About this file
This is a Plans & Specifications Acceptance Letter from the Florida Department of Environmental Protection (FDEP) to Bay County regarding the Water Treatment Plant Resiliency Project. The letter, dated April 17, 2026, confirms that FDEP has accepted the plans and specifications for the construction of three additional sand gravity type filters at Bay County's Water Treatment Plant located at 3400 Transmitter Road, Panama City, Florida. The acceptance is effective April 17, 2026, and authorizes the project to be advertised for competitive bidding. Sealed submissions for the project will be received by the Bay County Board of County Commissioners until 2:00 p.m. on Thursday, June 4, 2026, with public opening of submissions to follow immediately after the deadline. FDEP requires prior approval before Bay County may award the construction contract and notes that construction disbursement requests cannot be processed until such authorization is issued and the construction loan agreement is executed. Additionally, Bay County must notify FDEP of the preconstruction meeting date and time, and all addenda and change orders must be submitted to FDEP for review.
The project is funded through the State Revolving Fund Loan Program under Chapter 62-552, Florida Administrative Code. FDEP's review focused exclusively on administrative conformance with State Revolving Fund requirements and did not include technical review to avoid duplicating the work of permitting agencies. Bay County is cautioned that improper or unauthorized procurement may result in disqualification of contract costs for funding. Tim Owens, P.E., Project Manager for the Drinking Water State Revolving Fund Program within FDEP's Division of Water Restoration Assistance, is the designated contact for questions regarding the approval and project administration.

Re: Plans & Specifications Acceptance – Bay County (DW0302J) Bay County Water Treatment Plant Resiliency Project (Additional Filters)
Dear Mr. Allen:
The plans and specifications titled “Water Treatment Plant Resiliency Project “are in conformance with the requirements set forth in Chapter 62-552, Florida Administrative Code. These documents are accepted effective April 17, 2026.
Our review of the plans and specifications was performed only to verify conformance with the administrative requirements of the State Revolving Fund Loan Program. We did not review the technical aspects of the documents in order to avoid duplicating the review performed or that may be performed by the permitting agency or agencies.
As a result of document acceptance, this project may now be advertised. You will need approval from the Department prior to awarding the contract for the construction of the project. Upon review of the complete bidding information for this project, the Department will authorize the award of the contract. Construction disbursement requests cannot be processed until this authorization has been issued and the construction loan agreement has been executed. Once the preconstruction meeting has been scheduled please notify the Department of the date and time. Additionally, all addenda and change orders issued for this contract must also be submitted for our review. Note that improper or unauthorized procurement may result in the disqualification of contract costs for funding.
