Addendum to 52.212-2, Evaluation – Commercial Items
Addendum to 52.212-2, Evaluation -- Commercial Items
1. The Government intends to award a contract resulting from this solicitation to the responsible offeror whose proposal conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following evaluation factors shall be used to evaluate proposals and are listed in descending order of importance:
Mission Capability Past performance Price
When combined, Mission Capability and Past Performance are approximately equal to price.
2. Options. The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a proposal is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
3. A written notice of award or acceptance of a proposal, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the proposal, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept a proposal (or part of a proposal), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
4. BASIS FOR AWARD
a. This acquisition will utilize the Performance Price Trade-Off (PPT) technique to make a best value award decision in accordance with FAR Part 15.101-1. The mission capability, past performance, and price volumes will be evaluated separately. Any offeror who does not submit a complete package consisting of all of the elements described in the Instructions to Offeror may automatically be considered non-responsive. Therefore, non-responsive proposals will not be considered for award. The application of the PPT technique in the contract award selection and approval process is as follows:
b. A decision on the mission capability acceptability of each offeror’s mission capability proposal shall be made. Only those Offerors determined to be acceptable, either initially or as a result of discussions/clarifications, will be considered for award. Note: In accordance with FAR 52.215-1(f) (4), as prescribed in FAR 15.209(a), “The government intends to evaluate proposals and award a contract without discussions with Offerors” (except clarifications as described in FAR 15.306(a)). Therefore, each initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offerors, accept other than the lowest offer; and waive informalities and minor irregularities in offers received if such action is in the public interest.
c. Each offeror is required to demonstrate capabilities and experience in providing project services. Elements included in the evaluation process that will be rated include mission capability, past performance, and price.
d. All mission capability acceptable offerors will receive a performance confidence rating of Exceptional/High Confidence, Very Good/Significant Confidence, Satisfactory/Confidence, Neutral/Unknown Confidence, Marginal/Little Confidence, or Unsatisfactory/No confidence based on past performance information available to the Contracting Officer.
e. All mission capability acceptable offerors will then be ranked by evaluated price. Note: The Government reserves the right to reject proposals priced either so unrealistically high, or so unrealistically low, as to indicate an inherent lack of understanding of the requirements in the Performance Work Statement (PWS).
f. If the lowest evaluated price, mission capability acceptable offeror has also received an Exceptional/High Confidence performance risk rating, this offeror’s proposal represents the best value for this acquisition and award shall be made to this offeror, subject to a positive responsibility determination.
g. The government reserves the right to award a contract to other than the lowest evaluated price offered if that offeror’s performance confidence rating warrants such a trade-off. In these cases, the Contracting Officer shall use good business judgment in making the best value award decision.
h. The Government intends to award one contract for the maintenance of substations B and D. However, the Government reserves the right to award no order at all, depending on the quality of the proposal(s) submitted and the availability of funds.
5. EVALUATION FACTORS
FACTOR 1: Mission Approach:
Offererors shall demonstrate that they have performed the following within the last 3 years.
1) Insulation Power Factor (Doble) tests on a 69kV or higher voltage power transformer.
2) Insulation Power Factor (Doble) tests on a 69kV or higher voltage gas circuit breaker.
3) Timing and travel test on a 69kV or higher voltage gas circuit breaker.
