Performance Work Statement Naval Special Warfare Command

Naval Special Warfare (NSW) Preparatory Course Training and Support Services

1. BACKGROUND

1.1 Overseas Contingency Operations prompted a Chief of Naval Operations (CNO) directive to grow the

Naval Special Warfare (NSW) Force. Consequently, NSW targeted an increase in the Sea, Air, and Land (SEAL) and Special Warfare Combatant-Craft Crewman (SWCC) forces. As part of the effort to support and sustain this requirement, the Naval Special Warfare Center (NSWCEN) has developed the NSW Preparatory Course.

2. OBJECTIVES

2.1 The objective of this requirement is to obtain contractor personnel support in order to properly physically train and mentally prepare SEAL and SWCC candidates for successful completion of their respective selection programs.

3. SCOPE

3.1 The Contractor shall provide all personnel and management necessary to provide the support services and perform to the standards and the specifications contained in this Performance Work Statement.

3.2 This requirement includes support in the areas of strength and conditioning, running, swimming and water skills, administrative and statistical support, logistical support and inventory management, and medical support.

4. REQUIREMENTS

4.1 General Requirements

4.1.1 Technology: The Contractor shall possess a working knowledge and competency in basic computer programs [to include but not limited to; Microsoft applications, email, and working within the Navy/Marine Corps Intranet (NMCI)], operation of phone/voicemail (to include but not limited to; contacting fire and ambulance services), and technical support functions.

4.1.1.1 The Government does not anticipate the contractor needing to access classified information in performance of this contract. However, in the event the contractor is involved with a potential spillage, security violation, or information technology violation, the contractor shall cooperate in any related inquiry or investigation, which may include but not limited to the Government securing contractor property or contractor employee personal property as determined necessary by the Government and/or conducting forensic analysis.

Applicable Department of Defense, United Special Operations Command, and Naval Special Warfare regulations, instructions, and policies would apply to such processes.

4.1.2 Non-Disclosure and Conflicts of Interest: All contracted personnel identified in this PWS shall sign a non-disclosure statement during the physical check in process as they will have knowledge of training, facilities, transportation, budget and procurement functions.

As such, the Contractor agrees to implement the internal controls necessary, to include internal firewalls, to protect this information from unauthorized use or disclosure and to refrain from using the information for any purpose other than that for which it was furnished. The Contractor shall immediately notify the Contracting Officer (KO) in writing, if during the performance of the contract, it becomes aware of any circumstance where its personnel or subcontractors may have a conflict of interest. In such circumstances, the Contractor may propose a Conflict of Interest mitigation plan offering suitable processes for alleviating situations that may lead to conflict of interest situations or the appearance of conflict of interest. The Contractor is also cautioned that there may be instances where actions it takes under this contract may preclude it from proposing on request for proposals in support of NSWC.

4.1.3 Assigned Spaces: All contracted personnel shall maintain the cleanliness of all respective assigned spaces. All facilities and equipment issues shall be routed through the Contractor’s Program/Course Manager to inform the Contracting Officer’s Representative (COR).

4.1.4 Vehicles: All contracted personnel shall be able to operate government vehicles. Driving vehicles is considered incidental to the performance of duties required under this contract and is not considered primary to the function of the job. Within 15 calendar days of the award of the contract, or within 15 days of an approved substitution of personnel, the contractor shall provide to the COR:

4.1.4.1 Copy of current driver’s licenses for all contract personnel.

4.1.4.2 Copy of insurance covering all contract personnel, in accordance with federal and state laws.

4.1.5 Uniform: The Program/Course Manager, Physical Training Instructors/Coaches, Emergency Medical Technician, Transportation Specialists, and Logistics Management Specialist shall conform to a dress code consisting of NSW approved training attire, to be determined upon contract award. An example will be provided upon award of contract.

The contractor shall outfit all contract personnel.

4.1.6 Professional Appearance: Contract personnel shall maintain a standard of grooming and personal appearance that reflects a high degree of pride in themselves and are in keeping with their positions. Grooming standards for training professionals shall be commensurate with those which closely mimic grooming standards employed by active duty NSW instructors.

4.1.7 Confirmation of valid and current Certifications and Licensing of Contractor Employees:

Documentation providing proof of valid and current licensing/certification is required to be provided to the Contracting Officer (KO) and Contracting Officer's Representative (COR) within 10 calendar days of contract award, new hire, or update/refresh/requalification as applicable.

4.1.8 The Contractor shall exhibit professional conduct and comply with all applicable Federal, DoD, Navy and United Special Operation Command regulations, instructions, directives, and policies in performance of this contract.

4.2 Specific Requirements

4.2.1 Program/Course Manager (1 FTE - Key Personnel)

4.2.1.1 Position Requirements

4.2.1.1.1 The Naval Special Warfare Preparatory Program/Course Manager

(P/CM) shall have a minimum of three (3) years of recent (within the last 5 years) experience in a P/CM role.

4.2.1.1.2 It is desired that the P/CM has experience managing an effort of equivalent size and scope to this requirement in a SOF environment.

4.2.1.1.3 It is desired that the P/CM has experience within NSW and has an understanding of the NSW pipeline.

4.2.1.1.4 It is desired that the P/CM possesses a Bachelor of Science (B.S.)

or Bachelor of Administration (B.A.) in Business, Management, Administration, Finance, Operations Management, Human Resource Management, Health and Exercise Science, or Kinesiology.

4.2.1.1.5 It is desired that the P/CM has experience with the “General

Functions” (4.2.1.2) and “Specific Functions” (4.2.1.3) as identified for the P/CM below.

4.2.1.2 General

4.2.1.2.1 The P/CM shall maintain a close working relationship with the

NSW Preparatory Course COR and active duty staff, to include collaboration on all aspects of the course curriculum. The P/CM shall maintain accurate records of student information that includes travel activity, PST testing and results in the designated Government system. The P/CM shall be familiar with all aspects of the job, test sites, and Centers of Influence (i.e. Recruit Training Center (RTC), Naval Training Center (NTC), Training Support Center, NSWCEN, other supporting entities) in their relationship to the operation of NSW Preparatory Course.

4.2.1.2.2 The Contractor shall ensure that training management is conducted in accordance with OPNAV, SOCOM, NSWC, and NSWCEN instructional directives and policies. All policies are held electronically and distributed by the military staff. (i.e. Drop/roll policy, drug/substance abuse, workplace violence and their application to students).

4.2.1.2.3 The P/CM shall meet minimum PST standards within 30 calendar days of reporting IAW current MILPERS MAN 1220-410 SWCC candidate standards. The P/CM shall maintain a fitness level and be prepared to pass same standards on a yearly basis.

4.2.1.3 Specific Functions; The Project/Course Manager shall perform the following functions in addition to all items listed as responsibilities for the Lead Physical Training Instructors:

4.2.1.3.1 Directly supervise administrative and medical contract personnel.

Supervise Physical Training Instructors in conjunction with Lead Physical Training Instructors.

4.2.1.3.2 Manage the Physical Training Instructor's training activities. The P/CM is not required to be at every training evolution but shall maintain strict oversight of each instructor’s performance through the Lead Physical Training Instructors.

4.2.1.3.3 Ensure all instruction is being carried out in accordance with established curriculum, to include safety aspects of the training evolution and fulfillment of curriculum guidelines.

4.2.1.3.4 Oversee the implementation of the established academic curriculum.

4.2.1.3.5 Ensure physical and classroom evolutions are properly staffed, to include ensuring that required instructor/student ratios (currently ranging from 1:1 to 1:25) are maintained. Additionally, coordination may be required to ensure that the appropriate medical coverage is present and available for students at each physical evolution.

4.2.1.3.6 Evaluate Physical Training Instructors to ensure physical evolutions are being conducted in accordance with approved curriculum to minimize injuries and maximize candidate success.

4.2.1.3.7 Manage cycles of students arriving and departing based on convening class capacity, student flow, and completion of course requirements.

4.2.1.3.8 Implement and execute curriculum, to include control documents;

test plan; lesson plan; trainee guide; high-risk evolution documents; administrator guides; and evolution brief sheets and attached matrixes.

4.2.1.3.9 Submit course improvement and innovation change proposals through the COR for review and approval prior to implementation.

4.2.1.3.10 Review exit critiques and provide recommendations in a per class report to the COR.

4.2.1.3.11 Provide an as-needed report to the COR on contractor issues and command climate.

4.2.1.3.12 Communicate observations and trends of testing results, as requested, to the COR to provide feedback focused on better preparation of applicants in training.

4.2.1.3.13 Assist candidates in understanding the NSW selection pipeline, its requirements, and how to best prepare them for the selection process.

4.2.1.3.14 Possess the ability to demonstrate and explain all points of performance of exercises included in the Physical Standards Test and exit test.

4.2.2 Physical Training Instructors [18 FTE; 3 Key Personnel (1 Water/Swim Head

Coach, 1 Run Head Coach, 1 Strength and Conditioning Head Coach)].

4.2.2.1 The Contractor shall provide 18 Physical Training Instructors, broken down as follows –

4.2.2.1.1 Two (2) Lead Physical Training Instructors

4.2.2.1.2 Six (6) Water / Swim Coaches

4.2.2.1.2.1 One (1) of the personnel under this modality shall be designated as the “Head Coach” (Key Personnel)

4.2.2.1.3 Five (5) Run Coaches

4.2.2.1.3.1 One (1) of the personnel under this modality shall be

4.2.2.1.4 Four (4) Strength and Conditioning Coaches

4.2.2.1.4.1 One (1) of the personnel under this modality shall be

4.2.2.1.5 One (1) Rehab Strength and Conditioning Coach

4.2.2.2 Position Requirements

4.2.2.2.1 The 18 Physical Training Instructors shall each have

4.2.2.2.1.1 A Bachelor of Science (B.S.) or Bachelor of Arts (B.A.)

in Health and Exercise Science, Kinesiology, or related physical training field.

4.2.2.2.2 The 18 Physical Training Instructors shall each possess/maintain:

4.2.2.2.2.1 A valid and current CPR and AED American Red Cross Certification.

4.2.2.2.3 The Two (2) Lead Physical Training Instructors:

4.2.2.2.3.1 Each Lead Physical Training Instructor shall have a minimum of two (2) years of experience as a physical training instructor in a training environment.

4.2.2.2.3.2 It is desired that each Lead Physical Training Instructor have experience with the “General Requirements (4.2.2.3) and “Specific Functions” (4.2.2.4) as detailed below.

4.2.2.2.4 Six (6) Water/Swim Coaches:

4.2.2.2.4.1 Each Water/Swim coach shall have a minimum of three

(3) years of recent (within the last 5 years) experience working as a water/swim coach/instructor in a training environment and a valid and current American Red Cross Lifeguard Certification.

4.2.2.2.4.2 It is desired that each water/swim coach have one (1) year of Swim Coaching experience at a competitive level (club, collegiate, or Olympic).

4.2.2.2.4.3 It is desired that each water/swim coach possess a valid and current Level 3 Swim Coach certification as recognized by the American Swim Coach Association.

4.2.2.2.4.4 It is desired that each Water/Swim coach have experience with the “General Requirements (4.2.2.3) and “Specific Functions” (4.2.2.4) as detailed below.

4.2.2.2.5 Five (5) Run Coaches:

4.2.2.2.5.1 Each Run Coach shall have a minimum of three (3) years of recent (within the last 5 years) experience as a run coach/instructor in a training environment.

4.2.2.2.5.2 It is desired that each run coach have a valid and current Level 1, 2, or 3 USA Track and Field Association run coach certification.

4.2.2.2.5.3 It is desired that each Run coach have experience with the “General Requirements (4.2.2.3) and “Specific Functions” (4.2.2.4) as detailed below.

4.2.2.2.6 Four (4) Strength and Conditioning Coaches;

4.2.2.2.6.1 Each Strength and Conditioning Coach shall have a minimum of three (3) years of recent (within the last 5 years) experience working as a strength and conditioning coach/instructor in a training environment.

4.2.2.2.6.2 It is desired that each Strength and Conditioning Coach have a valid and current Strength and Conditioning Specialist (CSCS) certificate, as recognized by the National Strength and Conditioning Association.

4.2.2.2.6.3 It is desired that each Strength and Conditioning Coach have experience with the “General Requirements (4.2.2.3) and “Specific Functions” (4.2.2.4) as detailed below

4.2.2.2.6.4 It is desired that one (1) of the four (4) coaches shall be currently certified as a Registered Strength and Conditioning Coach with Distinction (RSCC/D).

4.2.2.2.7 One (1) Rehab Strength and Conditioning Coach:

4.2.2.2.7.1 The one (1) Rehab and Strength Conditioning Coach shall have a minimum of three (3) years of recent (within the last 5 years) experience working as a Rehab Strength and Conditioning Coach in a training environment.

4.2.2.2.7.2 It is desired that the Rehab Strength and Conditioning Coach have a valid and current Strength and Conditioning Specialist (CSCS) certification, as recognized by the National Strength and Conditioning Association.

4.2.2.2.7.3 It is desired that the Rehab Strength and Conditioning Coach have experience with the “General Requirements (4.2.2.3) and “Specific Functions” (4.2.2.4) as detailed below.

4.2.2.3 General:

4.2.2.3.1 The Physical Training Instructors shall provide instruction and coaching to students in the Naval Special Warfare Preparatory Course. The persons for these positions shall have daily contact with junior sailors. As such, they must adhere to the highest standards of conduct in their interaction with these sailors; and understand the student/instructor relationship, the duties of the Physical Training Instructors, and provide the experienced, professional, administrative, and technical support required to achieve the desired degree of student preparation to accomplish program goals.

4.2.2.3.2 The Physical Training Instructors shall perform physical testing IAW with established guidelines set forth in MILPERSMAN

1220-410 (SEAL/EOD/SWCC/DIVER/AIRR PHYSICAL

SCREENING TESTING STRANDARDS AND PROCEDURES.

4.2.2.3.3 Physical Training Instructors are required to meet minimum PST standards within 30 calendar days from date of physical check in to Great Lakes IAW current MILPERSMAN 1220-410 SWCC candidate standards. Physical Training Instructors shall maintain a sufficient fitness level to pass these same standards on a yearly basis.

4.2.2.3.4 Physical Training Instructors, including the Leads, are required to successfully complete the High Risk Training Course (HRTC), or an executive level HRTC in accordance with NSWCEN policy.

Successful completion shall be within 30 calendar days of contract award and/or hired by the contractor; or when first offered by

NSWCEN, whichever is later. NSWCEN is responsible to teach this course and for determining all qualifications for course completion. Instructors are required to pass the course.

4.2.2.4 Specific Functions: All Physical Training Instructors shall perform specific duties to include, but are not limited to:

4.2.2.4.1 Perform and supervise physical training modules with students.

4.2.2.4.2 Demonstrate the points of performance for the exercises associated with the PST, as well as ensure exercises are being performed to the established standards.

4.2.2.4.3 Prepare students for success in SEAL, and SWCC selection and training pipelines by working with applicants to maximize their potential in aquatics and physical training modules. This shall include guidance and application of physical preparedness and training techniques for the PST to include, but not limited to, swim stroke development with and without fins, water confidence, running, and lower and upper body development.

4.2.2.4.4 Use the NSWCEN Detachment Great Lakes OIC and subordinate active duty members assigned to the Preparatory Course as the source of information for SEAL and SWCC training in order to train, brief, and inform students of changes in these programs.

4.2.2.4.5 Recommend solutions to establish and maintain

database/spreadsheet records of NSWCEN students and their status in the Naval Special Warfare Preparatory Course, specifically in regard to students’ performance on the PST.

4.2.2.4.6 Implement the established academic curriculum provided by the

NSWCEN.

4.2.2.4.7 Increase student awareness of physical standards for NSWCEN programs.

4.2.2.4.8 Provide medical attention to include, but not limited to, Cardiopulmonary Resuscitation (CPR) or Automated External Defibrillator (AED) devices while awaiting EMT Paramedics on scene.

4.2.2.4.9 Facilitate training modules in front of candidates in various forums to include, but not limited, to pool decks, classrooms, workout facilities, and podium lectures.

4.2.2.4.10 Plan and execute exit critiques. Collate results into a per class report, along with providing recommendations for curriculum changes based on critique results. Exit critique results shall be gathered from students exiting the Preparatory Course. Report shall be generated and sent to the COR within 7 calendar days following course completion.

4.2.2.4.11 The Rehab strength and conditioning coach shall be dedicated to assisting the rehab team.

4.2.2.5 Lead Physical Training Instructors: In addition to the requirements above –

4.2.2.5.1.1 Liaison with military staff, create daily/weekly schedule for students, supervise all instructors in conjunction with oversight from the P/CM, and observe safety at each training evolution. Provide guidance and counseling for instructor staff and send information to the P/CM regarding instructor climate.

4.2.2.5.1.2 Assist candidates in understanding the NSW selection pipeline, its requirements, and how to best prepare them for the selection process. As such, preference shall be given to those with experience as NSW operators.

4.2.3 Administrative Assistants (3 FTE).

4.2.3.1 Position Requirements

4.2.3.1.1 Each Administrative Assistant shall have a minimum of three (3) years recent (within the last 5 years) experience providing clerical and administrative support.

4.2.3.1.2 It is desired that each Administrative Assistant have experience within a DoD workplace.

4.2.3.1.3 Each Administrative Assistant shall, at a minimum, possess a High School Diploma, or equivalent.

4.2.3.1.4 It is desired that each Administrative Assistant have experience with the “Specific Functions” (4.2.3.2) as detailed below.

4.2.3.2 Specific Functions: The Contractor shall perform specific duties to include, but not limited to:

4.2.3.2.1 Provide data input to OIC, NSWCEN Student Control, Personnel Support Detachment (PSD) Great Lakes, and other Navy Administrative Departments to facilitate the timely execution of all student transfers and orders.

4.2.3.2.2 Assist in coordination of travel and travel orders for qualified recruits in NSWCEN training program.

4.2.3.2.3 Provide general office support to facilitate contract performance to include, but not limited to, completing data calls, answering phone calls, drafting business memos, providing timely correspondence, and requesting office materials.

4.2.3.2.4 Provide clerical and administrative support to facilitate daily coordination and activity with other administrative assistants.

4.2.3.2.5 Update presentations intended to train, brief, and inform students of changes in these programs derived from information provided by the OIC or NSW policy guidance.

4.2.3.2.6 Track student records and documents exchanged between the Contractor and Naval Special Warfare Center and Basic Training Command administrative personnel in the designated Government system.

4.2.3.2.7 Track daily student time in training and progress. Produce accurate reports and briefs for the OIC.

4.2.3.2.8 Enter course related information into Naval Special Warfare Center databases.

4.2.4 Statistician (1 FTE).

4.2.4.1 Position Requirements

4.2.4.1.1 The Statistician shall have a minimum of three (3) years’ recent (within the last 5 years) work experience conducting statistical analysis and related duties in a training environment.

4.2.4.1.2 It is desired that the Statistician possess a Bachelor’s Degree in Statistics or Computer Science, or related degree.

4.2.4.1.3 It is desired that the Statistician have practical experience with data cleaning and geospatial datasets. It is also desired for the Statistician to have experience with ggplot and language R.

4.2.4.1.4 It is desired for the Statistician to have experience with the “Specific Functions” (4.2.4.2) as detailed below.

4.2.4.2 Specific Functions: The Contractor shall perform specific duties to include, but

4.2.4.2.1 Execute responsibilities that require professional knowledge of statistics to include, but not limited to, collecting and interpreting data, data analysis, forecasting, trends, and predictions.

4.2.4.2.2 Apply statistical theories, techniques, and methods to program results and data. Prepare data for tracking.

4.2.4.2.3 Gather and interpret quantified information to include, but not limited to, run, swim, and academic and physical test results.

4.2.4.2.4 Provide analysis through mathematical modeling.

4.2.4.2.5 Communicate with the COR through point papers or power point presentations about any changes, strengths, or weaknesses derived through statistical findings. Coordinate guidance, feedback, and program evaluation with the COR prior to implementation.

4.2.4.2.6 Submit statistical reports, determined to be necessary by the COR, in order to document program effectiveness.

4.2.4.2.7 Enter course related information into Naval Special Warfare

Center databases.

4.2.4.2.8 Monitor trends in attrition and performance and communicate these trends through electronic media to the COR.

4.2.4.2.9 Provide a statistical analysis of student success/failure rates and

PST trends in a per class report, semi-annually to the COR

4.2.5 Emergency Medical Technician (EMT) Paramedics (2 FTE).

4.2.5.1 Position Requirements

4.2.5.1.1 Each EMT shall maintain a current and valid registration by the National Registry of Emergency Medical Technicians (NREMT- P). May hold a State of Illinois EMT Registration in lieu of

NREMT.

4.2.5.1.2 Each EMT shall maintain a current and valid registration as an

American Red Cross CPR/FIRST AID Instructor.

4.2.5.1.3 Each EMT shall maintain a current and valid Advanced Cardiac Life Support Certification (ACLS).

4.2.5.1.4 Each EMT shall have two (2) years of recent paramedic experience within last five (5) years.

4.2.5.1.5 It is desired that each EMT have experience with the “General Requirements” (4.2.5.2) and “Specific Functions” (4.2.5.3) as detailed below.

4.2.5.2 General Requirements

4.2.5.2.1 Paramedics shall be able to pass the minimum Navy Physical

Readiness Standards, with regard to age and sex, with a minimum passing standard of SATISFACTORY MEDIUM, as set forth in OPNAVINST 6110.1H (Physical Readiness Program). This testing shall be conducted within 30 calendar days from date of physical check in. Paramedics shall maintain this standard and be prepared to pass this standard on a yearly basis.

4.2.5.2.2 Paramedic shall be able to lift, at a minimum, 50 lbs. overhead.

4.2.5.3 Specific Functions: The Contractor shall perform specific duties to include, but

4.2.5.3.1 Provide EMT coverage for all physical training evolutions.

4.2.5.3.2 Serve as a source of medical knowledge and instruction with candidates. Be prepared to discuss injury prevention, heat/ cold related injuries.

4.2.5.3.3 Be the first responders in case of emergencies at all training sites.

4.2.5.3.4 Perform any relevant EMT duty in the course of physical and aquatic training modules.

4.2.5.4 Equipment Required: The Contractor shall outfit both paramedics with necessary medical equipment, per State of Illinois, Department of Public Health. At a minimum, each paramedic shall be supplied with the list below:

4.2.6 Logistics Management Specialist (1 FTE).

4.2.6.1 Position Requirements:

4.2.6.1.1 Each Logistics Management Specialist shall have a minimum of two (2) years recent (within the last 5 years) of experience providing logistical support in a training environment

4.2.6.1.2 Each Logistics Management Specialist, shall possess a High School Diploma, or equivalent.

4.2.6.1.3 It is desired that each Logistics Management Specialist possess working knowledge of DoD program planning, funding, and management information systems (computer programs), as well as a broad knowledge of logistical support.

4.2.6.1.4 It is desired that each Logistics Management Specialist possess knowledge of DoD logistics support activities involved including, but not limited to, maintaining inventory of all student and instructor equipment, as well as Government property.

4.2.6.1.5 It is desired that each Logistics Management Specialist have experience with the “Specific Functions” (4.2.6.2) as detailed below.

4.2.6.2 Specific Functions: The Contractor shall perform specific duties to include, but

4.2.6.2.1 Manage all logistics involved with this program.

4.2.6.2.2 Distribute and appropriately handle and maintain inventories necessary to training (e.g. medical gear, training supplies, training equipment, gym equipment, instructor, and student gear issues).

4.2.6.2.3 Coordinate with the OIC to ensure that the students receive the necessary gear/equipment to train. Communicate with the OIC to maintain inventory levels for all required student gear at all times.

4.2.6.2.4 Coordinate and assist in the development and performance logistics management operations that involve planning, coordinating, and evaluating the logistical actions required to support the NSW Preparatory Course.

4.2.6.2.5 Track inventory of material purchased or furnished by NSWCEN to include but not limited to training equipment and gear issued to students.

4.2.6.2.6 Recommend the specific requirements for inventory levels and material, and correlate those requirements with program plans to ensure that the required materials are provided at the right time and place.

4.2.6.2.7 Organize and enter data into logistics information systems.

Coordinate with OIC on facilities, budget, transportation, and procurement functions. Integrate the separate functions of planning and implementing them into a logistics management program.

4.2.6.2.8 Assist the OIC to perform resource allocation requirements to include, but not limited to, effective programming, management, allocation, and execution of program resources. Submit Unfunded Requirements (UFRs) to OIC for both facility upgrades and appropriated fund requests enhancing student equipment for Naval Special Warfare Preparatory Course.

4.2.7 Transportation Specialists (3 FTE).

4.2.7.1 Position Requirements:

4.2.7.1.1 Each Transportation Specialist shall have a minimum of one (1) year recent (within the last 5 years) experience providing logistical support in a training environment

4.2.7.1.2 Each Transportation Specialist shall possess a High School Diploma, or equivalent.

4.2.7.1.3 Each Transportation Specialist shall possess a current and active military or civilian equivalent bus license (CDL-commercial driver’s license). Contractors designated as Transportation Specialists who carry the necessary licenses shall be allowed to use Government vehicles for transportation of students and personnel to and from training evolutions.

4.2.7.1.4 It is desired that each Transportation Specialist possess knowledge of DoD transportation systems and record keeping.

4.2.7.1.5 It is desired that each Transportation Specialist have experience with the “Specific Functions” (4.2.7.2) as detailed below.

4.2.7.2 Specific Functions: The Contractor shall perform specific duties to include, but

4.2.7.2.1 Drive / Transport students in support of training evolutions etc.

Transportation Specialists shall drive contractor personnel as well as students.

4.2.7.2.2 Assist the OIC, through the Logistics Management Specialist, on management of material including initial planning, provisioning and requirements determination, and process inventory from central stocks including distribution, accountability, and ultimate issue for consumption, retention or disposal.

4.2.7.2.3 Perform analytical work to manage, regulate, coordinate, or otherwise exercise control over supplies, equipment, or other material.

4.2.7.2.4 Monitor and track all inventory issues to include but not limited to issuing of necessary training gear, organizing inventory, requesting inventory purchases, etc.

5. PHASE IN/OUT (OPTIONS):

5.1 Phase In (Option):

5.1.1 To minimize any decreases in productivity and to prevent possible negative impact on additional services, the Contractor shall have all key personnel on board, during the one

(1) month phase-in period and conduct key personnel left seat/right seat knowledge transfer with incumbent personnel for a period of 2 weeks, specific timeframe within the one (1) month phase-in period to be coordinated with the COR. During the phase-in period, the Contractor shall become familiar with performance requirements, in order to commence full performance of services on the start of the base period of performance.

5.1.2 During the Phase-In, the Contractor shall coordinate with the COR for the following: All

Contractor personnel shall in-process through the designated Government personnel to ensure compliance with the Government’s requirements for establishment of e-mail accounts, Common Access Cards (CAC), security measures, etc. The incoming Contractor shall coordinate with the COR for any additional in-processing requirements for all Contractor employees. By the end of the phase-in period, the Contractor shall be at full operational capability and prepared to perform the PWS in its entirety, with all personnel in place and performing assigned functions.

5.1.3 During the phase-in process, the incoming contractor shall ensure that its Phase-In processes do not hinder or interfere with normal operations and that maximum effort is made to avoid loss of productivity.

5.1.4 The incoming contractor shall: observe operations of the incumbent’s work force, if applicable, if applicable and desired, interview incumbent work force personnel off-site and secure all work products and documents needed to accomplish all contract requirements. Any and all required proof of current and valid certifications, etc. shall be provided to the Government at the Post-Award Conference.

5.1.5 Only those employees with a need to know will be allowed to observe operations.

5.1.6 Throughout the contract performance the Government reserves the right to ask for resumes, certifications, and related documents if concerns arise regarding personnel qualifications.

5.2 Phase Out (Option):

5.2.1 Prior to the completion of this contract, an observation period shall occur, at which time team management personnel of the incoming Contractor may observe operations. This will allow for orderly turnover of facilities, equipment, and records and will help to ensure continuity of services. The outgoing Contractor is ultimately responsible for performing full services IAW the contract, during the phase-out period, and shall not defer any requirements for the purpose of avoiding responsibility or of transferring such responsibility to the succeeding Contractor. The outgoing Contractor shall fully cooperate with the succeeding Contractor and the Government, so as not to interfere with their work or duties.

5.2.2 To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the outgoing Contractor shall have all personnel on board during the phase-out period. The outgoing Contractor shall be prepared to transition the work load to the newly selected Contractor during the phase-out period, which will occur at the end of the period of performance of the contract.

5.2.3 The outgoing Contractor shall develop a phase-out plan to affect a smooth and orderly transfer of contract responsibility to a successor. The plan shall fully describe the Contractor’s approach to the following issues, at a minimum: Inventories and turn-over of government property; removal of Contractor property; reconciliation of all property accounts; turn-in of excess property; data and information transfer; clean-up of Contractor work areas; and security debriefings in accordance with applicable regulations for incumbent personnel holding security clearances; and any other actions required to ensure continuity of operations. The Contractor shall provide the plan to the COR thirty

(30) days before the phase-out period commences. Phase out period is sixty days prior to contract expiration.

5.3 Participate in a Post-Award Conference

5.3.1 This meeting shall provide an introduction between the Contractor personnel and

Government personnel who will be involved with the contract. This meeting will be scheduled at a mutually agreeable time between the Contractor and Government, but shall take place no more than 30 calendar days after contract award, unless agreed upon in writing by the Contracting Officer. The Post Award Conference will aid both the Government and Contractor in achieving a clear and mutual understanding of all requirements, and identify and resolve any potential issues. The Contractor shall be prepared to discuss any items requiring clarification and gather information as necessary to support each deliverable. The Contractor shall provide a written summary of the Post- Award Conference to the COR within five (5) calendar days after Post-Award Conference.

6. PHYSICAL SECURITY: The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use. At the close of each day, shift, or work period, Government facilities, equipment, and materials shall be secured.

7. WORK HOURS / HOLIDAYS

7.1 It is anticipated that work will occur only Monday – Friday, excluding all federal holidays and any days designated in accordance with 7.4 below. No services or deliveries shall be performed on Saturdays, Sundays or Federal legal holidays. Deliverables due on a Saturday, Sunday, or Federal holiday shall be due on the following business day. No overtime is anticipated under this contract, however in the event it is required, it must be pre-authorized by the Contracting Officer in writing.

7.2 Observance of Federal Holidays:

7.3 If the date falls on a Saturday, the Government holiday is the preceding Friday. If the date falls on a Sunday, the Government holiday is the following Monday.

7.4 In addition to the days designated as holidays, the Government observes the following days:

Any other day designated by Federal Statute Any other day designated by Executive Order Presidential Inauguration Day Any other day designated by the President’s Proclamation

7.5 It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. This provision does not preclude reimbursement for authorized overtime work if applicable to this contract.

7.6 When the Federal, State, Local or other Government entity grants excused absence to its employees, assigned Contractor personnel may also be dismissed. The Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and must be guided by the instructions issued by the Contracting Officer or Contracting Officer’s Representative (COR).

Additionally, if Government personnel are unavailable due to furlough or any other reason, the Contractor must contact the Contracting Officer or the Contracting Officer’s Representative (COR) to receive direction. The Contracting Officer shall determine whether the contract price may be affected.

Generally, the following situations may apply:

7.6.1 Contractor personnel who are able to continue contract performance must continue to work and the contract price shall not be reduced or increased.

7.6.2 Contractor personnel who are not able to continue contract performance (e.g., support functions) may be asked to cease their work effort. This may result in a reduction to the contract price.

8. RIGHTS IN DATA

8.1 The Contractor shall not copyright, publish or disseminate information resulting from work performed under this contract, and/or, use data produced or obtained under this contract, and/or any other information or products provided by the Government, or which the Contractor develops, for any purpose other than performance under this contract without prior written approval from the Contracting Officer.

8.2 Ownership of Documents, Materials and Records: All documents, materials (including any computer code) or records provided to the contractor, developed or maintained by the contractor in the performance of this contract are deemed to be property of the Government.

9. LIMITED USE OF DATA

9.1 Performance of this effort may require the Contractor to access and use data and information proprietary to a Government agency or Government contractor, which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the Government and/or others.

9.2 Contractor and/or contractor personnel shall not divulge or release data or information developed or obtained in performance of this effort, until made public by the Government, except to authorized Government personnel or upon written approval of the Contracting Officer. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the Contractor without such limitations or prohibit an agreement at no cost to the Government between the contractor and the data owner which provides for greater rights to the Contractor.

10. DISCLOSURE OF INFORMATION

10.1 Information made available to the Contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer.

10.2 The Contractor agrees to assume responsibility for protecting the confidentiality of Government records, which are not public information. Each Contractor or employee of the Contractor to whom information may be made available or disclosed shall be notified in writing by the Contractor that such information may be disclosed only for a purpose and to the extent authorized herein.

11. PRIVACY ACT AND HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT

(HIPPA)

11.1.1 The Contractor will have access, work with, and/or have to input personally identifiable information (PII) into Government Information Systems in performance of this contract.

The Contractor shall adhere to Privacy Act requirements and applicable DoD, Department of Navy (DoN), and United States Special Operations Command (USSOCOM) regulations, instructions, directives and policies regarding PII, including but not limited to NIST 800-122 “Guide to Protecting the Confidentiality of Personally Identifiable Information (PII).”

11.1.2 The Contractor may have access, work with, and/or have to input personal health information (PHI) into Government Information Systems in performance of this contract.

The Contractor shall adhere to HIPPA requirements and applicable DoD, DoN, and United States Special Operations Command regulations, instructions, directives and policies regarding PHI, including but not limited to NIST 800-66 “An Introductory Resource Guide for Implementing the Health Insurance Portability and Accountability Act (HIPAA) Security Rule.”

11.1.3 For both PII and PHI, the Contractor agrees to assume responsibility for protecting such information, using best practices, and compliance with applicable references.

13. CONTRACTOR MANPOWER REPORTING

13.1 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Naval Special Warfare Command via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs http://www.ecmra.mil/ will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. 14. CONTRACTOR TRAVEL

14.1 All Physical Training Instructors, including the Leads, shall participate in the NSW Professional Development High Risk Training (HRT) Course for instructors. The course itself is not high risk but for personnel instructing NSW courses. This will be required one time per FTE and will require travel to San Diego, CA. FTEs that have previously taken the NSW Professional High Risk Training or an equivalent Special Operation Forces (SOF) course while a military member or under a previous contract vehicle are not required to retake the course for this contract. If requested, the contractor may have to provide verification of such training, and if not with NSW, that such training was equivalent.

Any new FTE(s) shall attend the training, should personnel turnover occur. Specific training dates will be determined during the period of performance in coordination with the COR. The exact duration, location, schedule and format of the HRT instructor course is subject to change and may include alterations. An associated travel expenses shall be considered in the Contractor’s Firm-Fixed Price; the Government shall not separately reimburse the Contractor for any associated travel expenses.

14.2 The Contractor is authorized to participate in appropriate training or events as professional development of the FTEs specified in this contract subject to NSWC concurrence and as long as it does not interfere with performance requirements under this contract. Such training or events may be required to maintain certifications or attend conferences to increase knowledge in the field the FTE is working under this contract. All training dates/times shall be coordinated with the COR as to ensure it does not negatively impact training events.
