C201 Supplement - Mult. Award IDIQ Page 1 of 2 March 2010

Supplemental Info For Solicitation – IDIQ Multiple Award Solicitation No. GS-03P-10-QM-D-0037

II.B.4. Additional Price Proposal Requirements

Price Proposal Evaluation

1. A percentage factor must be submitted for all items or the proposal may be rejected from further consideration.

2. The unit prices and percentages listed on the offeror’s form must contain the offeror’s overhead, profit, payment and performance bond premiums, and all contingencies in connection therewith, as no allowance will be made later for such items. (Prices for any unpriced line item will be determined through negotiations at the time the order is placed.)

3. The percentage factors will be applied to all unit prices for working and nonworking hours respectively, as listed on the Supplemental Sheets to Solicitation Offer and Award - Standard Form 1442.

4. The percentages listed on the bid form must contain the bidder's overhead, profit, payment and performance bond premiums, and all contingencies in connection therewith, as no allowance will be made later for such items.

5. Offers will be evaluated by multiplying the proposed unit prices by the estimated annual quantities and adding the product of these unit prices to calculate the total proposed amount for the Base Year as proposed on Attachment A to the Standard Form 1442. Further, the proposed unit prices will be adjusted by the proposed option year percentages to develop a proposed amount for each of the option years as proposed on Attachment A of the Standard Form 1442.

Each option year total will then be added to the proposed base year amount for a total evaluated proposal price.

6. The approach to source selection for this procurement will be pursuant to the greatest value concept. Award will be made to the offeror whose proposal offers the greatest value for the funds expended, not necessarily the lowest price. The greatest value concept will provide the source selection board the opportunity to make a value (price/technical trade-off) analysis. An award may be made without discussion. A competitive range will be established, after evaluation, for the purpose of conducting written or oral discussions. The competitive range will be determined on the basis of technical qualifications identified in the solicitation along with price and will include all proposals that have a reasonable chance of being selected for award.

7. Proposal prices For contract award and payment purposes, the unit prices shown in the SUPPLEMENTAL SHEETS TO STANDARD FORM 1442 shall be adjusted by any increase or decrease in the bid for work permitted to be performed during regular working hours and work ordered to be performed outside regular working hours. This could result in two different unit prices to be paid for the same work depending on the proposal and whether the Government orders the work to be performed outside regular work hours. If the Government permits the Contractor to work during regular work hours and the Contractor elects to perform that work (or portions thereof) outside regular work hours, payment will be made at the unit price provided for the work permitted during regular work hours.

In any case, the contract unit prices multiplied by the quantity involved, as adjusted and rounded to whole pennies will constitute total compensation for the work ordered under the contract and shall include all costs including, but not limited to, material, mobilization, labor and equipment

Special Pricing Conditions for IDIQ Contracts:

1. PRICE PROPOSALS: Each Offeror must submit a Cost Structure as listed in the Continuation Sheet to the Standard Form 1442 and must completely provide all information as requested on this document. The rates offered by the contractor may be negotiated during the source selection process. If awarded a contract under this solicitation, the negotiated rates will be accepted by the government as NOT TO EXCEED RATES to be used in pricing future projects/modifications for the contract. The rates requested are intended for use in situations where the Government and awardee are conducting sole source negotiations for the price of project work. Sole source negotiations may occur when pricing modifications to an awarded order, or when the Government uses the authority to enter into sole source negotiations for a new order as detailed in Paragraph titled “Method of Placement of Orders Under Multiple Award Contracts” in the Agreement. The intent of this contract is to compete RFP's for each project among the awardees, and in situations where adequate price competition is available, the Government will generally not request a price breakdown. Rather, GSA envisions that most project proposals will be submitted on a lump sum basis and the offerors shall include all mark-ups related to that project and all proposed preparation costs within that lump sum price. While some circumstances may arise in which a price breakdown is required for a specific RFP, it is the Government's intent to use the not-to exceed mark-up rates requested only in situations where GSA and the offeror/awardee are negotiating a price in a sole source environment.

For award purposes, the proposed cost structure as requested in the RFP will be evaluated based on a comparison of the proposed total cost structure for each of the elements listed with similar rates paid by GSA on previous projects. Cost analysis will be performed on the proposed rates that will be used in determining reasonableness and probable cost of future projects, and the offeror's understanding of the work and ability to perform the contract.

2. BID GUARANTEES AND PERFORMANCE BONDS

a. The solicitation shall require the submission of a bid guarantee in the amount of (20%) twenty percent of the guaranteed minimum amount.

b. Prior to commencement of work on an awarded task order, the contractor will be required to provide Performance and Payment Bonds in the following amounts: Performance Bond: 100% of the awarded delivery order amount. Payment Bond: 100% of the awarded delivery order amount. When additional bonding is required, the provisions of FAR 28.102-2(b)(1) and FAR 28.102-2(b)(2) shall apply.

IV.E. Additional Solicitation Provisions

Special Provisions for IDIQ Contracts:

FAR 52.216-27 – SINGLE OR MULTIPLE AWARDS (OCT 1995)

The Government may elect to award a single delivery order contract or task order contract or to award multiple delivery order contracts or task order contracts for the same or similar supplies or services to two or more sources under this solicitation. (End of provision)
