About this file

The amendment removes requirements for offerors to provide rationales for profit rates above 7% and direct labor rates lower than those stated in the solicitation. Revised pricing proposals are optional and due by July 22, 2021. Dear Valued Industry Partner, Please be advised that the accompanying solicitation amendment has been issued to the One Acquisition Solution for Integrated Services (OASIS) Small Business Pools 1, 3 , and 4 On-Ramp solicitation number GS00Q-13-DR-0002. This amendment was issued in response to the U.S. Court of Federal Claims (COFC) ordered corrective action in the case of Wavelink Inc., v. United States, No. 20-749C (sealed). Because this order is under seal, GSA cannot provide further details about the reason for the amendment at this time. The amendment also addresses issues raised in the COFC protest of Digiflight, Inc. v. United States, No. 20-0764, currently under appeal at the U.S. Court of Appeals for the Federal Circuit, Case No. 21-1486. This amendment is a post solicitation closing amendment and will not be posted on SAM.gov, but will be provided to each offeror who responded to the solicitation in a timely manner by the closing date for proposals.
The amendment only affects the documentation required by which GSA evaluates the price reasonableness of ceiling rates for task orders that are issued as FAR 52.216-30 Time-and-Materials/Labor-Hour Proposal Requirements--Non Commercial Item Acquisitions Without Adequate Price Competition, or FAR 52.216-31, Time-and-Materials/Labor-Hour Proposal Requirements--Commercial Item Acquisition where there is an exception to fair opportunity.
This letter serves as your notice of the amendment pursuant to Federal Acquisition Regulation (FAR) 15.206(c). Please be advised of the following:
1) The amendment removes the requirement for a rationale to support profit rates higher than 7%.
2) The amendment removes the requirement for a rationale to support vendor offered direct labor rates that are lower than the lowest direct labor rate stated in the solicitation. GSA does not intend to conduct price or cost realism analysis;
therefore, any offeror who offered direct labor rates lower than the low range will not be removed from award consideration due to offering “too low” pricing. This amendment aligns the solicitation text with the price reasonableness analysis performed under the previous proposal evaluations.
3) As a result of the amendment, GSA will allow revisions to any aspect of pricing proposals. The scope of the OASIS SB contract’s requirement has not changed
819 Taylor Street Fort Worth, Texas 76102 www.gsa.gov/oasis and the contracting officer has determined that the amendment will have no impact on the non-price elements of the proposal, therefore, no other revisions will be allowed.
4) Offerors are not required to update or resubmit a revised pricing proposal, the submission is optional.
5) If an offeror’s price proposal was determined to be fair and reasonable under the previous evaluation, submitting a revised pricing proposal is not necessary and will not make a proposal more competitive. Revised pricing proposals will not affect an offeror’s technical score.
6) GSA will accept questions about this amendment, submitted by July 8, 2021.
USE THIS FORM TO SUBMIT QUESTIONS found here. The CO will provide responses to questions by July 15, 2021. Responses to questions will be distributed to each offeror directly via email, just as this letter and attachment have been issued.
7) Revised Pricing proposals are due by July 22, 2021 by 5PM CST.
8) All proposals shall be evaluated in accordance with the amended solicitation.
9) If warranted, the CO will issue additional contract awards to qualifying offerors at the conclusion of the evaluation. No previously awarded contracts will be terminated, rescinded, or cancelled as a result of additional contract awards.
If you have any additional questions or concerns, please contact me at hattie.henry@gsa.gov.
Sincerely, Nita Henry Contracting Officer OASIS Small Business
