RFI#2 Exterior Construction Contract

Question: 1. The Government's response (Attached), states in part that:

"Teaming agreements/commitment letters will not be recognized because the Government is only contractually bound to the prime contractor."

2. However, FAR 9.603 states that "The Government will recognize the integrity and validity of contractor team arrangements; provided, the arrangements are identified and company relationships are fully disclosed in an offer or, for arrangements entered into after submission of an offer , before the arrangement becomes effective."

My interpretation as it currently reads is that the Government response is not consistent with FAR 9.603.

Please advise?

As an example: Concierge Business Solutions, Inc. (Prime contractor, licensed Georgia general contractor, 8a, HUBZone, SDVOSB).

Intends to form a teaming arrangement with an Architectural Services firm (Subcontractor, licensed, architect, 8a, SDVOSB) and a national roofing firm (subcontractor)

Based on the example above, does the Government's response mean that this teaming arrangement and combined past performance will not be recognized by the Government even if it is clearly identified and fully disclosed in our proposal?

Government Response: The Government will recognize and permit valid teaming arrangements for this solicitation. However, in accordance with FAR 9.604(b) the policy recognizing teaming arrangement does not limit the Government’s rights to determine the responsibility of the prime contractor (see subpart 9.1). The Special Standards of Responsibility must be met and obtained from the prime contractor and/or approved Joint Venture Partner. Past performance is not being evaluated as a part of this solicitation.
