About this file

This is a compliance certification form required by 2 C.F.R. 200.321 for the City of Port Orange's Mitigation Reconstruction of a Flood Prone Home Project in Florida. The form mandates that bidders certify their commitment to including small and minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs) in subcontracting opportunities whenever possible. Bidders must demonstrate affirmative steps including placing qualified enterprises on solicitation lists, actively soliciting such firms as potential sources, dividing requirements into smaller tasks when economically feasible to maximize participation, establishing delivery schedules that encourage participation, and utilizing support services from organizations such as the Small Business Administration and Minority Business Development Agency.

The form clarifies that these requirements do not impose mandatory set-asides for awards to MBEs/WBEs/VOBs/LSAFs but rather establish expectations for documented affirmative action efforts. An authorized company representative must sign and certify full compliance with these requirements, and the completed form must be submitted with the bid proposal. This certification requirement applies to all contractors bidding on the home rebuild project, which involves installation of a new elevated manufactured home in a Port Orange manufactured home park community.

FORM 7.17 – COMPLIANCE WITH 2 C.F.R. §200.321

Contracting with small and minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs)

The undersigned bidder hereby certifies that _________________________________________________ has taken (Name of Business) the next affirmative steps, if subcontractors are to be used, to ensure that MBEs/WBEs/VOBs/LSAFs are used, whenever possible:

i. Placing qualified MBEs/WBEs/VOBs/LSAFs enterprises on solicitation lists;

ii. Assuring that MBEs/WBEs/VOBs/LSAFs are solicited whenever they are potential sources;

iii. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by MBEs/WBEs/VOBs/LSAFs (however, this requirement does not authorize the City to break a single project down into smaller components in order to circumvent the micro-purchase or small purchase thresholds so as to utilize streamlined acquisition procedures (e.g.

"project splitting");

iv. Establishing delivery schedules, where the requirement permits, which encourage participation by MBEs/WBEs/VOBs/LSAFs; and

v. Using the services and assistance, as appropriate, of such organizations as the Small Business Administration and the Minority Business Development Agency of the Department of Commerce.

The requirement outlined above does not impose an obligation to set aside either the award of a subcontract to MBEs/WBEs/VOBs/LSAFs. Rather, the requirement only encourages carrying out and documenting the affirmative steps identified above.

As the person authorized to sign this statement, I certify that this firm has complied fully with the above requirements.
