About this file
This is a subcontractor and supplier disclosure form used by the Los Angeles County Metropolitan Transportation Authority (LACMTA) for non-federal set-aside projects. The form requires prime contractors to list all first-tier subcontractors and suppliers, including both small business enterprises (SBEs) and non-SBEs, to be utilized on the project. Completion of this form, along with Form 3 (Business Data Sheet), fulfills the requirements of the California Subletting and Subcontracting Fair Practices Act. The form accommodates up to ten subcontractors or suppliers and requires identification of each business entity's classification, including whether the firm is an SBE, manufacturer, supplier, or broker.
The pricing structure provides differentiated SBE credit calculations based on business classification. For SBE suppliers providing materials or supplies, only sixty percent of the cost receives credit toward the SBE goal, with the remaining forty percent attributed to the non-SBE portion. For SBE brokers, only broker fees and commission markups qualify for SBE credit, not the full contract value. The form requires the total proposal or bid price breakdown to match the overall bid amount submitted, with a separate line item identifying total SBE commitment. Metro retains authority to review and validate appropriate credit calculations in accordance with 49 CFR Part 26.55 regulations governing disadvantaged business enterprise programs.
