Niagara Falls Air Reserve Station (NFARS) shall be responsible for the disposal of any spill waste generated during the project and the contractor shall reimburse NFARS for the disposal costs of such wastes. NFARS will be considered to be the generator of such wastes for purposes of disposal. The contractor shall maintain spill equipment and materials sufficient to handle the containment and clean-up of spills in the capacity of the project. The contractor must immediately report any and all spills or leaks to the 914th AW Fire Department at 911 from a base phone or 716-236-2117 by cell phone. In the event of a spill, the following information shall be reported:

- Description and amount of material spilled.

- Name of the person reporting the spill (with location and telephone number where they can be reached.)

1.14.8 Hazardous or regulated wastes shall be disposed of in the following manner:

On-Base: - Contractor calls 914th AW/CEV at 236-3124.

- CEV will provide proper HW container(s) to contractor.

- Contractor places labels/markings on containers and fills them as needed.

- Contractor contacts CEV to deliver waste containers into Building 830 (HW storage facility).

- CEV disposes of waste through DRMO contract.

1.14.8.1 JP-8 Jet Fuel in either its liquid form or absorbed into absorbent pads, booms or speedy-dry to create a waste solid are the only waste-streams expected to be generated from the work described herein.

The flashpoint of JP-8 is 100-degrees Fahrenheit, below the EPA minimum limit of 140-degrees for hazardous waste (HW). Therefore it has the EPA Waste Code or Number D001 due to its ignitibility characteristic. The reportable quantity for ignitable waste is 100 lbs. If disposed of, the DOT shipping name for JP-8 waste (in either liquid or absorbed form) is: Fuel, Aviation, Turbine Engine (JP-8 Jet

Fuel); Hazard Class 3, UN1863, Packing Group III. Emergency Response Guide (ERG) page number is

128. 55-gallon metal drums are the most common storage/shipping containers for this type of waste.

Reconditioned drums may be used for storage, but any containers used for shipping hazardous waste off-base to a disposal facility must meet DOT performance oriented packaging specifications outlined in 49

CFR. Should any HW be generated and stored in containers, the containers must be immediately labeled with a red HW adhesive label stating the contents and the date the waste was placed in the container. A diamond-shaped flammable liquid/solid HW class label should also be placed on the container. HW containers must be kept securely closed (so nothing would escape if container was tipped on its side) unless adding or taking waste from the container. The contractor must contact 914 CEV immediately when HW containers become full and turn-in such container(s) to CEV at B-830 (HW storage facility) within three (3) working days of becoming full. CEV will arrange for the HW container to be transported and delivered to an EPA-permitted Treatment, Storage or Disposal Facility (TSDF) within 90-days from the date HW was first placed in the container.

1.14.8.2 914 MSG/CEV is considered the generator of any hazardous waste liquid, sludge, or solids resulting from this scope of work. Accumulation, disposal, transport and handling of said waste materials shall be in accordance with all applicable local, state and federal and Air Force regulations.

1.14.8.3 All site personnel shall be required to submit a copy of their 40 HR. HAZARDOUS WASTE

SITE WORKER CERTIFICATE for review and approval by 914 AW/CEV personnel prior to beginning any work.

1.14.9 The contractor shall perform all work in a fire-safe manner in accordance with Niagara Falls ARS fire prevention standards available from Base Fire Department.

1.14.10 Portable fuel dispensing equipment and the dispensing of fuel, which includes diesel, unleaded gasoline, and propane, are not allowed on base unless prior written approval is obtained from the Base

Contracting Officer or his designated representative.

1.14.11 No Ozone Depleting Chemical (ODC) containing materials are allowed.

1.14.12 Contractor shall submit a Stormwater Pollution Prevention Plan (SWPPP) for approval by the

Contracting Officer and 914th AW/CEV prior to start of the project. For project activities with soil disturbance less than one acre, a SWPPP shall be developed in accordance with the “Niagara Falls ARS

Guidance for Stormwater Pollution Prevention/Erosion & Sediment Control Plan for Disturbances that are Less than One Acre”, most recent version. The Contractor shall be responsible for compliance with the SWPPP and all reports and documentation described within the SWPPP. The aforementioned guidance is available from the 914th AW/CEV (Environmental Office).

For project activities with soil disturbance equal to or greater than one acre, a NYSDEC SPDES General

Permit for Stormwater Discharges from Activity, GP-0-10-001 (or most recent version), shall be obtained.

The Contractor shall be responsible for compliance with this permit. The Contractor shall be responsible for all reports and documentation needed to comply with this permit including, but not limited to: the

Notice of Intent, SWPPP, inspection reports, NOT. The Contractor shall prepare all permit related documentation for approval by 914th AW/CEV or 914th AW/CEV designated entity prior to start of project activities. 914th AW/CEV or 914th AW/CEV designated entity shall submit all permits and permit applications, etc. to the appropriate regulatory authorities unless otherwise agreed upon between the Contracting Officer, 914th AW/CEV, and Contractor.

1.14.13 Contractor shall use recovered materials to the maximum extent possible. The Contractor shall divert a minimum of 50% by weight of total project solid waste from landfill disposal. The Contractor shall submit Solid Waste Diversion Reports to the Contracting Officer and 914

AW/CEV on the first working day after each quarter that non-hazardous solid waste has been disposed and/or diverted and shall be for the previous quarter (e.g. the first working day of January, April, July, and October). The report shall state the project name, project number, project duration, contractor name, name of contact, and phone number. Additionally, the report shall include the date the waste was disposed, waste type (i.e.

scrap metal, concrete, construction debris, etc.), disposal method (landfill, recycle, incineration, etc.), disposal location (facility name, city, state), total amount (in tons), and cost of disposal for waste generated. The contractor shall not use on base solid waste or recyclable containers unless prior written permission from the base 914th AW/CEV has been received.

1.14.14 Contractors shall certify that they have reviewed the HAZMAT Plan prior to commencing work and received a copy of the Quick Reference section of the plan. Contractors shall receive a briefing about spill response and reporting requirements as presented in the HAZMAT Plan.
