QUESTIONS AND ANSWRS
A. Questions & Answers regarding this solicitation.
Q1: According to page1 paragraph 13 this solicitation is due 12 March 2010 at 3:00 PM, however, page 72 of the solicitation states all bids must be submitted not later than 19 March 2010 at 1400. When are4 bids due in for this solicitation
A1: Proposals for this solicitation are due 22 March 2010 at 3:00PM, Japan Standard Time.
Q2: On page 41 of the solicitation Paragraph 5 under Management Approach there is a statement, “delivery of playground equipment to Seoul Elementary School in Seoul, Korea” Who is responsible for the transport of the equipment from Seoul to Mainland Japan and Okinawa?
A2: That statement has been removed. The playground equipment needs to be sent directly to the school that installation will take place. Schools for installation, repair or maintenance will be identified at the time that task orders are issued on the contract.
Q3: Concerning the initial inspections of the playgrounds – Who is responsible for determining what requires repair and will the cost be covered by the government for the inspection and/or repairs?
A3: Initial inspections of the playgrounds for repair/maintenance will be done by the Government.
Q4: Will 2 contracts be awarded for Mainland, Japan and 2 contracts awarded for Okinawa?
A4: The Government intends to award a minimum of two (2) contracts per region. However, the Government could award more.
Q5: On page 42 of the solicitation under the Warranty Paragraph there is a requirement for a 15 Year Limited Warranty, Is this a manufacturers warranty? Also is this warranty on parts only or parts and labor?
A5: Under the Warranty section on pg 42, each 15-Year Warranty is clearly identified as to which is related. The warranty section also states that the Contractor will guarantee all work for a period of 12 months and repair all defects at not cost to the Government.
Q6: On page 49 of the solicitation under Liquidated Damages it states, “If the Contractor fails to complete work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,500.00 for each calendar day of the delay until the work is completed or accepted.” As that this solicitation is for a new installation, and maintenance does the $1,500.00 per day extend to both new installation work and maintenance work alike?
A6: The liquidated damage (LD) amount specified in FAR clause 52.xxxx herein, applies to new installation requirements only. However, LDs may also apply in maintenance or repair work that requires timely completion. Accordingly, each individual task order issued against the contract will state an applicable LD amount, if any.
Q7: Are Japanese business registration and licenses required in order to be awarded this contract
A7: An applicable, valid business license and/or registration issued by a local, state/prefectural or federal Japanese Government office is required in order to be considered for contract award. The reason for this is to ensure that the contractor has legal authority to perform contract requirements (i.e., demolition, disposal, installation, maintenance and repair of playground equipment and tiles) onsite in Japan and Okinawa. The Contracting Officer will consider the business license and/or registration of the subcontractor(s) or the joint venture partner if the prime contractor does not possess the aforementioned business license and/or registration. The Prime Contractor shall comply with all applicable labor and tax laws of Japan.
