52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Price, Past Performance and Technical: (i) price; (ii) technical capability of the item offered to meet the Government requirement; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

This will be a Lowest Price Technically Acceptable (LPTA) award. Technical and past performance, when combined, are Less Important than Price.

Technical will be evaluated as follows:

Technical Acceptable/Unacceptable Rating Method

Adjectival Rating
Description
Acceptable
Proposal meets the requirements of the solicitation.
Unacceptable
Proposal does not meet the requirements of the solicitation.

*The purpose of the technical factor is to assess whether the offeror’s proposal will satisfy the Government’s minimum requirements.

Past Performance will be evaluated as follows:

Past Performance will be evaluated in accordance with FAR 15.305 and DFARS 215.305. Past performance shall be initially evaluated to determine whether the offeror’s present/past performance is recent, and relevant or not relevant to this acquisition. The Government, for this effort, shall consider recent to be any similar or like Government or Non-Government contract within the past ten years that is considered relevant. The Government shall consider relevant to mean any similar or like contract that provided similar types of cleaning in size and scope of this effort.

Adjectival Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a

reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (*See note below)

Unacceptable
Based on the offeror’s performance record, the Government does

not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

*No recent or relevant past performance shall be determined to have unknown past performance. In the context of acceptability/unacceptability a neutral rating will be considered “acceptable.”

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
