(12) Other Instructions

(i) General Information

(A) Points of Contact: The contracting officer (KO) and contract specialist (CS) listed in the Points of Contact Instruction are the sole points of contact for this procurement.

Submit any questions, concerns, or requests for clarification in writing to the CS/KO.

(B) Discrepancies: If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the KO in writing with supporting rationale. The Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

(C) Electronic Reference Documents: All referenced documents for this solicitation are available on the Contract Opportunities section on www.sam.gov. Potential offerors are encouraged to subscribe/follow for real-time e-mail notifications when information has been posted to the website for this solicitation.

(D) Communications: Exchanges of source selection information between Government and offerors will be controlled by the KO and CS. E-mail will be used to transmit such information to the offeror and will include “Source Selection Information – See FAR 2.101 & 3.104” in the Subject line.

(ii) Offerors are requested to submit a written Proposed Solution and a separate Price Quote in response to the attached Performance Work Statement (PWS) and Quality Assurance Surveillance Plan (QASP). Information on submission of the Proposed Solution and the Price Quote is provided below. The proposal shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of statements asserted in the proposal.

The proposal should not simply rephrase or restate the Government's requirements but rather shall provide convincing rationale to address how the offeror intends to meet these requirements.

Offerors shall assume the Government has no prior knowledge of their facilities and capabilities and will base its evaluation on the information presented in the offeror's proposal. The offeror's proposal must include all data and information requested by the solicitation and must be submitted in accordance with these instructions. The proposal should sufficiently address the requirements as stated in the PWS. Non-conformance with these instructions may result in removal of the proposal from further evaluation.

(iii) IAW DISA Instruction, Organizational and Consultant Conflicts of Interest (OCCI), each offeror shall specifically identify in its proposal whether or not any potential or actual organizational and consultant conflicts of interest, as described in Federal Acquisition Regulation (FAR) Subpart 9.5, exists for this instant procurement. If the offeror believes that no OCCI exists, the OCCI response shall set forth sufficient details to support such a position. If an offeror believes that an actual or perceived OCCI does exist on the instant procurement, the offeror shall submit an OCCI plan with the proposal, explaining in detail how the OCCI will be mitigated and/or avoided.

(iv) Page limitations, if applicable, are identified below and will be treated as maximums. A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Page size shall be

8.5 x 11 inches. Page limitations are identified below under each evaluation factor and will be treated as maximums. If exceeded, excess pages will not be read or considered in evaluation of the proposal. Although not required, the following items (if submitted) will not be considered when calculating page limits: cover page, table of contents, glossary, executive summary, OCCI mitigation plans, price quote, and responses to any provisions/clauses. In the event any evaluation notices are issued, page limitations may also be placed on those. Page limitations shall not be circumvented by including inserted text boxes/pop-ups or internet links to additional information; such inclusions are not acceptable and will not be considered part of a proposal.

The Government reserves the right not to consider for award any proposal that does not adhere to the administrative requirements of this solicitation.

(v) Organization/Number of Copies/Page Limits. The offeror shall prepare the proposal as set forth in the Proposal Organization Table below. The titles and contents shall be as defined in this table, all of which shall be within the required page limits and with the number of copies as specified. The contents of each required section of the proposal are described in the information to offerors paragraph as noted in the table below. Cross-referencing within a proposal volume is permitted where its use would conserve space without impairing clarity. Tab indexing may be used to identify sections. Additionally, each section may contain a glossary of all abbreviations and acronyms used, and with an explanation for each, if necessary. Glossaries do not count against the page limitations.

(vi) Electronic Offers. The offeror shall submit the Proposed Solution, the Price Quote, and any associated Contract Documentation in electronic format via e-mail and must include “Source Selection Information – See FAR 2.101 & 3.104” in the Subject line. The Proposed Solution, the Price Quote, and any associated Contract Documentation shall each be separate files. Proposals shall be submitted to the KO/CS identified in the Points of Contact Instruction.

(vii) Proposal Organization:

(A) Proposed Solution. The Proposed Solution should be specific and complete, and will be evaluated against the Factor 1 Solution, as defined in FAR 52.212-2, Evaluation – Commercial Items. The technical portion of the proposal is to be submitted as a Microsoft (MS) Word 2007 or PDF document. The page format shall have a 1-inch margin using no smaller than an 11-point Ariel, Times New Roman, or Courier New font for all text to include any text contained in a table. The file size of each document shall not exceed 10MB. The technical/management proposal shall not exceed 3 pages. Drawings/diagrams are counted in the total pages allowed. Using the instructions provided below, provide as specifically as possible the actual methodology you would use for accomplishing all aspects of the PWS and satisfying Factor 1.

Address your proposed approach to meeting or exceeding the minimum performance or capability requirements, as well as any risks in your proposed approach in terms of technical/performance, price, and/or schedule. Address risk by identifying those aspects of the Proposed Solution that you consider having the potential for disruption of schedule, increased cost, poor performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance. Describe the impact of each identified risk in terms of its potential to interfere with or prevent the successful accomplishment of other contract requirements (e.g., PWS or specification requirements). Propose a realistic "work-around" or risk mitigation for identified risks that will eliminate or reduce risk to an acceptable level.

Identify any new risks introduced by such risk mitigation.

(B) Price Quote. The quotation will be evaluated using one or more of the techniques defined in FAR Part 15.404 in order to determine if they are reasonable and complete.

Reasonableness is established through cost and price analysis techniques as described in FAR

15.404. For a quotation to be complete, all solicitation requirements must be priced, figures correctly calculated, and prices/costs presented in in a clear and useful format. The attached “PRICE QUOTE WORKSHEET” is provided to facilitate quotation preparation and to ensure uniformity across all offerors’ submissions.

The quotation spreadsheet shall be submitted in MS Excel 2007 format or newer. All formulas shall remain present in the spreadsheet for verification. The file size of each document shall not exceed 20MB. Information beyond that required by this instruction shall not be submitted unless you consider it essential to document or support your price. All information relating to the proposed price, including all required supporting documentation must be included in the section of the proposal designated as the Price Quote. Price Quote submissions should be sufficiently detailed to demonstrate their reasonableness. Offerors shall propose a total firm-fixed price and provide a detailed breakdown of materials, labor, and other direct costs (ODCs). Labor rates should be fully loaded hourly rates for each labor category that may be required in support of this effort.

Under no circumstances shall the information and documentation from the Price Quote be included elsewhere in the proposal.

FAR 12.504(a) The following laws are not applicable to subcontracts at any tier for the acquisition of commercial items or commercial components at any tier:

(7) 41 U.S.C. 4706(d) and 10 U.S.C. 2313(c), Examination of Records of Contractor, when a subcontractor is not required to provide certified cost or pricing data (see 15.209(b)), unless using funds appropriated or otherwise made available by the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-5).

(C) Contract Documentation. The purpose of this proposal section is to provide information to the Government for preparing the contract document and supporting file.

1. You must complete blocks 30 a, b, and c of the SF Form 1449 and return this form with your proposal. Signature by the offeror on the SF 1449 constitutes an offer, which the Government may accept.

2. Offerors shall provide completed representations, certifications, acknowledgments, and statements as required in the solicitation. For representations and certifications specifically in FAR 52.212-3 Alt I (Oct 2014), offerors shall complete only paragraph (b) of the provision if the offeror has completed the annual representations and certifications electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If not, offerors shall complete paragraphs (c) through (v) of the provision.

3. OCCI Mitigation Plan or a statement that OCCI does not exist.

4. Authorized Offeror Personnel. Provide the name, title, and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government. Contractor Point of Contract information will be used for contract administration in the Points of Contact Instruction.

5. Company/Division Address, Identifying Codes, and Applicable Designations. Provide company/division's street address; CAGE code; DUNS/UEI number;

TIN; size of business/socioeconomic categories.

ADDENDUM TO 52.212-2(a)

Addendum to 52.212-2(a), Evaluation-Commercial Items is tailored as follows:

a. Basis for Contract Award

Award will be made to the responsible offeror whose proposal is determined to represent the overall best value to the Government using a lowest price technically acceptable (LPTA) process. The Proposed Solution should include all information the offeror wants the Government to consider and evaluate regarding its ability to perform all required tasks and conform to all required terms and conditions. To be eligible for award, the offeror’s proposal must sufficiently address all aspects of the PWS. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award.

Regarding the best value analysis for the award decision, the below evaluation factors will be used to determine technical acceptability. Section 508 Accessibility Standards do not apply to this requirement.

b. Evaluation Factors and Subfactors

(1) The following evaluation factors will be used to evaluate each proposal.

Factor 1: Solution This factor will be evaluated based on the extent to which the offeror’s Proposed Solution meets the requirements stated in PWS Paragraphs 6.1 through 6.3 and 6.2 for performance in PWS Paragraph 9 adhering to the schedule in PWS Paragraph 10. In order to be rated Acceptable, the offeror’s Proposed Solution must clearly demonstrate its ability to deliver the required dividers and complete associated, incidental disposal, installation, and warranty services as stated in the PWS Paragraphs above.

Factor 2: Price Price Quotes will be evaluated to determine if they are reasonable and complete. The Government reserves the right, but is not obligated, to conduct a realism analysis. The offeror should ensure the Price Quote includes detailed information regarding the resources required to accomplish the task (e.g., labor categories, labor hours, number of employees for each labor category, rates, etc.). All ODCs shall annotate the specific detail (e.g., quantity, part number, manufacturer, etc.) to include supporting documentation to justify the costs (i.e., price quotes, price history, etc.)

Completeness is defined as: The Government will determine completeness of an offeror’s Price Quote by verifying that all solicitation requirements have been priced, figures are correctly calculated, and prices are presented in a clear and useful format.

Reasonableness is defined as: Price Quotes will be evaluated using one or more of the techniques defined in FAR 15.404 to determine price reasonableness.

All travel must show the specific detail, if known (e.g., number of days, locations, number of personnel, etc.). All Other Direct Costs (ODCs) shall annotate the specific detail (e.g., quantity, part number, manufacturer, etc.) to include supporting documentation to justify the costs (i.e., price quotes, price history, etc.). Travel shall be authorized by the KO in writing prior to performance and will be paid IAW FAR Part 31.205-46.

(2) Relative Importance of Factors. The relative importance of each factor is as follows:

The Solution Factor is less important than the Price Factor/price.

c. Ratings

The Solution Factor will receive one of the ratings described in Table 1: either Acceptable or Unacceptable. In order for a proposal to be rated overall Technically Acceptable, the Solution Factor must be rated Acceptable.

d. Discussions/Exchanges

The Government intends to evaluate proposals and award a contract without exchanges.

However, the Government reserves the right to conduct exchanges or seek clarifications if the KO determines they are necessary. If exchanges are required, the number of proposals being competitively considered may be narrowed to all of the most highly rated proposals. The Government further reserves the right to reduce the number of proposals being competitively considered to the greatest number that will permit efficient competition among the most highly rated proposals. If an offeror’s proposal is removed from further consideration for award, written notice of the removal will be provided to the offeror. In the event issues pertaining to the solicitation cannot be resolved to the KO's satisfaction, the Government reserves the right to withdraw and cancel the solicitation. In such event, offerors will be notified in writing.

2. Contract or Task Order Title. Defense Network Center Pacific (DNC PAC) Video Wall Tech Refresh

3. Background. The video walls in the DNC at Defense Information Systems Agency Pacific (DISA PAC) allows the Watch Officers to share valuable information with the engineers/technicians on the video walls.

However, the video walls have reached end of life/end of service (EOL/EO. Therefore, this contract will tech refresh both video walls in the DNC to ensure the A/V system in the DNC remains fully operational.

4. Objectives: Procure two video walls and two video processors and provide services to install the equipment in DISA PAC, Ford Island, Building 77, Room 228/229.

5. Scope. Procure equipment for two video walls, two video processors, and miscellaneous audio/video (A/V) equipment/materials. Remove existing video walls in the DNC. Install two new video walls, two video processors, and all associated cabling. Label all new cabling. Assist with programming of the control system and test and checkout of the video walls and A/V system in the DNC.

6. Performance Requirements.

6.1 Task 1 – Tech Refresh DNC PAC Video Walls

6.1.1 Subtask 1 Disassemble and remove the two existing video walls from the DNC.

6.1.2 Subtask 2 Install two new video walls, two video processors, and all associated A/V equipment and cabling. Label all new cabling.

6.1.3 Subtask 3 Assist with programming of the control system and test and checkout of the video walls and A/V system in the DNC.

6.2 Task 2 – Installation Warranty.

The Contractor shall provide a 12-month warranty on the system and associated installation.

Warranty shall include 8 x 5 telephone helpdesk support during standard federal government business hours, remote engineering support for critical system troubleshooting, and <24 hour on-site response time if necessary. The Contractor shall acquire and maintain an inventory of spare parts meeting the video wall manufacturer's recommended on-hand replacement parts. Spare parts shall be readily available for installation during on-site troubleshooting (<24 hours).

7. Performance Standards.

6.1 Task 1 – DNC PAC

Performance occurs with no required re-performance or re work at least 80% of the time.

Problems that occur are minor and are resolved in a satisfactory manner.

Warranty

Telephone support provided within 2 hours and on-site support with proper replacement parts within 24 hours is provided at least 95% of the time.

9. Place of Performance.

Mission Location: DISA PAC, 477 Essex Street, JBPHH, Building 77, Ford Island. All work will be completed on-site.

10. Period of Performance. The period of performance is 12 months from Date of Contract/Task Order Award.

11. Security Requirements. The contractor shall coordinate visits with site Point Of Contact (POC)s providing at least a 72-hour notice (or according to each site security requirements) prior to any site access. Contractor personnel performing any task under this PWS must have an interim or final Secret clearance.

11.1 Facility Security Clearance. Work performed under this contract/order is up to the Secret level.

Therefore, the company must have an interim or final Secret Facility Clearance from the Defense Counterintelligence and Security Agency Facility Clearance Branch.

11.2 Security Clearance. All personnel performing on or supporting a DISA contract/order in any way shall be U.S. citizens. The personnel security requirements for this contract/order cover the individuals supporting the Task Areas delineated in the table below. Contractor personnel must possess the interim or final security clearance eligibility delineated in the table below when performance starts.

11.3 Investigation Requirements. All personnel requiring Secret access under this contract/order shall undergo a favorably adjudicated Tier 3 (T3) Investigation formerly known as a National Agency Check, Local Agency Check and Credit Check or Access National Agency Check and Inquiries as a minimum investigation. Enrollment into Continuous Evaluation current within 5 years and, reflected in DISS, would meet the requirement for a current PR.

11.3.1 The contractor is required to have personnel cleared with an interim or final Secret (as specified in the table located in section 11.2) at contract start date. If contractor personnel is replaced during performance of the contract, replacement personnel should also have interim or final clearance Secret (as specified in the table located in section 11.2).

11.4 Visit Authorization Letters (VAL). Visit requests shall be processed and verified through the DISS to Security Management Office (SMO) DKASAA. DISS visits for contracts/orders are identified as “Other” or “TAD/TDY” and will include the Contract/Order Number of the contract/order in the Additional Information section. Contractors that do not have access to DISS may submit visit authorizations by e-mail in a password protected .pdf to the COR/ACOR specified in DITCO Additional Text G1 - Points of Contact.

*Prior coordination with the DISA COR should be made via email to ensure the VAL/ Visit Authorization Request (VAR)/ Visit Termination Notification (VTN) process is agreed upon and properly secure.

11.4.2 VTN Package. The Contractor FSO will forward a VTN letter to the DISA COR identified in the PWS/TO/Sub for all employees leaving the contract/task order/subcontract.

11.4.2.3 In addition, the DISA CORs and security managers shall inform the DISA Security Office when contractor personnel are removed for cause from a contract supporting DISA. This step is being added to prevent contractor personnel removed for security related issues from returning to DISA without appropriate vetting. This step will also provide security with pertinent information to make an informed decision regarding potential contractor employees’ access to secure facilities and sensitive information.

“For Cause” is information regarding an individual that falls into one or more of the actions or incidents that are within one of the 13 adjudicative guidelines as cited in the Security Executive Agent Directive

(SEAD) 4.

The VTN must contain the following information on company letterhead

11.6 Information Security and other miscellaneous requirements.

11.6.1 Contractor personnel shall comply with all local security requirements including entry and exit control for personnel and property at the Government facility.

11.6.2 Contractor employees shall be required to comply with all Government security regulations and requirements. Initial and periodic safety and security training and briefings will be provided by Government security personnel. Failure to comply with Government security regulations and requirements shall require the company to provide the Government with a written remediation/corrective action plan; furthermore, failure to comply with such requirements can be cause for removal and the contractor will not be able to provide service on this contract/order.

11.6.3. Contractor employees with an incident report in DISS who have had their access to classified suspended will not be permitted to fill positions requiring access to classified information on a DISA contract/order.

11.6.4 The Contractor shall not divulge any information, classified or unclassified, about DoD files, data processing activities or functions, user identifications, passwords, or any other knowledge that may be gained, to anyone who is not authorized to have access to such information. The Contractor shall observe and comply with the security provisions in effect at the DoD facility. Identification shall be worn and displayed as required.

11.6.5 The authority for the contractor personnel to regain access must be granted by DISA Chief of Security.

11.6.5.1 DISA retains the right to request removal of contractor personnel regardless of prior clearance or adjudication status, whose actions, while assigned to this contract, clearly conflict with the interest of the Government.

11.6.5.2 DISA retains the right to revoke contractor personnel access to DISA facilities and networks, who violates one or more of Security Personnel Adjudicative guidelines, harassment or violence in the workplace while assigned to a contract clearly conflict with the interest of the Government.

11.6.5.3 If contractor employee is accused of violating state or federal laws and/or Government professional conduct policies or regulations, then the Government may require that such contractor employee be removed from Government premises and/or that such contractor employee be removed from supporting this contract, pending the duration and outcome of a Government investigation if the Contracting Officer finds that the conduct or violation alleged has the potential to negatively interfere with contract performance or operations at a Government facility. Only the Contracting Officer can make such a request on behalf of the Government. Removal of contractor employee shall not negatively impact contract performance.

11.6.6 Contractor personnel will generate or handle documents that contain Controlled Unclassified Information (CUI) at the Government facility. All contractor deliverables shall be marked in accordance with DoDM 5200.01, Vol. 3, DoD Information Security Program: Protection of Classified Information; DoDI 5200.48, Controlled Unclassified Information (CUI); and DoDM 5400.07, Freedom of Information Act Program, unless otherwise directed by the Government. The contractor shall comply with the provisions of the DoD Industrial Security Manual for handling classified material and producing deliverables. The contractor shall comply with DISA Instruction 630-230-19, Cybersecurity.

11.6.7 The Contractor shall afford the Government access to the contractor’s facilities, installations, operations, documentation, databases and personnel used in performance of the contract/order. Access shall be provided to the extent required to carry out a program of IT inspection (to include vulnerability testing), investigation and audit to safeguard against threats and hazards to the integrity, availability and confidentiality of data or to the function of information technology systems operated on behalf of DISA or DoD, and to preserve evidence of computer crime.

14. Section 508 Accessibility Standards.

E201.1 Scope ICT that is procured, developed, maintained, or used by agencies shall conform to the Revised 508 Standards.

E206.1 General. Where components of ICT are hardware and transmit information or have a user interface, such components shall conform to the requirements in Chapter 4.

E208.1 General Where an agency provides support documentation or services for ICT, such documentation and services shall conform to the requirements in Chapter 6.

E301 General

E301.1 Scope. The requirements of Chapter 3 shall apply to ICT where required by 508 Chapter 2 (Scoping Requirements), 255 Chapter 2 (Scoping Requirements), and where otherwise referenced in any other chapter of the Revised 508 Standards or Revised 255 Guidelines.

E302 Functional Performance Criteria

302.1 Without Vision. Where a visual mode of operation is provided, ICT shall provide at least one mode of operation that does not require user vision.

302.2 With Limited Vision. Where a visual mode of operation is provided, ICT shall provide at least one mode of operation that enables users to make use of limited vision.

302.3 Without Perception of Color. Where a visual mode of operation is provided, ICT shall provide at least one visual mode of operation that does not require user perception of color.

302.4 Without Hearing. Where an audible mode of operation is provided, ICT shall provide at least one mode of operation that does not require user hearing.

302.5 With Limited Hearing. Where an audible mode of operation is provided, ICT shall provide at least one mode of operation that enables users to make use of limited hearing.

302.6 Without Speech. Where speech is used for input, control, or operation, ICT shall provide at least one mode of operation that does not require user speech.

302.7 With Limited Manipulation. Where a manual mode of operation is provided, ICT shall provide at least one mode of operation that does not require fine motor control or simultaneous manual operations.

302.8 With Limited Reach and Strength. Where a manual mode of operation is provided, ICT shall provide at least one mode of operation that is operable with limited reach and limited strength.

302.9 With Limited Language, Cognitive, and Learning Abilities. ICT shall provide features making its use by individuals with limited cognitive, language, and learning abilities simpler and easier.

401.1 Scope. The requirements of Chapter 4 shall apply to ICT that is hardware where required by 508 Chapter 2 (Scoping Requirements), 255 Chapter 2 (Scoping Requirements), and where otherwise referenced in any other chapter of the Revised 508 Standards or Revised 255 Guidelines.

Exception from E401.1 Scope: Hardware that is assistive technology shall not be required to conform to the requirements of this chapter.

402.1 General. ICT with closed functionality shall be operable without requiring the user to attach or install assistive technology other than personal headsets or other audio couplers, and shall conform to 402.

402.2 Speech-Output Enabled. ICT with a display screen shall be speech-output enabled for full and independent use by individuals with vision impairments.

402.2.1 Information Displayed On-Screen. Speech output shall be provided for all information displayed on-screen.

Exceptions from E402.2:

1. Variable message signs conforming to 402.5 shall not be required to be speech-output enabled.

2. Speech output shall not be required where ICT display screens only provide status indicators and those indicators conform to 409.

3. Where speech output cannot be supported due to constraints in available memory or processor capability, ICT shall be permitted to conform to 409 in lieu of 402.2.

4. Audible tones shall be permitted instead of speech output where the content of user input is not displayed as entered for security purposes, including, but not limited to, asterisks representing personal identification numbers.

5. Speech output shall not be required for: the machine location; date and time of transaction; customer account number; and the machine identifier or label.

6. Speech output shall not be required for advertisements and other similar information unless they convey information that can be used for the transaction being conducted.

402.2.2 Transactional Outputs. Where transactional outputs are provided, the speech output shall audibly provide all information necessary to verify a transaction.

402.2.3 Speech Delivery Type and Coordination. Speech output shall be delivered through a mechanism that is readily available to all users, including, but not limited to, an industry standard connector or a telephone handset. Speech shall be recorded or digitized human, or synthesized. Speech output shall be coordinated with information displayed on the screen.

402.2.4 User Control. Speech output for any single function shall be automatically interrupted when a transaction is selected. Speech output shall be capable of being repeated and paused.

402.2.5 Braille Instructions. Where speech output is required by 402.2, braille instructions for initiating the speech mode of operation shall be provided. Braille shall be contracted and shall conform to 36 CFR part 1191, Appendix D, Section 703.3.1.

Exception from E402.2.5 Braille Instructions: Devices for personal use shall not be required to conform to 402.2.5.

402.3 Volume. ICT that delivers sound, including speech output required by 402.2, shall provide volume control and output amplification conforming to 402.3.

402.3.1 Private Listening. Where ICT provides private listening, it shall provide a mode of operation for controlling the volume. Where ICT delivers output by an audio transducer typically held up to the ear, a means for effective magnetic wireless coupling to hearing technologies shall be provided.

402.3.2 Non-private Listening. Where ICT provides non-private listening, incremental volume control shall be provided with output amplification up to a level of at least 65 dB. A function shall be provided to automatically reset the volume to the default level after every use.

402.4 Characters on Display Screens. At least one mode of characters displayed on the screen shall be in a sans serif font. Where ICT does not provide a screen enlargement feature, characters shall be 3/16 inch (4.8 mm) high minimum based on the uppercase letter “I”. Characters shall contrast with their background with either light characters on a dark background or dark characters on a light background.

402.5 Characters on Variable Message Signs. Characters on variable message signs shall conform to section 703.7 Variable Message Signs of ICC A117.1-2009 (incorporated by reference, see 702.6.1).

403.1 General. Where provided, biometrics shall not be the only means for user identification or control.

Exception from E403.1 General: Where at least two biometric options that use different biological characteristics are provided, ICT shall be permitted to use biometrics as the only means for user identification or control.

404.1 General. ICT that transmits or converts information or communication shall not remove non-proprietary information provided for accessibility or shall restore it upon delivery.

405.1 General. The same degree of privacy of input and output shall be provided to all individuals. When speech output required by 402.2 is enabled, the screen shall not blank automatically.

406.1 General. Where data connections used for input and output are provided, at least one of each type of connection shall conform to industry standard non-proprietary formats.

407.1 General. Where provided, operable parts used in the normal operation of ICT shall conform to 407.

407.2 Contrast. Where provided, keys and controls shall contrast visually from background surfaces.

Characters and symbols shall contrast visually from background surfaces with either light characters or symbols on a dark background or dark characters or symbols on a light background.

407.3 Input Controls. At least one input control conforming to 407.3 shall be provided for each function.

Exception from E407.3 Input Controls: Devices for personal use with input controls that are audibly discernable without activation and operable by touch shall not be required to conform to 407.3.

407.3.1 Tactilely Discernible. Input controls shall be operable by touch and tactilely discernible without activation.

407.3.2 Alphabetic Keys. Where provided, individual alphabetic keys shall be arranged in a QWERTY-based keyboard layout and the “F” and “J” keys shall be tactilely distinct from the other keys.

407.3.3 Numeric Keys. Where provided, numeric keys shall be arranged in a 12-key ascending or descending keypad layout. The number five key shall be tactilely distinct from the other keys. Where the ICT provides an alphabetic overlay on numeric keys, the relationships between letters and digits shall conform to ITU-T Recommendation E.161 (incorporated by reference, see 702.7.1).

407.4 Key Repeat. Where a keyboard with key repeat is provided, the delay before the key repeat feature is activated shall be fixed at, or adjustable to, 2 seconds minimum.

407.5 Timed Response. Where a timed response is required, the user shall be alerted visually, as well as by touch or sound, and shall be given the opportunity to indicate that more time is needed.

407.6 Operation. At least one mode of operation shall be operable with one hand and shall not require tight grasping, pinching, or twisting of the wrist. The force required to activate operable parts shall be 5 pounds (22.2 N) maximum.

407.7 Tickets, Fare Cards, and Keycards. Where tickets, fare cards, or keycards are provided, they shall have an orientation that is tactilely discernible if orientation is important to further use of the ticket, fare card, or keycard.

407.8 Reach Height and Depth. At least one of each type of operable part of stationary ICT shall be at a height conforming to 407.8.2 or 407.8.3 according to its position established by the vertical reference plane specified in 407.8.1 for a side reach or a forward reach. Operable parts used with speech output required by 402.2 shall not be the only type of operable part complying with 407.8 unless that part is the only operable part of its type.

● 407.8.1 Vertical Reference Plane. Operable parts shall be positioned for a side reach or a forward reach determined with respect to a vertical reference plane. The vertical reference plane shall be located in conformance to 407.8.2 or 407.8.3.

○ 407.8.1.1 Vertical Plane for Side Reach. Where a side reach is provided, the vertical reference plane shall be 48 inches (1220 mm) long minimum.

○ 407.8.1.2 Vertical Plane for Forward Reach. Where a forward reach is provided, the vertical reference plane shall be 30 inches (760 mm) long minimum.

● 407.8.2 Side Reach. Operable parts of ICT providing a side reach shall conform to 407.8.2.1 or

407.8.2.2. The vertical reference plane shall be centered on the operable part and placed at the leading edge of the maximum protrusion of the ICT within the length of the vertical reference plane. Where a side reach requires a reach over a portion of the ICT, the height of that portion of the ICT shall be 34 inches (865 mm) maximum.

○ 407.8.2.1 Unobstructed Side Reach. Where the operable part is located 10 inches (255 mm) or less beyond the vertical reference plane, the operable part shall be 48 inches (1220 mm) high maximum and 15 inches (380 mm) high minimum above the floor.

○ 407.8.2.2 Obstructed Side Reach. Where the operable part is located more than 10 inches (255 mm), but not more than 24 inches (610 mm), beyond the vertical reference plane, the height of the operable part shall be 46 inches (1170 mm) high maximum and 15 inches (380 mm) high minimum above the floor. The operable part shall not be located more than 24 inches (610 mm) beyond the vertical reference plane.

● 407.8.3 Forward Reach. Operable parts of ICT providing a forward reach shall conform to

407.8.3.1 or 407.8.3.2. The vertical reference plane shall be centered, and intersect with, the operable part. Where a forward reach allows a reach over a portion of the ICT, the height of that portion of the ICT shall be 34 inches (865 mm) maximum.

○ 407.8.3.1 Unobstructed Forward Reach. Where the operable part is located at the leading edge of the maximum protrusion within the length of the vertical reference plane of the ICT, the operable part shall be 48 inches (1220 mm) high maximum and 15 inches (380 mm) high minimum above the floor.

○ 407.8.3.2 Obstructed Forward Reach. Where the operable part is located beyond the leading edge of the maximum protrusion within the length of the vertical reference plane, the operable part shall conform to 407.8.3.2. The maximum allowable forward reach to an operable part shall be 25 inches (635 mm).

■ 407.8.3.2.1 Operable Part Height for ICT with Obstructed Forward Reach. The height of the operable part shall conform to Table 407.8.3.2.1.

■ 407.8.3.2.2 Knee and Toe Space under ICT with Obstructed Forward Reach. Knee and toe space under ICT shall be 27 inches (685 mm) high minimum, 25 inches (635 mm) deep maximum, and 30 inches (760 mm) wide minimum and shall be clear of obstructions.

408.1 General. Where provided, display screens shall conform to 408.

408.2 Visibility. Where stationary ICT provides one or more display screens, at least one of each type of display screen shall be visible from a point located 40 inches (1015 mm) above the floor space where the display screen is viewed.

408.3 Flashing. Where ICT emits lights in flashes, there shall be no more than three flashes in any one-second period.

Exception from E408.3 Flashing: Flashes that do not exceed the general flash and red flash thresholds defined in WCAG 2.0 (incorporated by reference, see 702.10.1) are not required to conform to 408.3.

409.1 General. Where provided, status indicators shall be discernible visually and by touch or sound.

410.1 General. Where provided, color coding shall not be used as the only means of conveying information, indicating an action, prompting a response, or distinguishing a visual element.

411.1 General. Where provided, audible signals or cues shall not be used as the only means of conveying information, indicating an action, or prompting a response.

412.1 General. ICT that provides two-way voice communication shall conform to 412.

412.2 Volume Gain. ICT that provides two-way voice communication shall conform to 412.2.1 or 412.2.2.

412.2.1 Volume Gain for Wireline Telephones. Volume gain conforming to 47 CFR 68.317 shall be provided on analog and digital wireline telephones.

412.2.2 Volume Gain for Non-Wireline ICT. A method for increasing volume shall be provided for non-wireline ICT.
