About this file
This is an amendment to a solicitation for Survival, Evasion, Resistance, Escape and Personnel Recovery training and training support services. The amendment revises the performance work statement, service contract act wage determinations, required resource lists, proposal instructions and evaluation criteria. Interested parties must request a copy of the revised performance work statement and attachments from the specified contracting officer by 11 September 2019. The Naval Special Warfare Command is seeking proposals for SERE/PR training courses to be conducted in California, Virginia, and Alaska over a one year base period and four one-year options. Offerors must propose fixed prices for course materials with a not-to-exceed of $70,000 per period, and travel with a not-to-exceed of $49,700 for the base period and incrementally higher amounts for options. Proposals are due on an undetermined date and the agency intends to make a single-award fixed price contract.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SUBMISSION REQUIREMENTS
L.1 General Instructions to Offerors
L.1.1 This is an all-electronic solicitation release. No hard copies will be mailed. Amendments to the solicitation will be posted to www.fedbizopps.gov. It is the responsibility of each offeror to review the webpage for notice of amendments, updates, or changes to current information. The exclusive responsibility for the source selection will reside with the Government. Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. 423) as implemented in the FAR. The proposal and corresponding program will be unclassified and treated as Source Selection Sensitive Information.
L.1.2 All proposals must be complete, self-sufficient, and respond directly to the requirements of the solicitation.
Any commitments made in the proposal shall become part of the resultant contract. Any inconsistency, if unexplained, raises a fundamental issue of the offeror’s understanding and/or ability to perform under a contract.
This may be a basis for rejection of the proposal. In no case shall words like “we will comply with the requirements of the contract,” or equivalent statements, be acceptable to meet the requirements of this RFP. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Use of documentation by reference, and not incorporated into the proposal, will not be allowed. Where cross-referencing is used, the volume, attachment, exhibit, and paragraph numbers, as appropriate, shall be referenced. Offerors shall provide separate responses to each technical evaluation factor within the identified page limitations. Offerors shall not exceed the page limitation by cross referencing other sections of their proposals. Failure to comply with these instructions may result in an offeror’s proposal being excluded from further consideration for award. Offerors shall submit with their proposals a list of names and telephone numbers of persons authorized to conduct negotiations.
L.1.3 The evaluation will consist of an evaluation of submitted Contract Forms and Certifications, Qualifying Criteria, Technical Capability, Past Performance, and Price, which are outlined below.
L.1.4 Proposals shall not contain classified information
L.1.5 Proposal Format. Format of the proposal volumes shall be as follows:
a. Text size shall be no smaller than Microsoft Word, Times New Roman, 10 point, uncompressed font, including in any tables, charts, graphs or figures. For table, charts, graphs or figures, text is permitted to be single spaced.
b. Pages shall be single sided, one and one half spaced, with a minimum of one inch margins on all sides.
Pages shall be dated and numbered sequentially by volume. A cover sheet should be included in each volume, clearly marked as to volume number, title, solicitation identification, and the offeror's name.
c. Elaborate format and color representations are not desirable. Cover sheet per volume is limited to one page and will not count against the aggregate page limitations listed under the table in Section L.1.6.
d. Electronic copies must be provided via E-mail. Microsoft Office Word processing software and Excel spreadsheet software formats are required.

L.2.2 The Government will review Volume 1 for completeness and that the offeror indicated that it is eligible for a Government contract based on the offeror’s responses to the representations, certifications, all contract forms, and other statements required by the solicitation. The offeror shall ensure all Contract Forms, Representations, and Certifications have been completed as required.
L.3 Volume 2, Factor 1: Qualifying Criteria: Facility Clearance and Small Business Participation. This volume is limited to two (2) pages.
L.3.1 Evidence of SECRET Facility Clearance. Offeror shall provide documentation evidencing the offeror holds an active Secret Facility Clearance as accredited by the Defense Security Service (DSS). The offeror must have an active Secret Facility Clearance as accredited by the Defense Security Service (DSS) as of solicitation closing date.
The Government will review the offeror's submission and also verify the offeror’s clearance status and level in the DSS Industrial Security Facilities Database (ISFD) upon solicitation closing.
L.3.2 All offerors shall submit a summary statement describing the degree in which the offeror intends to utilize small businesses in the execution of this tasking. Offerors shall disclose, as a total percentage of the price of this tasking, the extent this tasking will be set-aside to small-businesses. If an offeror is a small business, the offeror shall state the total percentage of this tasking to be performed by their firm, the percentage of this tasking they intend to set-aside to other small businesses (if any), and the total percentage of this tasking to be sub-contracted to large business. Offerors shall include the name, address, CAGE code and business size (small or large) of the proposed sub-contracted entity. Offerors are referred to the table below, which reflects the stated small business objectives of the agency:
SECTION L – Table 1. Small Business Subcontracting Goals
CATEGORY MINIMUM
REQUIREMENT
Small business 21% Small disadvantaged ** 5%
Woman owned** 5%
HUBZone** 1% Service Disabled Veteran Owned** 3%
**Included in overall Small Business goal of 21%
NOTE: Submission of summary statement for the small business participation factor SHALL NOT RELIEVE large businesses of the requirement to submit a formal small business subcontracting plan in accordance with Federal Acquisition Regulation (FAR) 52.219-9 and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003 Alt I. A small business subcontracting plan, complying with the requirements of FAR 52.219-9 and DFARS 252.219-7003 Alt I, will be assessed by the contracting officer prior to issuance of award, and shall be incorporated into any resulting contract. Submission of a formal small business sub-contracting plan is not required at quote submission but may be requested in writing by the contracting officer prior to an award decision.
L.4 Volume 3, Factor 2 – Technical Capability. This section is limited to fifteen (15) pages, inclusive of any title page, table of contents, acronym lists, and photographs, maps and/or diagrams as supporting documentation for offeror’s facilities described below. The fifteen (15) page limit is exclusive of Key Personnel resume(s). Key Personnel resume(s) are limited to two (2) pages each.
L.4.1 The purpose of the Technical Capability Volume is to provide a concise summary of the offeror’s overall capability and approach to support Survival, Escape, Resistance, Evasion and Personnel Recovery (SERE/PR) training and training support. Under the Technical Capability Factor, the Government will evaluate two sub-factors of the offeror’s overall approach to support SERE/PR training and training support. The two sub-factors under the technical capability factor are technical approach and staffing plan. Of the two sub-factors, technical approach is more important than staffing plan:
Technical Approach: The contractor shall provide a written narrative explaining the offeror’s approach and ability to provide/support the four (4) listed SERE/PR training courses referenced under Performance Work Statement (PWS) paragraphs 3.1 and 4.1.2 and to perform logistic and curriculum support (PWS 3.2, 3.3, 4.2 and 4.3).
Offerors shall consider these PWS paragraphs and all associated sub-paragraphs when developing their technical approach. NOTE: An offeror’s technical approach to provide SERE/PR course training and support services shall not be focused on the offeror’s past performance. Rather, the offeror is encourage to describe their approach to the requirement listed in the requiring paragraphs above.
Staffing Plan: The offeror shall address the firms’ plan for recruiting and retaining qualified staff to support SERE/PR training and training support. The offeror shall identify composition of labor, inclusive of all labor categories that will be utilized to perform the effort. Offerors shall address the possibility of staffing shortages, the approach for replacement of departing staff and how the offeror intends to minimize or eliminate any potential disruption of service. Offeror may provide historical data on employee retention rates in similar labor markets associated with similar tasking. As part of the staffing plan, the offeror shall submit resumes for each Contract Manager proposed under this solicitation. Resumes per candidate shall be limited to two (2) pages and candidates shall meet the requirements listed under PWS paragraph 4.4.1.2.2. NOTE: The Government is not requesting offerors provide dedicated staffing by course (excluding Kodiak, Alaska). The Government envisions labor resources to be utilized across multiple courses and to be used to perform logistic and curriculum tasking in a manner that provides efficiency in performance and price. Offerors shall address how they intend to efficiently utilize labor resources to secure efficiencies in tasking and in pricing.
L.5 Volume 4, Factor 3: Past Performance
L.5.1 Contents. The offeror shall submit a Past Performance Proposal containing the following:
1. Summary Page (limited to one (1) page per submitted reference) describing the role of the offeror and each major subcontractor, teaming partner, and/or joint venture partner during performance of this contract. “Major subcontractor” is defined as performing 25% or greater of the total evaluated price.
2. Past Performance Information Sheet providing POCs and describing the relevancy of the experience to this effort (Attachment 3).
3. Past Performance Questionnaire (Attachment 4) or CPARS.
L.5.1.1 Past Performance Information Sheet (Attachment 3). Submit a maximum of three (3) past performance relevant and recent experiences, including associated CPARS where applicable. The Government defines “recent” as contracts that have been performed during the past three (3) years from the date of issuance of this solicitation, and have at least six (6) months performance within the last three (3) years from solicitation issuance. The Government requires at least one (1) information sheet from the offeror to reflect an effort acting as a prime contractor on the experience. The Past Performance Information Sheet for each experience is limited to three (3) pages, and shall reference only one contract/order per Sheet. The offeror shall complete the Sheet in its entirety, including current and accurate points of contact (POCs) for each contract/order identified. POCs could include contracting officer’s representatives (CORs), program managers, end users, contracting officers, other Government agency representatives and/or commercial customers. Offerors are cautioned that the Government may use information obtained from other sources for the evaluation of past performance, including references and information not identified by the Offeror. The Government reserves the right to limit the number of references it decides to contact.
L.5.1.1.1 Past Performance Questionnaire (Attachment 4). For each contract reference submitted under a Past Performance Information Sheet, the offeror shall reference/submit a CPAR, or if there is no associated CPARS for the experience, the Offeror shall forward the Past Performance Questionnaire (Attachment 4) to the offeror’s POCs.
Offerors are to request their POCs to submit the completed questionnaire directly to the contracting officer prior to the closing of the solicitation. The Government retains discretion but is not required to consider Past Performance Questionnaires received after the proposal submission due date. Therefore, any questionnaires received after the solicitation closing may not be considered by the Government for purposes of the Factor 2 – Past Performance evaluation and rating. At its discretion, the Government may also use the Past Performance Questionnaire to contact sources for additional information, where appropriate. NOTE: Offerors shall not submit a Past Performance Questionnaire for contracts/orders where a CPARS is available.
L.5.1.2 Relevant Contracts. Relevancy will be determined based on the degree to which the submitted experiences are relevant to this effort concerning scope (e.g., providing SERE/PR training similar to the courses required by the PWS), magnitude (e.g., dollar amount (tasking on an annual basis at or above $2M), and complexity (e.g.
performance at multiple geographically dispersed locations similar to requirements under the PWS). The more the overall effort is similar in all areas, the more relevant it becomes. The Government does not assume the duty to search for data to cure any problems it finds in the past performance information provided by the Offeror; the burden of providing thorough and complete relevant past performance information remains with the Offeror.
L.6 Volume 5, Factor 4: Price
L.6.1 Offerors shall submit pricing for all course related contract line items listed under Section B of the SF33. A total of seventeen (17) line items shall be priced and the Government has entered established contract line item values for all material and travel contract line items. Base period and option periods, excluding the option provision at 52.217-8 and the Phase-in/Phase-out line items, are for twelve months. The option at 52.217-8 represents a six month period of performance and offerors shall not submit pricing for this option. Phase-in represents a one month period of performance and Phase-out represents a two month period of performance. The option at 52.217-8 will be calculated by the Government by taking 50% of the value of CLINS 4001, 4002 and 4003.
With each offeror’s pricing submission, the offeror shall submit a narrative describing the composition of labor, material and travel proposed for each period of performance to include listing of labor categories, number of hours per labor category and the fully burdened labor rate per labor category. At a minimum, per period of performance, the following shall be provided by the contractor: Labor per period of performance: List labor category, number of hours and fully burdened labor rate; Material per period of performance: Material description, quantity and price; and Travel per period of performance: Summary of travel expenditures and price.
SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
BASIS FOR AWARD
Section M – Evaluation Factors for Award
M.1 Best Value Introduction. This section outlines the criteria the Government will use in evaluating the offeror’s capabilities and proposals for the SERE/PR training and training support services contract. The Government will compare each offeror’s capabilities and proposal elements against the predetermined evaluation criteria related to the Government’s requirement defined herein. This is a competitive, best value source selection that will be conducted in accordance with (IAW) Federal Acquisition Regulation (FAR) Part 15 and Defense Federal Acquisition Regulation Supplement (DFARS) Part 215. The Government intends to issue a single award firm fixed price contract as a result of this solicitation.
Discussions. IAW FAR 15.306, the Government intends to evaluate proposals and award a contract without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. After completion of the evaluation if the Government determines discussions necessary, the Government may establish a competitive range and conduct discussions with only the offerors in the competitive range. The Government reserves the right for efficiency purposes to only include the most highly rated proposals in the competitive range. Offerors may be asked to clarify certain aspects of their Technical, Past Performance, and Price proposal. Exchanges conducted with regard to adverse past performance, or to resolve minor or clerical errors in any of the proposal volumes will not constitute discussions, and the Procurement Contracting Officer (PCO) reserves the right to award a contract without granting an opportunity to revise the original proposal.
While the Government Source Selection Evaluation Board (SSEB) and the Source Selection Authority (SSA) will strive for maximum objectivity, the source selection process, by its nature, is subjective, and therefore, professional judgment is implicit throughout the entire process. This may result in an award being made to a higher rated, higher priced offeror where the decision is consistent with the evaluation factors and the SSA reasonably determines that the technical superiority, and/or superior past performance, of the higher priced Offeror outweighs the price difference. The SSA will base the source selection decision on an integrated assessment of proposals against all source selection criteria in the solicitation. The SSA will not qualitatively assess or compare the Qualifying Criteria considerations, and will only verify whether an Offeror received an acceptable rating for this factor. Proposals receiving an unacceptable rating for the Qualifying Criteria or any evaluation factor will be ineligible for award.
An offeror’s failure to submit a complete solicitation response or failure to comply with solicitation instructions and/or an offeror’s failure or refusal to assent to any terms or conditions of the solicitation may constitute a deficiency. A deficiency may result in the offeror receiving an unacceptable rating and may lead to rejection.
The only way to correct a deficiency would be through discussions per FAR 15.306(d). The Government intends to make an award without discussions, but reserves the right to hold discussions if determined to be in the best interest of the Government.
M.1.1 Best Value Evaluation. The Government will review submitted Contract Forms and Certifications (Volume 1) for completeness and that the offeror indicated that it is eligible for a Government contract based on the offeror’s responses to the representations, certifications, all contract forms, and other statements required by the solicitation. The offeror shall ensure all Contract Forms, Representations, and Certifications have been completed as required. Once review of Contract Forms and Certifications is complete, the Government will evaluate qualifying criteria. “Qualifying Criteria” will receive an acceptable or unacceptable rating. An unacceptable rating renders the proposal ineligible for award and the Government will not evaluate the remaining factors. Once evaluation of qualifying criteria is complete, the Government will evaluate the remaining factors one through four. Technical Capability will be evaluated using a combined Technical/Risk Rating using the DOD Source Selection Guide adjectival rating technique and Past Performance will receive an overall confidence level rating. The Price Factor will not be given an adjectival rating or scored.
The relative order of importance of the non-price factors is as follows; Technical Capability is the most important non-price factor and is more important than Past Performance. When combined, the non-price factors are significantly more important than Price. The importance of Price as an evaluation factor will increase with the degree of equality of the proposals in relation to the remaining evaluation factors. When the Offerors are considered essentially equal in terms of Technical Capability and/or Past Performance or when Price is significantly high as to diminish the value of the Technical and Past Performance superiority to the Government, Price may become the determining factor for award. In summary, price/technical trade-offs will be made, and the extent to which one may be sacrificed for the other is governed only by the tests of rationality and consistency with the established evaluation factors.
Qualifying Criteria Volume 2, Factor 1 Acceptable/Unacceptable Technical Capability Volume 3, Factor 2 Technical/Risk Rating
Past Performance Volume 4, Factor 3 Confidence Rating Price Volume 5, Factor 4 Total Evaluated Price
M.2 Factor 1: Qualifying Criteria.
M.2.1 The offeror must have an active Secret Facility Clearance as accredited by the Defense Security Service (DSS) as of the solicitation closing date. The Government will review the offeror's submission and also verify the offeror’s clearance status and level in the DSS Industrial Security Facilities Database (ISFD) upon solicitation closing. Proposals which do not demonstrate the required facility clearance will receive an unacceptable rating and will NOT be further evaluated. Specifically, the Government will not evaluate the remaining Factors 1-4, and the Offeror will be ineligible for award.
M.2.2 Small Business Participation will be evaluated on an acceptable/unacceptable basis. In order to receive an acceptable rating, the proposal must indicate an adequate approach and understanding of small business objectives, which is defined as meeting the overall 21% small business set-aside goal, listed under SECTION L
– Table 1. Small Business Subcontracting Goals, at a minimum. An offeror proposing utilization of small business under the 21% objective will receive an unacceptable rating. The 21% small business goal is irrespective of the socio-economic categories for which the proposed small businesses reside.
NOTE: The apparent successful offeror, if a large business, shall be required to submit a Small Business Subcontracting Plan, satisfying the requirements of Federal Acquisition Regulation (FAR) 52.219-9 and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003 Alt I, for the contracting officer’s assessment prior to award (this requirement is not applicable to Small Business offerors). Submitted plans will be assessed using the Attachment 8 Small Business Subcontracting Plan Assessment Checklist. NOTE:
Subcontracting plans that contain a Small Disadvantage Business goal of less than 5% may be rejected if approval in accordance with SOFARS 5619.705-4 is not obtained. Submission of a formal Small Business Subcontracting Plan will be requested in of the apparent offeror prior to award.
M.2.3 Any unacceptable rating in the above two qualifying criteria may result in the proposal being considered ineligible for award.
M.3 Factor 2: Technical Capability. Under the Technical Capability Factor, the Government will evaluate two sub-factors of the offeror’s overall approach to support SERE/PR training and training support. The two sub-factors under the technical capability factor are technical approach and staffing plan. Of the two sub-factors, technical approach is more important than staffing plan: to SERE/PR training and training support:
Technical Approach: The Government will evaluate the extent to which the Offeror demonstrates overall technical capability and merit to successfully provide SERE/PR training and training support. Specifically the Government will evaluate the offeror’s ability to provide the four (4) listed SERE/PR training courses and perform logistic and curriculum taskings referenced under PWS paragraphs 3.1; 3.2; 3.3; 4.1.2; 4.2; 4.3; and all associated sub-paragraphs.
Staffing Plan: The Government will evaluate the extent to which the Offeror demonstrates the ability to successfully recruit and retain qualified staff to support SERE/PR training and training support by addressing the possibility of staffing shortages, the approach for replacement of departing staff and how the offeror intends to minimize or eliminate any potential disruption of service. As part of the staffing plan, the Government will review submitted resumes and evaluate the extent to which the proposed candidate(s) for the Contract Manager labor category meet the requirements listed under PWS paragraph 4.4.1.2.2.
Evaluation of the two sub-factors shall focus on the strengths, deficiencies, significant weaknesses, and weaknesses of the offeror’s proposal. Evaluation of risk associated with the offeror’s proposal is inherent in the evaluation.
Note that if an offeror’s proposal demonstrates a material failure to meet a Government requirement, it is a deficiency in the offeror’s proposal. The Government will compare each offeror’s technical proposal against the Government’s requirements identified within this solicitation. The Government will assign a single Combined Technical/Risk Rating to Factor 1 - Technical Capability, as a result of evaluation of the two sub-factors. The technical approach sub-factor is more important than staffing plan. Ratings are shown in the Table 1 below.
