QUESTIONS & ANSWERS

SECTION SF 30 – BLOCK 14 CONTINUATION PAGE

AMENDMENT 0004

A. Questions & Answers regarding this solicitation.

Q8: According to our Project Manager who attended the site visit at Lanham Elementary School on 11 March, a request was made during the site visit by the school to replace the fence surrounding the playground indicated as the seed bid, this fence is not currently part of the scope of work for this project, should we include replacement of the fence in our bid for this project and if so what are the requirements for the fence?

A8: Yes; see attached revised scope of work for Lanham ES.

Q9: According to amendment 1 page 14 under the requirements for Area 1 there is a statement, “Include picnic area with cover and trike track”, what type of cover is required? would this be a permanent cover or a removable cover? Is there a specific wind load requirement for the cover and if so what would that be?

A9: Amended Sheet 2 of 5 Area 1: The cover is currently plastic panels and require replacement of same or equal new material. This is a permanent cover.

The current material is not wind loaded. Typhoons occur in Okinawa and should be a recommended consideration.

Q10: A question was raised if rubber tile or poured-in-place surfacing would be required, this is very important and will have a major affect on cost because the labor cost for poured-in-place is much higher than rubber tile. Which will be required for this solicitation and will it be the same for all future task orders?

A10: Amended Sheet 2 and 3 of 5: Indicate Softile Kroslock safety tiles and specs has been added.

Q11: According to the drawings for area 2 two swing sets are to be removed however there are also wooden playground equipment in the area should this wooden equipment also be removed?

A11: Amended Sheet 5 of 5 has indicated 11 wooden playground equipment to be removed. This additional space can be used to incorporate the 2 new swing sets

Q12: Does the proposal(s) have to be in Korean or Japanese currency?

A12: The Price Proposal should be in Japanese Yen. If the offeror proposes in U.S. dollars, the Government’s budget rate for Japan will be applied to calculate the Yen equivalent value when evaluating proposed prices.

Q13: Can military transportation thru regular transportation channels be arranged as we are used it at the moment?

A13: Transportation of equipment is up to the contractor. The contractor must meet the delivery schedule set regardless of what transportation is used.

Q14: The U.S. Government is tax exempt in Japan also, right?

A14: Yes, see Tax Exempt language stated in Section A of the Solicition.

Q15: Can pour-in surface be used, or is it limited to tiles?

A15: No, See A10. Amended Sheet 2 and 3 of 5: Indicate Softile Kroslock safety tiles and specs has been added.

Q16: Has the proposal to be in hard copy, or is e-mail sufficient?

A16: The proposals must be sent by electronic mail AND regular mail.

Q17: In the SOW page 14 of 30 it states, that 1 copy has to be provided to the facilitiy engineers?

A17: All site designs need to be sent directly to the contract specialist, Robin Boyd, for the seed projects in connection with this solicitation.

Q18: Covers for the sure start, in what extend?

A18: See A9. Cover should match existing with new material.

Q19: On page 14 of 30, it states that Area 3 only the equipment should be removed…..

no further action?

A19: Amended sheet 4 of 5: 2 swing equipment are removed and holes should be filled and replaced with matching tiles.

Q20: Design policy was indifinite until today's site visit. We need at least 2~3 weeks to design. (We may be need more time depend on Amendment)?

A20: The proposal submission deadline was extended to 26 March 2010.

Q21: Amendment 0001 Page 14 of 30 "Note: Area1: Include picnic area with cover and Trike track." Does Cover mean GAZEBO??

A21: See A9. Match existing material with new material.

Q22: Amendment 0001 Page 14 of 30 "Do not replace House or store". Is that mean leave the House and store?

A22: Amended Sheet 2 of 5: Remove old House and store panel.

Q23: Please indicate number of seats for the swing, Quantity and Age group?

A23: This is provided in Attachment 2 and sheet 2 of 5 with model number of BigToys IS3-10. total 12 seats (2 swing sets 6 seats each)

Q24: Will you please indicate the playground type and quantity for ZUKERAN ES like

LANHAM ES?

A24: Same or equal in the catalog cut for Burk Cyber Catalog Structure Model 1383 (CPB-1383) or PlayMart WINSTON mini play systems.

Q25: In which phase, request from USER (School) will be heard and be reflected in design? Is it after the project be awarded?

A25: Yes, after each task order is awarded, and this would apply to either color approval or tile design.

Q26: Amendment 0001 Page 14 of 30 "Note: Area1: Include picnic area with cover and Trike track." Does Cover mean GAZEBO??

A26: See A9. Match existing material with new material.

Q27: Amendment 0001 Page 14 of 30 "Do not replace House or store". Is that mean leave the House and store?

A27: See A22. Amended Sheet 2 of 5: Remove old House and store panel.

Q28: On some of the Section B line items, ‘maintenance’ is mentioned on the title and description. What does maintenance entail? Are there set maintenance requirements?

A28: No, there are no established maintenance requirements or schedules.

Maintenance requirement(s) will be specified in the task order issued against the contract.

Q29: What does ‘maximum’ quantity mean in terms of the Section B line item requirements? How do we propose an amount when we do not know the requirements/projects to be performed during contract period of performance?

A29: Offerors do not have to input a price or amount in the Section B line item blanks. Maximum quantity means the not-to-exceed amount that the Government may order against the particular line item (CLIN). The maximum amounts shown are in U.S. dollars. For example, if a maximum quantity of a particular CLIN is 400,000, that means the Government will not order more than $400,000 against that CLIN for that performance period, unless both parties agree to increase the capacity. Since the Government intends to award 2 contracts against this solicitation, the maximum quantities per solicitation CLIN will be divided by 2, and the resultant quantity will be the maximum quantity for each contract.

A1: Proposals for this solicitation are due 22 March 2010 at 3:00PM, Japan Standard Time.

Q2: On page 41 of the solicitation Paragraph 5 under Management Approach there is a statement, “delivery of playground equipment to Seoul Elementary School in Seoul, Korea” Who is responsible for the transport of the equipment from Seoul to Mainland Japan and Okinawa?

A2: That statement has been removed. The playground equipment needs to be sent directly to the school that installation will take place. Schools for installation, repair or maintenance will be identified at the time that task orders are issued on the contract.

Q3: Concerning the initial inspections of the playgrounds – Who is responsible for determining what requires repair and will the cost be covered by the government for the inspection and/or repairs?

A3: Initial inspections of the playgrounds for repair/maintenance will be done by the Government.

Q4: Will 2 contracts be awarded for Mainland, Japan and 2 contracts awarded for Okinawa?

A4: The Government intends to award a minimum of two (2) contracts per region. However, the Government could award more.

Q5: On page 42 of the solicitation under the Warranty Paragraph there is a requirement for a 15 Year Limited Warranty, Is this a manufacturers warranty? Also is this warranty on parts only or parts and labor?

A5: Under the Warranty section on pg 42, each 15-Year Warranty is clearly identified as to which is related. The warranty section also states that the Contractor will guarantee all work for a period of 12 months and repair all defects at not cost to the Government.

A6: The liquidated damage (LD) amount specified in FAR clause 52.xxxx herein, applies to new installation requirements only. However, LDs may also apply in maintenance or repair work that requires timely completion. Accordingly, each individual task order issued against the contract will state an applicable LD amount, if any.

Q7: Are Japanese business registration and licenses required in order to be awarded this contract

A7: An applicable, valid business license and/or registration issued by a local, state/prefectural or federal Japanese Government office is required in order to be considered for contract award.

The reason for this is to ensure that the contractor has legal authority to perform contract requirements (i.e., demolition, disposal, installation, maintenance and repair of playground equipment and tiles) onsite in Japan and Okinawa. The Contracting Officer will consider the business license and/or registration of the subcontractor(s) or the joint venture partner if the prime contractor does not possess the aforementioned business license and/or registration.
