QUESTIONS FOR RFP FA8501-13-R-0016 as of 22 AUG 2013
Question 1: Reference RFP Section L, Instructions, Paragraph C., and Section M, Evaluation, Paragraph 1.D: The paragraph states that failure by the applicable offeror/joint venture partner(s)/subcontractor to submit TCIR/DART or other comparable rates may result in the offeror being considered as failing to meet the RFP terms and conditions. If the Prime contractor does not have these available, will a signed statement attesting to known injuries/days away be accepted as meeting the terms and conditions?
ANSWER: Section L clearly explains this. As part of Volume I, for each of the past three (3) calendar years ending with the calendar year immediately prior to the calendar year in which this solicitation is being issued, you must submit your Total Case Incidence Rates (TCIR) and Day Away, Restricted, and or Transfer Case Rates (DART) for the standard Industrial Classification System (SIC) code or North American Industrial Classification Systems (NAICS) code for the applicable industry as identified on the face page of this solicitation. If TCIR/DART rates are not maintained, you can submit comparable insurance rates or compensation injury rates. Therefore, no, a signed statement would not be acceptable.
Question 2: Reference RFP Section L, Instructions, Paragraph C., and Section M, Evaluation, Paragraph 1.D: The paragraph states that failure by the applicable offeror/joint venture partner(s)/subcontractor to submit TCIR/DART or other comparable rates may result in the offeror being considered as failing to meet the RFP terms and conditions. If the Prime contractor of a Prime/Subcontractor offeror does not have any rates available, will the offeror be considered as failing to meet the RFP terms and conditions?
ANSWER: Again, Section L clearly explains this. Not submitting any TCIR/DART or other comparable rates, at all, would result in in the Government determining an offeror as failing to meet the terms of the RFP. But just to restate Section L, it also says that you may submit comparable insurance rates or compensation injury rates if you don’t have or maintain TCIR/DART rates.
Question 3: Ref. Section L-900, Proposal Requirements; Paragraph A states: “In accordance with FAR 13.003(f); 14.202-8 or 15.203(c), electronic commerce methods to receive proposals, modifications, and revisions is permitted and preferred. Contracting Officer’s email address for submissions is matthew.wright@robins.af.mil and brandi.morris@robins.af.mil .” Yet in the table provided as well as Paragraph (1) reference is made to instructions for submitting printed proposals.
-Please clarify if proposals are to be submitted electronically or in printed format.
-If electronic submission is permitted, please clarify the number of “copies” and if a CD is also required.
-Please clarify the statement that “Each electronic volume within the proposal notebook shall be separately tabbed and identified.” Please define “proposal notebook” and describe how the Government wish the tabs to be provided in the electronic volume.
ANSWER:
Both paper and electronic format are required per Section L.
If you look in Section L, Paragraph A, the chart there clearly states that one (1) electronic copy* and three (3) paper copies are to be submitted for Volume I. The same directions are given for Volume II. The asterisk next to “1 Electronic” copy says to use a “*CD-R or DVD-R (write once/read only). CD-R/W or DVD-R/W media types are not acceptable”.
The Government is clarifying that the CD or DVD should be clearly labeled. Typically when contractors provide both paper and electronic copies, they do so, for example, by providing the Government with a 3 ring binder/notebook. If the contractor is providing the paper copy of Volume I, the sections of Volume I are labeled (for example: Completed SF33, Voluntary Protection Program Information, Mission Essential Services Plan). If the electronic version is provided with the notebook, the CD or DVD will be clearly labeled as well (for example, the CD or DVD is labeled “Completed SF 33”, etc).
Question 4: Reference Section M - Evaluation Factors, 2.A. Past Performance Factors (Relevant and Somewhat Relevant) Page 71 of 74; In order to achieve a Past Performance rating of Relevant, all 5 of the bulleted items must be met. Please validate the first bullet requirement of a “minimum workload of 30,000 aircraft operations (including aircraft arrival / departures) per year”, as the workload estimates for this opportunity are only equal to approximately 10,908 per year. In our experience, it is highly unlikely that any air force installation with contracted airfield management handles 30,000 aircraft operations per year, therefore it would be near impossible for any offeror to meet this experience requirement.
ANSWER: The 30,000 aircraft operations is inclusive of arrivals/departures; local sorties, transient, HHQ, airshows, hurricane evacuation, etc… The workload estimate is only representative of the Airfield Management Operations Coordinator AIS-R flight planning and does not include the TACC, civilian, and ANG filed flight plans.
Question 5: Reference PWS paragraph 1.6.1 Airfield Inspections; Please confirm that the AFM/AAFM are employed by the Contractor. The last sentence of the paragraph states that “The individual completing the inspection (AFM/AAFM or contractor) shall…” thereby making it appear that the AFM/AAFM are not employed by the contractor. Please confirm.
ANSWER: The AFM/AAFM are civil service employees and are not employed by the contract. The Contract requirement PWS paragraph 1.1.1 is for a site manager (Airfield Management Operations Manager) with Special Experience Identifier (SEI) 368 qualifications
Question 6: In CLINS X000X the following statement appears:
NOTE: The contractor warrants that the prices proposed in this solicitation (and resulting contract) do not include any allowance for any contingency to cover increased costs covered by a wage adjustment IAW the Collective Bargaining Agreement (CBA) attached, and FAR 52.222-43 Fair Labor Standards Act and Service Contract Act -- Price Adjustment (Multiple Year and Option Contracts)
Discussion: The CBA provided, lists wages and benefits effective 1 April 2013 and 1 April 2014. The solicitation also lists a base period of performance beginning 1 January 2014 to 31 December 2014 on page 25. The time period of the base year and first option year crosses over the CBA years. The first option year includes 3 months of the time period covered by the CBA rates effective 1 April 2014, 1 Jan 2015-31 March 2015.
New rates would be negotiated for the period beginning 1 April 2015.
With the "Note" included in the text in Schedule B, it is unclear if the Government is desiring for offerors to price their services with the "known" 2013 and 2014 rates in the CBA through 31 March 2015 or to use the "current , 1 April 2013" CBA rates throughout all the periods and use CLINS X0005, X0006 and X0007 for all adjustments to including the rates effective 1 April 2014. Please clarify.
ANSWER: Most contractors who work with CBAs would already know this, but the “NOTE” was included in Schedule B only because the Government wanted to reiterate (IAW FAR 52.222-43) the fact (in case an offeror had never dealt with a CBA before) that the contract prices proposed for CBA covered labor should not include amounts for known or projected increases in wage rates, fringe benefits, or allowable accompanying costs that may become effective after the base period of the contract. The base year for this contract is 1 Jan 2013 through 31 December 2014. CLINS, X005, X006, and X007, are for wage adjustments. The presence of CLINs 0005, 0006, and 0007 may be causing some of this confusion. These CLINs will be removed because they are not a necesity for the base year (because the base year would not need a wage adjustment).
Question 7: Will the government please verify the base period of performance as 1 January 2014-31 December 2014.
ANSWER: Yes, the base period of performance is 1 Jan 2014- 31 Dec 2014.
