSWER: Section M, 52.212-2(a)(11)(c). The Government will NOT evaluate past performance performed by proposed subcontractors. (Pg 98)

Can the government provide the current seniority lists for incumbent bargaining unit personnel in order that we may correctly calculate leave costs? Currently, the only bidder with accurate information is the incumbent.

ANSWER: The current contract was awarded November 2015. It is unknown to the Government if personnel have seniority.

38 Are CSOs that monitor CCTV and Intrusion Alarms in the Security Ops Center required to be armed? ANSWER: Yes--there are no unarmed posts on this contract.

39 Are all the incumbent personnel current on their training and medical qualifications? Does their training and medical status meet the requirements for the new contract?”

ANSWER: For training, all CSO's would need refresher training and all would need the active shooter response training. For medical, all personnel are current on medical requirements that are working on the current contract.

40 Recognizing that the Program Manager will circulate among the various sites, does the Government have a preference for where his/her base location will be? ANSWER: No

The existing CBA provides for a 15 minute gear up and 15 minute gear down for each CSO shift. Will this be a requirement under this RFP? Is walk time included in that time or as that additional?

ANSWER: Yes gear up and down is part of this RFP under Attachment B, Section 6. Walk time is included in that time. Attachment B, Section 6 has been revised for clarity.

The first page of the RFP identifies the procurement number as HQ00034-16-R-0204 (3 leading zeros). However, other citations in the document and Fed Biz Ops uses HQ0034-16-R- 0204 (2 leading zeros). Which is correct?

ANSWER: The correct solicitation number is HQ0034-16-R-0204. The pg 1 of the solicitation has been revised.

43 The Security Post Matrix shows Transition Managers for the period of November 1 to November 30, 2016. Is this the entire transition period? ANSWER: Yes

The proposal requires resumes for the Program Manager, Quality Control Manager, and CSO Supervisors. Because the CSO Supervisors are 24 hour posts, and because there are 10 locations, that will require in excess of 40 personnel to be CSO Supervisors. This provision favors the incumbent provider as they presumably already have staff in all these positions.

Would the Government consider a sampling of 5-6 resumes to fill these Supervisor positions, plus resumes for the PM and QCM?

ANSWER: FAR 52.222-17 Nondisplacement of Qualified Workers is listed in section I - Contract Clauses. All qualified staff should be offered a first right of refusal of employment. Resumes for personnel already working on the contract are not required. CSO Supervisor resumes are not required. See PWS section

7.0 for revised resume requirements.

Reference: Performance Work Statement, Section F, identifies CLIN 0013 as having a period of performance from 01-NOV-2016 to 30-NOV-2016. Attachment A reflects CLIN 0013 as being a Surge CLIN “To be used for Temporary Additional Service (TAS) Posting.”

Attachment K reflects CLIN 0013 as being representative of a Transition line item. Question:

Will the government provide clarity on which line items CLIN 0013 is assigned to?

ANSWER: Attachment A has been revised. CLIN0011 is the TAS CLIN with a limit of $3000 per year. CLIN0013 is assigned to the transition. Attachment K has the TAS CLIN as 0011. Attachment K is not being revised.

Reference: Attachment A, CLIN 0007, includes a site-designated Relief/Response position.

Question: Does this Relief/Response position provide all breaks for non-supervisory positions at the Defense Headquarters Health Headquarters (DHHQ) facility?

ANSWER: No, the relief/response position cannot provide all breaks for non-supervisory positions at DHHQ. Additional personnel may need to assist with this requirement.

Reference: Attachment B, section 5.5.1, requires the following, “To be eligible to perform under this contract, armed security personnel shall successfully complete 90 hours of basic training, which includes a minimum of 40 hours of firearms training; a minimum of 12 hours of semi-annual weapons qualification; and weapons handling safety procedures.” The number of hours accounted for under Initial Training amounts to 82 hours. Question 1: Will the government provide guidance on the remaining 8 hours of unaccounted training time required within the 90-hour Initial Training iteration? Question 2: Does the 12 hours of semi-annual weapons qualification account for both qualification periods combined (i.e. two qualification periods at six hours each), or does this account for two 12-hour qualification periods?

ANSWER 1: The Government will increase the number of DoD training by 8 hours to make up the difference. ANSWER 2: No. The training requirements in paragraph 5.5.1. identify INITIAL training and the training requirements in paragraph 5.6. identify ANNUAL RECERTIFICATION (refresher) training requirements.

Reference: Attachment K, includes line items for “Surge – FFP” with the following note, “Not to exceed value up to 25% of Subclins 0001-0010”. While the spreadsheet does not allow offerors to make entries for quantity, unit of issue, and unit price, the “Total Amount” block is open for entries. Question: Since the number and frequency of surge incidents is unknown, will the government provide guidance on how offerors are to account for costs related to such activities in the Total Amount block?

ANSWER: The 25% is a plug value. Vendors may not enter a lower price.

Surge, if utilized, is limited to 25% of the total of each year, excluding transition and the Temporary Additional Service (TAS) Posts. Surge is not considered a CLIN and will not be included in the price evaluation.

Reference: Attachment K, includes line items for “Manpower Reporting – FFP”. While the spreadsheet does not allow offerors to make entries for quantity or unit of issue, both the “Unit Price” and “Total Amount” blocks is open for entries. Question: Will the government provide guidance on how offerors are to account for costs related to Manpower Reporting?

ANSWER: For information on this requirement, please go to:

https://dodcmra.hqda.pentagon.mil/Login.aspx It is at the offerors discretion to charge for this reporting requirement.

50 Please clarify section 4.5.1: Are CSO's authorized to leave their post to engage an active shooter in the facility?

Part B: Attachment L Performance Questionnaire has a requested submission date of June 30. Please confirm that this document is not due until July 11th.

ANSWER: The Attachment L, Performance Questionnaire has been revised to "July 11".

52 Please confirm that CPARS cannot be used as substitution for Attachment L Performance Questionnaire.

ANSWER: 52.212-1(9)(IV)(a) The offeror shall provide at least three (3) but no more than five (5) past performance projects that reflect recent and relevant past performance where the offeror served as the prime or 1st tier subcontractor. (3) For each project submitted, the offeror shall also ensure a questionnaire (reference Attachment L) has been completed by the cognizant evaluator. Submitted projects without a corresponding questionnaire will not be evaluated. CPARS cannot be used as a substitution.

53 Please confirm that that Attachment L Performance Questionnaire is not included in the 20-page limit for Volume IV Factor 3: Past Performance.

ANSWER: The performance questionnaire required at 52.212-1 is not included in the 20 page limit for Volume IV.

Please clarify, Volume I – Administrative Item G pass / fail requirements – Facility Clearance.

Can the contractor apply with an active interim secret facility clearance? Our company has previously been sponsored and is currently engaged in the clearance process.

ANSWER: Per PWS Section 10.2.6. The Contractor shall hold, at a minimum, an interim Secret Facility Clearance at proposal submission and a final Secret Facility Clearance (FCL) as granted by the DSS, Facility Clearance Branch (FCB) by the start date of the contract. PFPA will not sponsor potential offerors or their employees for Facility Security Clearances. The solicitation sections 10.2.6, H.1.c, 52.212-1(I)(a), 52.212-2(a)(8)(g) have been revised.

Attachment B Section 5.6 states that weapons certifications occur semiannually, and shall consist of at least 40 hours of recertification training in each 12 month period.

Would the Government please clarify:

a. Which training modules constitute the 90 hours referred to in Section 5.5.1?

b. How are we to interpret the 12 hours of weapons requalification semi-annually in Section

5.5.1 vis-à-vis the 40 hours every 12 months in Section 5.6. ?

Answer 1: The Government will increase the number of DoD training by 8 hours to make up the difference (90 hrs. vs. 82 hrs.). Answer 2(a): 90 training hours is in paragraphs 5.5.3. through 5.5.3.10.1. (DCJS requirements) and paragraphs 5.5.3.2. through 5.5.3.2.34. (DoD requirements). Paragraph 5.5.1.

identifies INITIAL training and paragraph 5.6. identifies ANNUAL RECERTIFICATION (refresher) training.
