South Garage Repairs Solicitation GS-11-P-17-YM-C-0021, Amendment 0009, Attachment #1
Questions & Responses
South Garage Concrete Repairs
At
Department of Labor
July 26, 2017
Q1. ( Note: GSA heavily edited this question for clarity purposes. ) We believe the unit price sheet (Spec Section 012200) has a communication disconnect. Example original doc. Listed 10000 sf of x and a secondary number that indicated say 500 sf. That secondary number was to indicate that if the larger quantity was increased or decreased by more than the 500sf, then the unit rate could be adjusted. But since the addenda 8, the 10000sf has become 3000sf for argument sake and the secondary number changed to 50 sf. The 3000sf reflecting an expected quantity based on a number shown on the south garage drawing. So it is obvious that the secondary number cannot reflect an expected quantity. We believe the small number was expected to be a plus or minus range for unit pricing stability from the larger anticipated number.
R1. Any reference to “bid” is to mean “proposal” for this response. Specification Section 012200 Unit Prices serves to provide the contractor with an estimated base bid quantity and to provide GSA an opportunity to establish unit prices. Using Unit Price #2 from 012200 as an example, the specification requires that the contractor include in the base lump sum price the estimated quantity of 3,500 SF (See 3.1B.3). The Limits of Variation in this case is 535 SF and was calculated based upon FAR 52.211-18 Variation in Estimated Quantity clause (incorporated into the solicitation per Amendment 0007 Response 52). In summary, the clause states that if the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. Using our example, this means that the estimated quantity could fluctuate plus or minus 535 SF from the estimated quantity or a range from 2,965 SF to 4,035 SF and no equitable adjustment would be warranted. The unit price provided in 3.1.B.5 would be used in an adjustment if the quantity was outside of the Variation in Estimated Quantity.
In order to evaluate the unit pricing, GSA will use the Limits of Variation quantity identified in Section 012200 multiplied by the Unit Rate for an extended total. All ten Unit Prices will be totaled and added to the lump sum base bid for evaluation purposes only. However, the Unit Prices will remain fixed for the duration of the contract and will apply to any equitable adjustment covered by FAR 52.211-18.
GSA has attempted to clarify this methodology in the Revised Solicitation Section VI.B Method of Award dated July 26, 2017 and the revised Specification Section 012200 also dated July 26, 2017.
Offerors are to provide Section 012200 with their proposal submission.
