MEMORANDUM FOR INTERESTED PARTIES

FROM: 773 ESS/PK

3515 S. General McMullen, Ste. 200 San Antonio, Texas 78226

SUBJECT: Questions and Government responses pertaining to solicitation FA8052-20-R-0001 for the Air Force Drug Testing Laboratory Support Services requirement

The purpose of this memorandum is to provide Government responses to Offeror questions regarding solicitation FA8052-20-R-0001 for Air Force Drug Testing Laboratory Support Services. Each question listed below was received prior to the time and date marked on the bottom of this memorandum.

1. Question/Comment: As a threshold matter, please clarify the requirement for a Facility Clearance because there appears to be information may be conflicting. The PWS requires an FCL, but it is not clear whether that is necessary and whether contract personnel will need Personnel Clearances. PWS 3.3.4 states that a Tier 3 (investigation for Secret) is not required, and 3.3.9.1 says the requirement of a PCL depends on whether contract personnel will have IT- Level I, II, or III access. Finally, in 3.3.9.2, the PWS states that the Government will run the Personnel Security Investigation through the IPO, which suggests that that a FCL may not be necessary (as they typically are not in our experience with DoD laboratory services). Please advise.

a. Government Response: Facility clearance and security clearance refer to two different things. Facility clearance is AFDTL’s requirement to enter our building, which is a controlled access facility (due to the forensic nature of the AFDTL). To gain facility clearance, an individual must have been vetted and cleared by the contractor through a local background check. Note that this presumes an individual does not already have a valid CAC.

If an individual has a valid CAC, then the individual will be granted clearance. Security clearance is a DoD term that refers the level of information a member has access to; in our case, AFDTL deals with mostly Position of Trust information. The security requirements for each position are: MEDICAL LABORATORY TECHNICAN-TEAM LEAD: Position of Trust, MEDICAL LABORATORY TECHNICIANS - SPECIMEN PROCESSING: Position of Trust, DATA ENTRY CLERKS: Position of Trust, ANALYTICAL SCIENTIST TASKS: Position of Trust, AFDTL INFORMATION TECHNOLOGY SUPPORT: Secret

2. Question/Comment: The RFP Attachment 10 – Past Performance Questionnaire template states that the questionnaires are due to the Government “no later than 04:00 PM Central Standard time on 01/22/2020”; however, the RFP instructions state the questionnaires are due “not later than the closing date and time for receipt of proposals”, which is 1/31/2020 at 12:00 PM CST. Please confirm that Past Performance Questionnaires are due to the Government no later than the due date/time of the proposal submission (1/31/2020 at 12:00 PM CST).

Page 2 of 17 1/24/2020 3:26 PM

a. Government Response: Past Performance Questionnaires are due to the Government no later than the due date/time of the proposal submission (1/31/2020 at 12:00 PM CST). The date identified in RFP Attachment 10 – Past Performance Questionnaire has been changed in beta.SAM.gov to reflect the correct due date/time; 1/31/2020 at 12:00 PM CST.

3. Question/Comment: Is the Data Entry Clerk currently being filled by an incumbent with an existing contract?

a. Government Response: Yes. Contract number FA8052-14-C-0015 was awarded to Eagle Applied Sciences on 18 September 2014.

4. Question/Comment: Is the Service Contract Act (SCA) applicable to this requirement? If not, can the Government remove it from the solicitation?

a. Government Response: Yes, the Service Contract Act is applicable to this requirement;

therefore it will not be removed from the solicitation.

5. Question/Comment: If the Service Contract Act (SCA) applicable is applicable to this requirement, then can the Government confirm the positions in which it applies with the labor category and WD-Code?

a. Government Response: Yes. Service Contract Act WD # 2015-5253, Revision # 10, Last Revised on 23 December 2019 is applicable to this requirement. The applicable Occupation Code – Title(s) are as follows:

(1) 01051 – Data Entry Operator I

(2) 12130 – Medical Laboratory Technician

6. Question/Comment: Are we required to include any of the Clauses in the proposal? Reps and Certs?

a. Government Response: No. SAM reports will be pulled at the time proposals are received to validate status and Representations and Certifications.

7. Question/Comment: Do we need to include confirmation that SAM is up to date?

8. Question/Comment: Is there an incumbent? If so, who is it and what is the contract number?

a. Government Response: Yes. There are three (3) separate incumbent contractors currently providing services. The pertinent information for each incumbent contractor is as follows:

Page 3 of 17 1/24/2020 3:26 PM

(1) Contract number FA8052-14-C-0015 was awarded to Eagle Applied Sciences on 18 September 2014.

(2) Contract number FA8052-16-C-0032 was awarded to ADC Management Services, Inc. on 26 September 2016.

(3) Contract number FA8052-16-C-0034 was awarded to Abacus Solutions Group, Inc.

on 29 September 2016.

9. Question/Comment: Should we include a VOL I - Admin Volume to include the Cover letter, Exceptions/assumption, 1449 and Amendments, acceptance, etc., or do we include these in the Pricing Volume?

a. Government Response: An Administrative Volume is appropriate for inclusion of the Proposal Cover Sheet, Subcontracting/Teaming Agreements, Exceptions/Assumptions, Attachment 03, and Attachment 11 (if submitted). The Price Volume should include both Section B of the Standard Form 1449 and Attachment 08_Pricing Schedule.

10. Question/Comment: In Attachment 06, page 3, para 3c, it talks about the technical volume (identified as Part 1- Technical. Is there a Part II and/or Part III? It also talks about Factor I, II, and III. Which is correct?

a. Government Response: Reference Attachment 06_Addendum to 52_212_1_ITO_Commercial Items. Attachment 06 has been revised. There are no “Parts” to this solicitation. There should be four (4) Volumes included in an Offeror’s proposal. The Volumes and contents are as follows:

(1) Administrative Volume

(a) Proposal Cover Sheet – 1 page

(b) Subcontracting or Teaming Agreements

(c) Exceptions/Assumptions – no page limit

(d) Attachment 03_PWS_Appendix B_Organizational Conflict of Interest

(e) Attachment 11_Notification of Compliance with Contract Insurance Requirements

(2) Technical Volume – 5 page limit to synopsize technical and management approach and outline recruiting, hiring, training, and retaining personnel

(3) Past Performance Volume – 5 page limit to describe all contract references.

(a) Attachment 09A_Reference Information Sheet_Summary Data_Template – no more than 1 page (does not count toward Past Performance Volume page limit)

– no more than 5 pages (does not count toward Past Performance Volume page limit)

(c) CPARS for referenced contracts (if applicable) (does not count toward Past Performance Volume page limit)

(4) Price Volume

(a) Section B of the Standard Form 1449

(b) Attachment 08

Page 4 of 17 1/24/2020 3:26 PM

11. Question/Comment: Do we need to include a copy of the CPARS in the Past Performance Volume?

a. Government Response: Yes. If the past performance reference is in CPARS the contractor shall provide a copy with proposal submission.

12. Question/Comment: The Solicitation page 3-7 includes a Supplies or Services and Prices/Cost table. It is not clear from section 3 Piece Volume if we are complete that table and include it in the Pricing Volume. If not, it appears that the Pricing Volume is just the Attachment 08 Pricing Worksheet. Can you please confirm the contents of the Pricing Volume?

a. Government Response: The Price Volume should include both Section B of the Standard Form 1449 and Attachment 08_Pricing Schedule.

13. Question/Comment: Is Attachment 11_Notification of Compliance with Contract Insurance Requirements to be filled out and returned with the Proposal? If so, in what volume does it go in?

a. Government Response: Attachment 11 is not required but may be submitted with the proposal. Attachment 11 will be required once the contract is awarded. If submitted with the proposal, Attachment 11 should be included in an Administrative Volume of the proposal.

14. Question/Comment: It appears from para 2 n page 2 of Attachment 03_PWS_Appendix B_Organizational Conflict of Interest, “An Offeror/Contractor wishing to submit an offer for this procurement, or any Offeror/Contractor which provides or previously has provided support to AFMRA, must include the following as part of its offer”, that this COI attachment must be include in the proposal response. If so, in what Volume do we put it?

a. Government Response: Yes. Attachment 03_PWS_Appendix B_Organizational Conflict of Interest is to be filled out and returned with the proposal and should be included in an Administrative Volume of the proposal.

15. Question/Comment: Can you please confirm the due date/Time of the Past Performance Questionnaire (PPQ)? The Proposal is due on 31 January 2020 at 12:00 PM CST and from the Attachment 10_Past Performance Questionnaire_Template it appears that the PPQ is due 4:00 PM 22 January 2020. Would the Government consider making the PPQ due on 31 January, the same time as the Proposal?

later than the due date/time of the proposal submission (1/31/2020 at 12:00 PM CST). The

16. Question/Comment: Will a Sub’s Past Performance be evaluated at the same level as the Prime?

Page 5 of 17 1/24/2020 3:26 PM

a. Government Response: Yes. Prime and Subcontractor teaming agreements will have to be defined in the Administrative Volume of the proposal.

17. Question/Comment: What is the security clearance level required and will the Government be providing a DD254?

a. Government Response: MEDICAL LABORATORY TECHNICAN-TEAM LEAD:

Position of Trust, MEDICAL LABORATORY TECHNICIANS - SPECIMEN PROCESSING: Position of Trust, DATA ENTRY CLERKS: Position of Trust, ANALYTICAL SCIENTIST TASKS: Position of Trust, AFDTL INFORMATION TECHNOLOGY SUPPORT: Secret

18. Question/Comment: Can you clarify the Part Performance (PP) requirement? In Attachment 06_Addendum to 52_212_1_ITO_Commercial Items para 3d(1) states “provide at least one (1) but no more than a total of three (3) references” and para 4(4)(b) states “The total page limit to describe all five (5) contract references shall not exceed five (5) pages.

52_212_1_ITO_Commercial Items has been changed to reflect “Offerors shall provide at least one (1) but no more than a total of five (5) references meeting the recency and relevancy requirements cited below.”

19. Question/Comment: There are several Clauses that reference SCA however, there is no Wage Determination (WD) provided. Is this correct or in the Government going to provide a

WD?

a. Government Response: Service Contract Act WD # 2015-5253, Revision # 10, Last Revised on 23 December 2019 is applicable to this requirement. The applicable Occupation Code – Title(s) are as follows:

20. Question/Comment: Would a Commercial Lab that is doing the same type drug testing be considered relevant past performance and evaluated at the same level as a federal customer contract?

a. Government Response: Yes.

21. Question/Comment: If one of the Past Performance Questionnaires (PPQs) is not returned by the Government Client, and the other CPARS are Very Good or better, how would that Past Performance reference be scored? In Attachment 07_Addendum to 52_212_2_Evaluation_Commercial Items para 1b(2) it appears that it would be rated “Unknown Confidence” however it is not clear how that would roll into the overall Performance Confident Rating? Can you please clarify?

Page 6 of 17 1/24/2020 3:26 PM

a. Government Response: The Government will assign a single past performance confidence rating based on the integrated assessment of recency, relevancy, and quality of past performance for each Offeror whose technical proposals was rated “Acceptable.” The Government shall rank all Offerors by performance confidence rating and then by the Offeror’s total evaluated price. The Government wishes to award to the highest performance confidence rated Offeror at the best price for the requirement. Offerors without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably. These Offerors will receive an “Unknown Confidence” rating for the past performance evaluation.

22. Question/Comment: Will the experience and past performance of parent or subsidiary companies be evaluated if the proposal shows that a sister company lending its experience and past performance has made a firm commitment to have a meaningful involvement in contract performance?

23. Question/Comment: Are there any additional requirements that an offeror must address in its proposal in order to utilize parent or subsidiary company experience and past performance if the proposal shows that a sister company lending its experience and past performance has made a firm commitment to have a meaningful involvement in contract performance?

a. Government Response: Yes. Parent and subsidiary company teaming agreements will have to be defined in the Administrative Volume of the proposal.

24. Question/Comment: Are there specific or special evaluation criteria for rating the experience and past performance of an offeror who utilizes parent or subsidiary company experience and past performance if the proposal shows that a sister company lending its experience and past performance has made a firm commitment to have a meaningful involvement in contract performance?

a. Government Response: No.

25. Question/Comment: Are the Past Performance Questionnaires due (22Jan)? Can an extension be granted for PP since current 8a's with PP have CPARS on file and do not require the PP Questionnaire.

26. Question/Comment: Is Security clearance required at time of award?

Page 7 of 17 1/24/2020 3:26 PM

27. Question/Comment: The RMF accreditation was removed from the original draft PWS, however, it is noted in the Publications/Requirements that “The Contractor shall follow all applicable publications and references thereto, of which Risk Management Framework for DoD Information Technology is listed. Please confirm that Accreditation is NOT Required.

a. Government Response: The Risk Management Framework for DoD Information Technology accreditation is required.

28. Question/Comment: Considering Technical is more important than Past Performance, and the requirements are focused on recruiting efforts, we believe that 5 pages does not allow us to adequately describe how we will perform the work identified in the entire PWS. Will the government consider increasing the page count to 15 pages?

29. Question/Comment: Can you provide the bill rate for FTE's?

a. Government Response: Bill rates differ for all FTEs and incumbent companies.

Therefore the Government will not provide the bill rate for FTEs.

30. Question/Comment: Will the AF Sponsor the Security Clearance if the contractor does not have Clearance?

31. Question/Comment: May you please make the Past Performance Questionnaires due the same date/time as the proposals? With questions not due until 22 Jan, the same date currently as the PPQs, we will not receive the answers to questions until after the current PPQ due date. And answers to Q&A may impact what contracts we use for references. To avoid confusion on submitted PPQs and revisions to PPQs and PP information in the proposal, post Q&A, we kindly ask to make the due date for PPQs to be the same as proposals.

32. Question/Comment: Are previously completed and digitally signed (i.e. signed with a CAC) past performance questionnaires acceptable?

a. Government Response: Yes. However it is incumbent upon the Offeror to ensure the PPQs meet the recency and relevancy requirements.

33. Question/Comment: We understand that there is more than one incumbent for this requirement. Is there any change to the total number of FTEs when combining these contracts?

Page 8 of 17 1/24/2020 3:26 PM

34. Question/Comment: If we enter into a Prime-Subcontractor Teaming Agreement can we use past performance of our proposed subcontractor?

35. Question/Comment: Will the Government provide the original hire dates of the incumbent employees?

a. Government Response: Hire dates differ for all incumbent employees and companies.

Therefore the Government will not provide the hire dates for incumbent employees.

36. Question/Comment: Page 34 of the solicitation lists FAR 52.222-17 however EO 13495 has been revoked. Will the awarded contractor be expected to offer the first right of refusal to the incumbents?

37. Question/Comment: Attachment 06, page 3, section h states “Files shall not contain classified data and must adhere to the page limitations of ten (10) pages.” What does this apply to? The whole proposal?

a. Government Response: Yes. Proposals shall not contain classified data.

38. Question/Comment: Should the proposal consist of 1 document with all 3 volumes included?

a. Government Response: No. Each Volume of the proposal should be submitted separate from one another.

39. Question/Comment: Should we provide a proposal in 3 separate attachments (1 per volume)?

a. Government Response: Each Volume of the proposal should be submitted separate from one another.

40. Question/Comment: As a part of the cover sheet, it states we are to provide “the audit office with a point of contact/phone number; the administration office with a point of contact/phone number” What type of audit is this referring to? Is the administrative Office the same as the corporate office?

a. Government Response: This is referring to a DCAA or DCMA audit office.

Page 9 of 17 1/24/2020 3:26 PM

41. Question/Comment: Attachment 6, section 2, para h – Is 10 pages for the entire proposal submission? Please clarify. Section 3, para c states that the Technical Volume is limited to 5 pages. Section 3, para d(4) states “the total page limit to describe all 5 contract references shall not exceed 5 pages.” However, section 3, para a requires a 1 page limit for a company letterhead.

a. Government Response: Attachment 06 has been revised. There should be four (4) Volumes included in an Offeror’s proposal. The Volumes and contents are as follows:

(b) Subcontracting or Teaming Agreements

(c) Exceptions/Assumptions – no page limit

(d) Attachment 03_PWS_Appendix B_Organizational Conflict of Interest

52_212_1_ITO_Commercial Items, Section 2. c. The Contracting Officer and Contract Specialist are the sole points of contact for this acquisition.

44. Question/Comment: In which volume are the signed solicitation and amendments (if any) included?

45. Question/Comment: Who is the incumbent performing this work? What is the contract number?

a. Government Response: There are three (3) separate incumbent contractors currently providing services. The pertinent information for each incumbent contractor is as follows:

(1) Contract number FA8052-14-C-0015 was awarded to Eagle Applied Sciences on 18 September 2014.

(2) Contract number FA8052-16-C-0032 was awarded to ADC Management Services, Inc. on 26 September 2016.

(3) Contract number FA8052-16-C-0034 was awarded to Abacus Solutions Group, Inc.

on 29 September 2016.

46. Question/Comment: Please state whether a facility security clearance is required for this contract. If so, please state what level security clearance. If a clearance is required, please state whether the clearance must be held at proposal submission or if the Government will sponsor the contractor to receive a facility clearance.

controlled access facility (due to the forensic nature of the AFDTL). To gain facility

Page 11 of 17 1/24/2020 3:26 PM clearance, an individual must have been vetted and cleared by the contractor through a local background check. Note that this presumes an individual does not already have a valid CAC.

If an individual has a valid CAC, then the individual will be granted clearance. Security clearance is a DoD term that refers the level of information a member has access to; in our case, AFDTL deals with mostly Position of Trust information. The security requirements for each position are: MEDICAL LABORATORY TECHNICAN-TEAM LEAD: Position of Trust, MEDICAL LABORATORY TECHNICIANS - SPECIMEN PROCESSING: Position

47. Question/Comment: Please state what level of security clearance (if any) is required for each position on the contract.

a. Government Response: The security requirements for each position are: MEDICAL LABORATORY TECHNICAN-TEAM LEAD: Position of Trust, MEDICAL LABORATORY TECHNICIANS - SPECIMEN PROCESSING: Position of Trust, DATA ENTRY CLERKS: Position of Trust, ANALYTICAL SCIENTIST TASKS: Position of Trust, AFDTL INFORMATION TECHNOLOGY SUPPORT: Secret

48. Question/Comment: The Instructions state in 3.d(1) that at least one and no more than three references shall be cited for Past Performance, however, 3.d(4)(b) states 5 references. Please clarify what minimum number of Past Performance references are required and what number is the maximum a bidder may submit. Please note: Attachment 9A Reference Information Sheet also has space for up to 5 references.

49. Question/Comment: Is Attachment 11 – Notification of Compliance with Contract Insurance Requirements to be completed and submitted with the proposal? Or will it be required once the contract is awarded? If submitted with the proposal, please instruct where this document should be placed.

a. Government Response: Attachment 11 is not required but may be submitted with the proposal. Attachment 11 will be required once the contract is awarded. If submitted with the proposal, Attachment 11 should be included in an Administrative Volume of the proposal.

50. Question/Comment: Please provide instructions for how the Attachments 09a and 09B are to be compiled and submitted with the proposal. Should Offerors combine all documents into a single document volume and call it Past Performance or should they combine everything into a single Technical and Past Performance document volume?

a. Government Response: Attachment 09A and no more than five (5) copies of Attachment 09B are not counted against the maximum page limit. There is no page limit

Page 12 of 17 1/24/2020 3:26 PM established for information to describe each individual contract reference; however, there is a maximum page limit of five (5) pages allotted for all contract references. (Example: An Offeror may submit a Past Performance Volume that contains one (1) Attachment 09A, five

(5) different versions of Attachment 09B, and no more than five (5) pages of information describing each contract reference. Therefore, the maximum number of pages in a Past Performance Volume is eleven (11) pages. A single document volume, containing up to eleven (11) pages, is preferable for the Past Performance Volume, which should be separate from the Technical Volume.

51. Question/Comment: Please provide instruction for how to submit Attachment 03 - Organizational Conflict of Interest. Should it be submitted as a standalone document or incorporated into the Technical or Past Performance volumes.

a. Government Response: Attachment 03_PWS_Appendix B_Organizational Conflict of Interest is to be filled out and returned with the proposal and should be included in an Administrative Volume of the proposal.

52. Question/Comment: Since FAR 52.222-41, Service Contract Labor Standards (Aug 2018) is included in this solicitation, will the Government provide a Wage Determination for Offerors to reference while preparing our proposals?

a. Government Response: Yes. Service Contract Act WD # 2015-5253, Revision # 10, Last Revised on 23 December 2019 is applicable to this requirement. The applicable Occupation Code – Title(s) are as follows:

53. Question/Comment: Regarding staff travel identified in Section 2.5.6 of the PWS, please state which personnel will be traveling on each trip.

a. Government Response: If travel is required it is typically one of the Analytical Scientist FTEs.

54. Question/Comment: The PWS requires overtime of 1.5 times hourly rate be paid for hours worked in addition to 40 hours per week. Does overtime pay apply to all employees or only those in SCA labor categories?

a. Government Response: This is applicable to employees under the SCA.

55. Question/Comment: Reference: PWS Section 2.9.2.1.2. states that “the Contractor shall perform random drug screening of 50% of the contract employee end-strength assigned to this contract over every 12-month period.” Question/Comment: Will the Government consider revising Attachment 08 - Pricing Schedule to include an ODC line to account for drug screening costs?

Page 13 of 17 1/24/2020 3:26 PM
