About this file

This document is a Question and Answer record from History Colorado (GLRR) addressing clarifications for RFP 2016-142, a Lebanon Mine Safety and Egress project rebid. The file contains responses to contractor inquiries regarding project scope, bonding requirements, and environmental permitting obligations. Key clarifications indicate that the contract will only include Phase 1 work initially, with Phase 2 (Add/Alternates) contingent on bids coming under the total project budget amount. Performance and payment bonding is required only for the first phase of work, not for any potential future unfunded phases. Contractors will not be responsible for treatment or permitting of ongoing natural mine water discharge that may occur after the collapse pile removal, and evaporation of mine water is not permitted as a discharge method.

The project requires contractors to comply with standard construction site discharge permitting requirements for mine water management. The responses clarify the financial and operational boundaries of contractor responsibility, limiting bonding obligations to Phase 1 and explicitly excluding contractor liability for post-construction natural mine water discharge from the Everett mine. This structure protects contractors from potential future financial exposure related to unfunded project phases while clearly defining environmental compliance boundaries for the active construction phase.

2015-109M14 Lebanon Mine Safety and Egress Re-Bid Questions

Questions for RFP 2016-142

Are the responses to the questions asked for 2016000194 applicable to 2016000142?

Yes

Is it the intention of History Colorado that the contract would include both phases of work, even if the second phase does not have funding allocated as yet?

No. The contract will only include Add/Alternates if a bid comes under the total project amount.

If the contract will be for both phases, is the Contractor required to post performance and payment bonding for the unfunded second phase, which could be a year out, thus tying up bonding capacity for a future phase with uncertain funding?

Performance and payment bonding is only required for 1st phase.
